I had a investigation, the worker told me it was closed. However I have never received the letter that it was closed that was almost a year ago.

Thank you for your comment. Did you move during the investigation, if not, then contact the caseworker and if caseworker no longer works there speak to the supervisor. If it was indicated we believe you have right to appeal it and if it were unfounded you have the right know along with having documentation showing it. Hope this information helps but we suggest following up until you receive a physical document confirming.

Does not substantiated mean the same thing as unfounded? It seems like different states use different terminology.

Thank you for your comment. Unsubstantiated is an evidentiary term while unfounded is used by CPS to differentiate between indicated (ie founded) or unfounded. Sort of the same but different at the same time.

at 1:53 when he says it goes for an administrative hearing type thing all internally (he almost said within 3 days) because if they do the 3 day 'speedy trial' its forfeiting the jury trial. instead of a jury hearing and deciding, it is quickly decided by a public defender. that's what he means by internal.

The burden of proof for CPS is the lowest in the legal system. They only need to show some credible evidence to indicate their report. Sadly, this is backwards from the rest of the legal world, here you are guilty until proven innocent.

It is a requirement that you are presented with, or mailed the letter, as for the releases, I would question how they gained any information without a release signed. There are a few ways in which they can do this, but it is dependent on the case and the circumstances.

Thank you for your question. If CPS opened an investigation and you have not received correspondence from them about the status of the investigation then contact the caseworker. If the caseworker no longer works there speak to the supervisor. This is an administrative agency. If you are worried that you may be the subject of a neglect proceeding then you should consult an attorney about the details of your open investigation.

I made the mistake of letting cps in my home.. social worker gave me a information packet after the home investigation. She said there was nothing that she found.. so now what? Do I wait for a letter or is it still open?

“What do I have to prove?” I don’t have to prove to the government that I have not abused or neglected my children in order to remain a parent. The government has to prove that to me. I shouldn't have submit to lengthy interrogations, and undergo “voluntary” services to make sure that I am innocent. I just wholeheartedly embrace my 4th Amendment Right to be free from invasive searches. Stop harassing innocent parents & selling children to feed your f4t 4sses.

Thank you for your comment. You do not have to prove anything; however, we have found that you are guilty until proven innocent. You need a good attorney that is willing to represent you at all stages of a CPS investigation through a court proceeding. You are correct they need to prove the allegations but the system is set up for you to be so desperate that you cave into their recommendations and comply. Remember you do have a fourth amendment right to be free from invasive searches. This means they cannot come into your home with out your permission or without a warrant.

So there is no variance from case to case? I see this as a major issue. From my brief experience CPS has lost sight of its responsibility. Protect children. At least in my case. My parental rights were taken away by a default judgment that was an egregious error by judge. I hired attorney. They were disbarred. I couldn’t get released for over a year and then Covid hit and I still have no rights cuz too much time has passed. Explaining why I am allowed visits whenever mother allows. Which is 2-3 times a yr Feb10- it’s been 6 months. I get 2 hours supervised with mother at public library. She’s in another room of library. 90 minutes pass. My 5 yr old daughter is standing to my right facing me . I’m sitting . She reached over and grabbed my pants inappropriately. 30 seconds later she asked “when do I get to see u naked” and putting her in car seat to say goodbye I said Give me a kiss. She said , I want a kiss on the lips. I spent a week researching and trying to get mother to talk to me about behavior . She ignores. I have no choice but to call CPS. 6 professional therapists all said that’s a taught behavior and get my child protected. So I call. I get a fresh college graduate. I said, get the video from library camera before doing anything . So u can see exactly what she did and mother can take precautions. CPS calls, mom said everything is fine . They close the case. I was not notified of anything. I went to police and did report. They said call back to hotline. Same thing, get video. Nope. They interview daughter, no disclosure . I get a text. Daughter gave no disclosure of any abuse. I tried calling, texting. They closed case. This was in May. I didn’t know for sure case was closed til October. I was never communicated with . I haven’t received report. Video was never watched. Boyfriend wasn’t questioned because I never provided his name. I requested report in August. My take - Any potential child abuse has to be funneled through CPS.(Missouri)That’s beyond comprehension. Which means CPS better have their act together. The person doing intake that ignored my request. He just graduated. So the most critical part is done by people unqualified. No communication whatsoever. I actually expected to be interviewed in person. Many 5 yr olds aren’t going to make a disclosure of abuse. Questioning my child first was ridiculous. The biggest grind- if CPS is supposed to protect children, why wouldn’t the following take place? Get the video, show mother, “ma’am ur daughter is exhibiting behaviors that are very troubling . There’s no guarantee ur daughter will make any disclosures. If she doesn’t , it doesn’t mean a crime hasn’t occurred. Her actions are a high indicator someone has behaved inappropriately. We urge to take whatever actions u deem necessary to protect the child. Y on earth would that conversation not take place? CPS is only concerned with cases headed for court . And if a child doesn’t disclose , no investigation. I have wasted 8 months (and haven’t seen my daughter in that time) Tens of thousands of dollars wasted cuz instead of working , calling professionals for insight. And nothing is any different than 8 months ago except she has probably been abused more. Opinion???
