There has already been a legal case regarding a comic with ai generated images where the courts ruled that any aspects generated by ai and not made by a human cannot be registered for copyright. (The script that she wrote was hers so she could copyright that aspect but not the images which she generated using one of the popular large language models). Hence, depending on the amount of ai in your own comic, those aspects remain in the public domain so you can’t launch a complaint if someone else decides to use those specific elements.

That's the point. Devaluing human skills, so that corporations can lower salaries/fees or even replace human labor completely. So, if it's going according to Mattel, nobody will need the Four Horsemen or other artists anymore...

I don't think it goes that way. AI can't replace human judgment. It can remove some of the more mundane tasks. It can create a toy sculpt, but it will still be the human artist that brings their skill and judgment to the table to make it great. The best quote I've seen on this is "AI won't replace you; a person using AI will."

I think there's some laws about privacy that can relate to this. You have reasonable expectation of privacy. The police can't enter your home without a search warrant unless they see you committing a crime in plain view. This is with normal human vision. They can't bypass your privacy by using technology like an infrared camera. Same thing can relate to art. People say artists learn how to make new art by copying other artist's work all the time. This is true. What else is true is you can't learn another artist's style with perfect accuracy unless you paid them to teach you all of their secrets. Humans can only master so much on their own. AI art is essentially that infrared camera used by police to bypass your privacy. Normal human vision can't see through walls, but that camera can. Normal artists can't master your style, but AI can. You're using AI to bypass paying 100 artists to teach you everything they know. A feat that would be impossible for a normal human to learn on their own.

That "unique" superhero prompt sent a chill down my spine. There may come a time when Warner Bros. could have AI print out guidelines for how Martin Scorsese would direct a Batman movie. If that day comes, creative artists will be worth pennies on the dollar.

I don't think that's the way it's headed. It would be more like Scorsese asking AI to write a Batman movie for him and them him revising the script to bring his unique views to it. Studios won't rely on AI for content because they want to own the work product (and AI generated content has no copyright) and because AI lacks creative judgment.

I'm an artist myself, and I completely understand why so many artists are so mad about it. But if people are really honest about it, the AI is essentially doing the same thing artists have done for years... You pick up things from styles of your favorite artists - like the way they draw faces, eyes, hands, etc. The way they do shadows, the way they color, and so on and incorporate it into your own art. Most artists learn from adapting elements of other artists styles into their own unique, "new" style. AI isn't going away, and the courts seem to be allowing it. So a happy medium might be if the tools are forced to remove "in the style of THIS artist" for living artists prompts. Not allowing the generators to ape styles of artists.

You can use any artist's body of work to train an AI to output work in their style if you can get hold of a small number samples. The result won't be as good as commissioning the actual artist but if all you want is to approximate their style without paying them it works quite well- and the beauty of it is that none of your stylisitc rip offs will be actual copies of their work so they can't do anything about it. (The technique is using LoRA's to modify the base output of the AI to mimic specific styles.)

Large language models do not “learn” in the same way that humans do so comparing it to how artists come up with ideas is a misnomer. These models have also been found to spit out their training data or sections of to complete copies of the data they trained on. Large language models mash things together, an amalgamation of averages of whatever it “thinks” (these models are not sentient, contrary to what many tech companies are dishonestly claiming) will please the prompter.

@@paulhiggins5165and this is what you would refer to as illegal scamming because you don’t want to bother to pay the artist for the work while still wanting something that looks like their work. You’re essentially creating something through stealing in order to directly compete with (insert artist) in their own market using their own labour as the base. An artist has more than enough grounds to sue you and win in court over these types of shady practices.

Yes AI art is definitely stealing and no amount of mental gymnastics or justifications will change that, and I am sorry to say it is the only reason I didn't pick up your myth wars comic ( I wish you used an actual artist cause your story sounds cool)

As for the subject, it’s new to me. It looks like training AI may not be the most honorable until authors and artists are compensated OR flat out tag their work as “Not for AI input”. The Output on the other hand seems like collage and may be the art equivalent of defining GMO vs Non GMO. Good luck!
