When a landmark judgment was handed down by the Court of Appeal this Wednesday, Sudiksha Thirumalesh's family paid her a visit at the cemetery. They celebrated her courage, conviction and posthumous win, which ruled that her pleas to "die trying to live" were wrongly ignored and she indeed had mental capacity to make decisions about her treatment.
This judgment will affect thousands of other patients and their families, and reaffirm their right to disagree with their doctors without risking being declared mentally incompetent and having their best interests assessed and enforced by the courts.
We pray Sudiksha’s legacy will mean a more transparent, life-promoting attitude in our hospitals, courts and parliament.
