All bullion dealers should do this: "The payment of state sales tax is the responsibility of the buyer. We are not a tax collection agency and are not compensated by any state to collect their tax. Therefore, if you believe you owe taxes to your state, it's up to you to pay them."

Constitutionally speaking, Taxes were only supposed to be for Times of War and should have been restricted to Invasion of the mainland United States of America only. The 16th Amendment contradicts the Constitution, and is Repugnant. Therefor the 16th Amendment is Null and Void!

Florida resident here, This happened to me as well recently with some Silver Eagles purchase. I too complained and got the same canned response. Funny, I buy from two local coin shops when they have them and have NEVER been charged tax (on Eagles, Maple Leafs, Britannias, Philharmonics or Krugs). Even on fractional and one ounce gold coins same thing, no taxes. I wont be buying from JM Bullion again. Also, if I buy bars locally, anything over $500 no tax! I cant help but wonder if JM is actually paying the tax or are they just pocketing it as profit. I did notify the Florida Department of Revenue.

What I found to be very eye opening is that when I initially wrote them requesting the refund of the tax charged, I never mentioned why I was requesting the refund specifically - meaning I didn't quote any laws or regulations from Florida, I just simply mentioned I bought ASEs and that I was charged sales tax and shouldn't have been, please correct this. The response I got included the very line that I knew was bogus and that's the only line from the supposed Florida Tax law they shared with me in the email response - line (3) to be exact. Not line 1 or 2, 4 or 5...only line 3 which was very eye opening as right then I knew the customer service agent was coached or trained to provide that response - likely assuming the unsuspecting customer would let it go assuming it is indeed the law. They knew we would be writing about the tax, and they were ready to respond with their version of the law. The problem is of course, it isn't law!

My last JM experience… My order went missing from JM due to a glitch in their website (orders were not including the PO Box number) and they did nothing to investigate because they said it arrived at USPS. I had to deep dive into the problem myself. USPS denied it showed up. It actually turned into a federal investigation after UPS said they gave it to USPS. Wasn’t confirmed but I do believe someone at USPS was looking to take it once declared missing. UPS was awesome. They sent an investigator to USPS and literally told them to go find it. For three weeks it sat on a workers desk tucked away at USPS. Not a single person asked the question, hey does this person have a PO Box here?.. JM did nothing to help me out. It was a big order too. Edit: I’ve ordered from SD ever since, and quit going to that post office. I know JM isn’t a shipping company but I needed info for the insurance claim and it was time sensitive. I couldn’t get through to the appropriate parties there, nor would USPS do an investigation. The UPS investigator took initiative and truly helped me.

Sounds like a tough experience. I've had a couple issues with buying online. Usually the item shows up but I've also found that the dealers, JM Bullion being one I've had this experience with will respond with a tracking number and tell you to have a nice day. That's the extent of help they usually provide. I am happy to have read you got it resolved.

All ways require a signature on delivery and track it . There are some shady people working for the USPS .They will try to redirect your package and disappear it. Some states like my state requires the dealer to collect a state tax.@@floridastacker

I've had exactly the opposite happen with USPS and UPS - items ( including 50 pound bags of dog food ) sent USPS come right to the door : items sent UPS were thrown in the weeds where the drive meets the hiway some 800 feet from the house. Complaints to UPS were ignored until my daughter discovered one of her fellow teachers was married to a UPS higher-up. Magically, the service improved and that particular driver appears to be a former employee now. USPS employees know that silly crap like that will get them snorkel deep in serious ( Federal ) trouble.

I haven't bought any PMs in the recent years, but when I used to buy (and I bought exclusively from JM Bullion) more than 6 years ago, I was never taxed nor charged shipping no matter how small (such as less than $150) or how big (such as around $5k) my orders were. Times surely have changes, and people and companies too! 😟

That comment is on me. Call it PTSD from 4 years on KZitem and having an idea now from experience what comments to expect. Typically, in the past when I complain about Florida Tax law I get responses from those living in hellish blue states or Europe where they tax the air they breathe (or at least they would if they could). However, it appears most of the comments, about 99% of them have been positive so I was off in my forecast of what to expect!

@@floridastacker - It's not just JM Bullion - - it's now Florida law since 2023 and here's APMEX notice for Florida "Taxes must be collected on (1) bullion, non-US coins, or non-US numismatic coins if the total amount of a single sales transaction is less than $500; (2) non-US currency; (3) Copper; (4) accessory items; and (5) processed items. All other products sold by APMEX are exempt from these taxes."

When checking out, the tax has to be shown before the sale is completed. In Missouri, almost all metal is tax free, maybe there are limited exceptions. I've had orders that are mostly tax free, but I think some foreign coins may be taxed. Or attempted to be taxed, most places don't charge tax for Missouri at all. I say, always double check your final total before hitting the "Order" button.

I guarantee you they are not sending the collect tax to your state. That's tax fraud as well as mail fraud. Contact your state tax office to check if they are receiving the money. If not, file charges.

Unrelated but I used to purchase from Provident Metals before they were acquired by JM Bullion. Since that time, Provident changed their privacy policy and it reads like war & peace, amongst other atrocities allowing them to share personal and fiduciary information of customers to 3rd parties. They're now kryptonite to me. And since both firms are owned by the same parent company, I'll assume they have the same intrusive policies. My online dealers are Monument and Hero and have never had a problem with either.

Inform your state tax revenue department that they charged you state tax. They will then go after JM Bullion to get the money. If JM has not sent them the tax they will be in big trouble with your state.

I was told I would receive a response from their tax department in 1 to 3 days. Nothing yet. I'll share with the community when I do. You should not be paying state sales tax on American Silver or Gold Eagles or 90% Silver Coins or pre-33 US Gold Coins. Silver Bars, Foreign Coins, Ingots and other Bullion valued under $500 at the time of purchase is taxable. Anything above $500 should have no tax. What gets me is the policy stated on their webpage. Why wouldn't they just copy directly to the Florida document - the source of truth? That feels deceptive to me.

I'm up to 800 out in silver and 5 ozt in gold (25k & 10k $) I primarily shop with SD bullion, Pimbex and Hero bullion out of Texas. I have never been taxed, and some of my purchases were over $5,000.. I did briefly check out JM but I wasn't impressed with the prices so I moved on. This is an example of how the government is trying to keep us from buying precious metals because it interferes with their Central Bank digital currency aspirations and the Fednow digital currency. Dangerous times and all the more reason keep stacking! Thanks for the great information

Huh?? I've ordered thousands from them and never paid a penny. They told me processed items are taxable when I called them regarding JM Bullion ripping me off on .999 silver rounds. Copper for one instance is processed. I have never bought anything fitting that description.

I’ve always been happy with JM Bullion. I’ve probably ordered from them a half a dozen times. I am in Florida too. Florida Stacker made a good point in the video that everyone should learn their own tax law, because no one should be paying tax on whatever they buy. If I had to, I wouldn’t buy it.

Hi! Marshall Dressel here. I just viewed your latest video about JM Bullion charging tax on sovereign US silver coins. I’m willing to bet that Florida’s Revenue Service would be very interested in watching this video as it is HIGHLY ILLEGAL to charge “tax” and then retain those funds. I would advise JMB that you have cc’d a copy to the State Attorney’s General. This is a very quick trip directly to prison. No appeals, no technical fouls. Unless, of course, JMB call show that they sent that money to Florida’s Revenue Service. I would really like to hear JMB’s response!

I just put some items into my JMB cart to see if they charged sales tax. I live in Maryland. For purchases under $1000, they did charge Maryland sales tax. Above $1000, no tax was charged.

Thank you for commenting, Sal. I really wasn't paying attention at checkout. It was an order for 5 of the 1986 BU Silver Eagles. I needed just the 5 to finish that tube this month so I sprung for them. It wasn't until I was reviewing the order, I saw the tax added and decided to politely ask for it to be refunded. The big problem I see is that the tax information on their website regarding Florida law is completely different than...you guessed it...Florida law. That's a problem rather deliberate or by accident that I hope they correct.

I don’t buy from JM Bullion since they raises them princess but APMEX charge me taxes on a purchase of $530 on silver and I called them and they told me because was a numismatic coin I bought the same coins on Bullion Exchange and they didn’t charge taxes on it. Great video FS thanks 👍🏻💪🏻

The number one question I ask online bullion dealers is how my order will be taxed. In my state it's complex. >$1,000 orders, and under 115%/140% based on bullion type are not taxed. Had good luck with BE, plan to use them again moving forward.

I did have a similar incident happen to me this year, you can purchase bullion through Walmart fulfilled by apmex and I did make a purchase from them a gold piece that was taxed, but when I brought upbthe fact that bullion is not taxed in my state it was quickly rectified. And I have made many purchases through Walmart in this way and only had the one taxed, very random. Anyways your one if my favorite stacking channels, no bs. You just keep it real 👍

I have made several JM purchases. I am in Texas. I have never been taxed on any silver purchase. I did get taxed for copper rounds, but no tax for silver rounds or silver currency from any country including the US. Just monitor any purchase. With the copper rounds, I got a phone call from a human being in the USA and was explained that copper was not exempt like silver and gold and that I would be taxed on that purchase. I have had very good luck with JM Bullion.

Here in PA, there's no sales tax on any gold or silver, but I was charged tax on copper rounds. BTW ... Precious metals use ozt. (troy ounces), whereas copper is sold by the standard (avdp.) ounce.

Taken from Gainesville Coins website: As defined in Florida Statute F.S. §212.05(1)(j)1 and state code Rule 12A-1.0371, the following bullion and numismatic items are exempt from sales tax when shipped by Gainesville Coins to a Florida address: EXEMPT U.S. legal tender numismatic coins and currency are exempt in any amount; U.S. legal tender bullion coins are exempt in any amount; Numismatic coins and currency that are legal tender of a foreign nation and sold for more than face value are exempt in single transactions greater than $500; Bullion coins that are legal tender of a foreign nation are exempt in single transactions greater than $500. Coins and currency that are NOT legal tender in the U.S. or foreign country are exempt in single transactions greater than $500; Refined gold, silver, or platinum bullion bars, ingots, or plates sold by precious metal content instead of form, in single transactions greater than $500.

Actually SD also states that coins under $500 are taxed in FL. By using the word coin I’d imagine they’re referring to legal tender

I'm so tired of the b.s. going on in our country today literally punishing people for being responsible while advocating for those who are not. I have very little power over anything. I have maybe 400 friends on social media in my real life of which maybe 30 I actually see from time to time. I am much more influential here with my KZitem channel as it gets a broader reach, so I have no problem using it to call out the b.s. when I experience it.

Florida Stacker, when I jumped into the Gold & Silver stacking community (more like obsession), I bought almost exclusively through Provident Metals. They almost always seemed to have the best price on most bullion, and the customer service was excellent. Fast forward to a couple years (or so) ago, and Rip-Off-Mex swallowed them up, along with JM Bullion. It didn’t take but a few months (if that) before their prices ballooned, just about matching Rip-Off-Mex’s prices. Needless to say, I haven’t purchased anything from them since. I refuse to pay exorbitant premiums, in order to fill the pockets of the greedy, and I don’t care about the whining of overhead due to larger variety. My go-to now is Bold. Almost always the absolute lowest prices on bullion, and many semi-numismatics as well. Let’s face it, as consumers, and as stackers, we have to go where the money is (that is say, the lowest amount of cost).

That is the problem with people, just be sheep and say nothing while being ripped off with made up taxes to pay their profit tax is what is really is about. Thank you for alerting us about this. I will be watching out for this. Their are plenty of other bullion dealers to go to that will be happy for the peoples business.

In New York I have to spend over $1,000 in order to avoid tax I mean it sucks sometimes but again it helps me build my stack a lot quicker 😅😂 and dude I appreciate you fighting back , they tax us enough!

If JM Bullion isn't forwarding to the State tax they charge, I believe that's illegal. It's because I live in one of the nasty ones that I have decreased my online buying. I do agree that they larger these online dealers get, the more they start to resemble Apmex. Good luck getting a refund. The best I bet they do is give you a credit, which means you have to buy from them to use it, though maybe they will buckle if what they do is actually illegal.

@@rm2jjc11 do your own research, but in general I always look at Bullion Exchanges first as I have found them to be the cheapest, but somewhat limited in variety. Monument Metals seems to be second place and I will look there too and especially if BE is out of what I am looking for. Checking a few sites each time is free and can save you a bundle !

JMB never responded to my request for a refund through PayPal (2+ weeks ago) so I was forced to initiate a PayPal case against them yesterday. I am NOT going away until I get my tax money refunded! Buyer beware. KNOW your state's tax laws!

Same thing here different company. We tried to buy less than $500 of 90% from SD Bullion and they added the sales tax. I told them I wouldn't pay it. They wouldn't respond, so I cancelled the order.

File a complaint with the Florida tax commission. I am sure the time involved that JM will have to endure will more than offset the sales tax they erroneously collected from you.

No sales tax on precious metals in Texas. Because TX considers it a money exchange. Like getting 4 quarters for a dollar.

Texas and Florida are very similar. This one goes to Texas though. My one complaint about Texas is that every time I drive in your state, I end up with a $2- $30 bill for using roads that actually have flowing traffic instead of constant jams.

You go Florida Stacker - don't put up with those invalid tax charges! I used to love buying from Liberty Coin in California - great service, great selection, and great prices. Until they got their new website with new tax regulation interpretation. Previously, they didn't used to charge tax for me (in the state of Nevada), but now they tax ALL silver and gold bullion even though it is specifically exempt in the state tax code. I have asked them to fix it several times but they aren't interested since they probably just paid a fortune for their new website. eBay is the same. So annoying these state-by-state sales taxes.

It took me over 6 weeks to get a refund from eBay on some ASEs i paid tax on. The hardest part is getting someone to acknowledge the error and fix it. JM Bullion basically told me to kick-rocks until I made the video.

I had a similar issue with JM. They were going to tax me for bullion over 500. I live in FL. They said because my order was different items I would be taxed.

The Florida Tax Link is in the video description section. Please visit the online dealer websites, scroll down to the bottom and most have their tax policies posted. If you can't find it there, check the FAQ section and look for any section regarding tax. But most importantly, pull your local state, county, city, tax regulations up and review them yourself if you are unsure. Chances are Florida isn't the only state being misled. If you struggle with this, reach out to me and let me know. When i have some free time, I'll try to locate the right resource for your area.

hey moron!, SD bullion charges sales tax on silver eagles on Florida residents too I just went to their website and ordered 1 silver eagle and they had a .75 sales tax on the coin!

I had a similar issue this past Christmas 🎄 when my wife bought me a few Gold items from US Gold Exchange out of Texas. Now let me say if I would have known she was buying me Gold or Silver or any type coins I would have directed her to never buy from these Bozos. However, I understand that she had no idea about where and where not to buy from when it comes to coins or PM'S. She wanted to surprise me. So one of the things she bought me was a 1/0 oz AGE. Now keep in mind that in Illinois there ISN'T ANY TAX on coins bullion what soever. And these Bozos charged her tax on the AGE. I called them but to no avail. They gave us some cock and bull crap excuse.

JM has really been a disappointment my last couple of purchases, done with them. Gold line is sneaky in the “specials” which pitch if you buy this or that you get this item free. The specials are generally well over the premium you would pay anywhere else. One special they ran buy 50 1/10 ounce gold eagles get ten ASE’s free. Priced the same purchase at Hero bullion paying for all items was over$1,300.00 cheaper then the “special” at gold line. Have made 23 multi thousand dollar purchases with Hero bullion and had great luck. Good pricing, fair selection, every delivery has been within 5-7 days and items have always been packaged well.

In Colorado no tax but in Colorado Springs and you buy Local, there is a 3% City tax and you should look into local taxes as well.
