The difference is that Ashleigh Merchant actually knows the law as opposed to Wills who believes the law is what she says it is. It’s time an honest judge did the right thing and stand up and put this matter to bed once and for all. Ashleigh is the type of person that all honest and decent lawyers should strive to be, she does her groundwork and knows exactly what the law is and doesn’t give up until justice is served.

Presidential immunity only applies to Lawful actions during his time as Commander in Chief. Qualified immunity has to be Lawful and fall under the scope of their office. Neither is the blanket immunity people think it is.

I am so elated with Attorney Merchant’s explanation regarding “the process” for the open records requested by non-attorneys like myself. I have personally tried this process to request records and got nothing! Another point, in this current law and government everything is so convoluted No One knows what, how, who … It appears to be “let’s make people think they have the capability to get information” BUT NOT REALLY! I am so disgusted with EVERYTHING … NO ONE should have to go through all this for information WHEN THESE PERSONS ARE WORKING FOR THE PEOPLE!

It is the right of the people to redress their government. The transparency is required to protect that right. Setting up a restrictive electronic system that intentionally prevents people from redressing their government is unconstitutional. All government officials are subject to audit and oversight. The process of FOIA is clear. It seems that Fulton County is trying to restrict the right of the people to access of public records.

So it seems. Funny about that. The County has also refused to provide access to the 2020 ballots in a way approved by a judge for verification by verified citizen vote counters, election workers, and experts. Fulton County is not just incompetent, it is very corrupt. And what about the flower expenditures by the Fulton Sheriff while he fails to maintain the jail? What about being a Sheriff requires the sending of flowers for Mother's Day?

Very interesting. Thank you. Its hard to believe Mrs Merchant is the first person who wanted information from the DA. Its surprising that there is ANY question that a DA is not required to hand over data requested. Us normal people do not have the resources/time to bring these cases to court, so I'm happy there are lawyers who get this all sorted out with the courts making it easier for all of us.

The judge is definitely under the influence of some substance maybe a prescribed medication for anxiety, but Her attitude doesn’t convince me as just being an optimistic person. The fact that she’s not infuriated by the stonewalling of the DA office on records it’s not surprising as she doesn’t see herself as being part of the herd of Fulton County, who will never be able to access records. If she had a good conscience towards the people who elected her, she would realize. Fanni is just trying to defeat the purpose of the open record’s act to hide her corruption

If you take these matters to the basic right of the people to have access to their government and its records under reasonable circumstances. Under the Constitution it is quite clear. And, again for them to claim outright immunity- while simultaneously denying the Constitutional right of the President of executive immunity as spelled out by the Constitution is really disgusting and repugnant.

@@satdady408 From what I have read, presidents have no immunity protections for election matters. It’s not one of the core powers in article 2. Most judges and lawyers I talk with believe presidents do not have immunity and the Supreme Court only made their presidential immunity from thin air. And one day, it will be reversed. Presidents have never had immunity. That’s why Nixon left. He knew he would wind up in Prison. And would have. But with this new Trump based Court, we have a number of issues that have been long standing stare decisis that somehow is being thrown out and these new legal roads are now the way things are. It basically makes professors wonder how will they teach classes now. Our laws basically got turned on their heads. Basically, before July 1, 2024 the words chiseled in stone above the Supreme Court doors were true “Equal Justice For All”. But that is no longer true. We need to chisel in “Except our president” so that we are not lying to the people. The Supreme Court basically made 6 living people above our reach. I think that will revert back to what we were one day. I believe as do many other attorneys that this decision for presidents and ex and former presidents to be above the citizens, will not stand. It basically striped away our democracy. There are six, we have no power over. I am not a party person, just a patriot and veteran who believes in democracy and our power as the people to still be the government. To do that, we need authority over those we chose to run the country for us. Otherwise our power means nothing anymore. That’s not how we started nor who we are or ever should be. No kings here. When you say, “people to have access to their government” WE are the government and hire people to run it for us. It’s easy and common for people to talk like they are not the government. But we are. That distinction is important to keep in front of you when dealing with anyone we hire. They answer to us ultimately. But many, especially mayors, police chiefs, governors, even DAs, think they are more important than those that put them in charge. There are 2 types of public servants: Those with a desire for power OR those with a desire to serve those in power. I always chose the latter of these so that is why I am never a party person. I pick the one that understands how they got their job and who they are supposed to serve.

The way my professor explained it was, when you sue the government, you are suing the people. In many states, you need to ask permission and have grounds and standing to even file it. Basically you need to ask the court’s permission first. Never sued Georgia, but have other states. We are the government. So we would be suing ourselves and asking the people for the money. The money comes from tax payers, not a private entity. That’s why the procedure requires an extra step. I had a case where the state was negligent and didn’t put up barricades resulting in 5 deaths in a 24 period. My client was the 4th death. If barriers were up, no one would have had tragedies, medics bills and funerals. I had to ask the state’s permission to even sue them. The employees themselves cannot be sued individually in most states either. Not while they are on the clock. But permissions can be granted. It’s just not the same as private sector issues. Because WE are the government. The money comes from all of us for settlements or rulings.

When the Constitution was written- there was no electronic version of anything. That doesn’t make the right to access public records any less of a right. For any administrator to say that you can request online, you can request by fax, you can request by phone or computer. The Constitution does not require any such thing. It is the right of the people to redress their government. You can go into any government office and request records by writing down your request with a pencil and handing it over to the desk clerk. They are required by law to forward the request to the proper person. That is the law and the right of the people. EFF Fulton County.

I guess I never took the time to read it. I know many laws have changed or have been updated to include the new technologies that were never imagined centuries ago. If it still says you can write it on a piece of paper and not changed it to having to be on a form, then yes, you are correct. Right to redress is still valid. The means to do so can vary. I mean, one day, will we need paper or writing instruments? It’s possible that may go the way of the buggy whip too. Maybe a kiosk with push button choices? Or an oral interactive hologram is in our future. Who knows what our grandchildren will invent and make available. I doubt pony express rules would make sense today. But the basic rights of mail delivery are still in place. Things change and sometimes laws need to keep up and have new methods added. They can even eliminate pen and paper one day and still be in compliance. So don’t get hung up on fighting change unless you want to live like the Amish, which is still legal and may be the reason why pen and paper remain. I wonder if Amish will still be here in 200 years?

Thanks so much! I tend to catch your shows after the fact. That said, I tend not to lag too far behind and get as close to real time as possible. I find the pushback by the DA’s office to be an abomination. While I do appreciate the judges careful deliberation- and inherent mandatory CYA protocols- From a common sense standpoint- my standpoint, it’s clear the Fulton County DA’s office on mass has no shame. Nada. De Rien. Niet! None whatsoever. How could they possibly descend in defiance of the essence of the public records rights further? I’m sure we’ll see. Willis’s is doing her best to break the spirit of the law and it’s frankly maddening. 💔

I don't believe for one second that Fani Willis is not directly telling the folks responsible for handling open records requests which requests to fulfill and which to ignore (and they are most assuredly following her instructions to the letter). And THAT is why she is being sued individually in both her personal capacity as well as her capacity as the DA.

Fani Willis, DA of Atlanta Judicial Circuit, which wholly exists within Fulton County, is a rogue, out-of-control official, able to do whatever she feels like, without any ability to limit or council, outside of impeachment? Does this problem exist in other counties within Georgia? It seems that specific legislation needs to be implemented to correct this deficiency. The Attorney General, Georgia Bureau of Investigation should take action.

The District Attorney Office is a formal and traditional agent/agency serving the DA; commonly recognized tool of her trade. Otherwise, how can attorneys in that office legally conduct prosecution of alleged criminals?

By God, I am so grateful now, there is no doubt in my mind that we shall all see Fani Willis and fiends, inevitably brought right behind the bars, that they are ever busy concocting for themselves, even as they unrepentantly continue to persecute and profit off the pains that they have heartlessly inflicted on those who stood up to expose them for what they are: devious criminals

Hmmm...I pause live feeds all the time. I've also seen other creators pause live feeds. If it is an extended pause, they seed up the playback till it catches back up to live. I do want to hear what you have to say, as you are an expert. That is why i didn't seek out the original source. I just want to hear what is going on as well.

The takeaway in laymen’s language put forward by the county lawyer is that the act is optional and nobody in Fulton county can be held responsible because they aren’t a person or an entity, if that is the case what is the point of the legislation in the first place?

I've actually arrived to this podcast late, but so far my opinion is they say you're no one's above the law, but yet they're trying to make it out that d.A's in georgia or above the law!! But I haven't watched what maybe twenty minutes of the video So I might change my mind in the end.Let's hope so!

Hi we were wondering in katt Not Williams chat in the ysl trial. If a witness gets a plea deal and has to testify but don’t testify the way the state wants. If they want to take back the plea and lock them up after not getting the testimony they wanted. 1. Is there a time limit for when they can do it? 2. Would it be strategic and wait for the case to finish then bring arrest them??

I respect Judge Krause, one of the only Judges on the bench who considered the separation of powers and that power must not exist in a vacuum, most notably and fundamental to the adversarial systems of the judicial branch under the American Constitution
