I think trademarked colors only apply to future brands wishing to market a product primarily based on that color so it’s not like youre banned from using it in any sort of publication or product of your own.

Guys, these colors are only illegal to use if a) you're in a jurisdiction where the trademark is accepted, and b) you're using said color in the same or a similar use case. Whiffle ball yellow could be used to paint a plane, but not make a baseball bat.

I mean, you can still use all of these colors legally, so long as you aren’t using them in a similar or exactly the same way as the brand. For example, Cadbury purple could be used to paint someone’s wall, but a competing chocolate company cannot use it to sell their chocolate.

These color trademarks only apply to the specific business that the company is in. You can use any of them for most things but if you were a competitor in the same market you can’t use them.

all of these are only illegal in the US and UK btw, as many countries do not follow the same copyright laws. and even between US and UK, there's still some laws that vary. and many of these companies are only protected in the US with a trademark by US law. many EU or Asian companies could easily use these colours with little to no care at all. and UK has greater 'fair use' legislations that protect those wishing to use the colours.

These trademarks ONLY apply in specific circumstances Pink panther pink only applies on insulation foam UPS brown only applies on vehicles Post it yellow only apples on paper Tiffany blue only applies on cloths, linens and bags Target red only applies in stores Home depot orange only applies on buildings Wiffle ball yellow only applies on baseball bats Barbie pink only applies on toys and clothes So you can paint your walls UPS brown, or put on Barbie Pink lipstick without any problem.

As an artist, I can also be hired to design a product. I will use those colours I will use McDonald’s red or Christian Louboutin red on a handbag that has the Pepsi logo. And sell it. If I make a painting on canvas painting is my own design, my own image, and I use these companies colours, I will sell that painting just the sake of complete mockery of the idea of copyrighted colours. I would love for a big company to try to dictate to me, what colours I cannot use in my art. if I had to use their logos in my artwork, and then sell that artwork as my own, I will.

@@dweep9546 To expand on that slightly: the (Nice) class a mark is registered under and the description provided to the TM office aren't always the deciding factor when assessing whether the goods/services a mark is used for are similar. They're a good starting point and definitely help courts decide, but it's possible for a new mark to infringe upon an older mark registered under a different class.

It's trademarked not copyrighted. The video is kinda misleading. Basically no company can do something similar to you in your industry with that specific specific trademark. So if Cocacola has trademarked it's red shade, no one can use that color when making soft drinks. It's only illegal to use trademarked things in certain contexts. Example - Apple owns the letter "i" as a prefix followed by a capital letter in the context of many technologies. You can't launch a smartwatch and name it iWatch for example. Even though Apple calls it's line of smartwatches Apple Watch, it still impersonates their brand. Even if something is trademarked, in many cases companies don't enforce it unless someone is maliciously trying to impersonate them or their branding (and succeeding at a large scale).

It doesn’t really matter. It’s not actually illegal to use these colors unless you’re in the same business as your competitor, for example you can use the target red, but if you have your own retail store then it becomes illegal.

And if another company used a color value 1 digit different, for ex Home Depot is #ee7125, and I started a supply store using #ee7126 … the colors are effectively identical, but Home Depot couldn’t sue me cuz it’s a different color technically. So why even bother trademarking a color? Speaking of trademarking em spectrum, why stop at visible light? Maybe I’ll try to trademark a common microwave wavelength and own all the microwave companies . 🤑

Kind of a weird thing about those papers is that they're not the color you think. They reflect the color you see the most, "trapping" all the other colors a bit more, so technically the paper itself "contains" more of every color exept the one you see. It's weird to explain, and not 100% true, but it's a fun thing to think about.

Some of these colors, like the Barbie pink and the Tiffany blue have look alikes that are near-indistinguishable from the originals. An artist by the name of Stewart Semple makes and sells look alike paint colors for these as well as Vantablack.

While it's certainly an interesting topic, I feel like this is kind of a missed opportunity in terms of educating the public on TM law. Many people hardly know the difference between different types of IP and the protection they each provide as it stands, and saying stuff like "it's ILLEGAL to use this color!" or "they OWN this color!" only adds to that confusion and tends to make people think negatively of TM law. In reality, use of these colors is only "illegal" under pretty narrow circumstances, depending on just how distinctive they are, the goods and services they are registered for (and whether they are actually in active use for those), what jurisdiction you're in (some don't accept color marks and what constitutes infringement differs from place to place), etc. You did mention secondary meaning and some other concepts, which is great, but overall videos like this (and especially out-of-context clips on other social media) don't exactly help portray IP law positively.

@@digitalunity Not sure what you're getting at, but the same is true for words like "Google," Apple," or "Tesla." Stuff like this isn't really an issue. Generally, you can totally use the color (or any trademark) for whatever you like, unless you plan on incorporating it in a similar product of your own. In practice, color marks are also likely to be "famous" marks (as they need secondary meaning/acquired distinctiveness, i.e., to be known to the public, to be registered in the first place), so releasing products that harm that product's reputation will probably be off limits, too. This all depends on local laws and court decisions, but simply being able to run across colors (or words, etc.) isn't an issue anywhere. Also, basic colors will never be trademarked because it's practically impossible to prove that plain red reminds a significant part of the population of a certain product.

Tiffany Blue, the moment I saw it, I knew what it was. Basically, if anyone ever asks what company has the most iconic color to their name, Tiffany’s is always the first thing I think of & say. Personally, I prefer Robin’s Egg blue to this one, but I like both. The first one mentioned, the oldest one, I was scratching my head when you said fiberglass insulation b/c it is not that saturated a pink, the Barbie pink looks more like fiberglass! It is very Pink Panther…but I still don’t know how Pink Panther entered this discussion, the two things are so random 😅 Also surprised that wiffle-ball trademarked a color, it’s really not that popular, I kinda think of it as a kids/neighborhood-organized game at their local park rather than a professional league of some kind. I’m surprised Walmart & IKEA didn’t trademark their respective blue & yellow….well, let me back-track, IKEA probably wouldn’t be able to do it without permission from either the govt or royal family first 😂 I guess the fact that two very well-known international companies uses similar color schemes have negated their chances of doing so, even though they are different intensities…nevermind 🤷🏻♀️ Gap should trademark that navy blue in their logo…I love it!

you can still use the colors, you just can't trademark it or use it on YOUR brand, or use it in marketing. I use a shade of maroon called "Minuteman maroon," which was used by the Boston and Maine railroad, which CSX owns the rights to, and I messaged their offices asking if it was alright to use the color for my main yt, they said that I can as long as theres credit to the original company, or CSX, and don't claim it to be my own brand, or use it to sell anything

Universities over here in the U.S. who have big sports teams have trademarked colors as well. It's for their merchandise and logos. Keep in mind, you can be ALMOST at the copyrighted color, and be off enough to be legal. It's a very, very specific color measurement these companies have copyrighted. Most people don't realize there are literally thousands of variations of any one color from a computer. You'd actually really have to work at it to accidentally hit on a copyrighted color.

@@KwikBR thats a really common purple. I also have never seen a cadbury product in my life. i live in Finland we don't really think of brands as gods here like in many other countries

I reckon McDonald's needs to trademark one of their colours, probably the yellow. Also, maybe PS or Xbox could claim their respective shades of blue and green?

But the colours have to be associated to the business and red and yellow are very common colours. in Australia that's the colour of our surf life saving and fire and rescue services too. It would also get so tricky if most companies trademarked their colours - like imagine if a company in fresh produce tried to trademark a green... if that made any sense

Trademarks only apply within their industry, if they aren't your competition you can most likely use it, especially with such general and abstract thing as colour. For example you can use macdonald's yellow as financing firm without much fear, but not as a restaurant.

Holy dang, i actually guessed correctly that they were copy striked by the brands. Tbh these big companies felt like ones to do such a thing, and when i looked at red and yellow, i immediately thought of mcdonalds.

The most famous ‘created’ colour of the 20th century would have to be Yves Klein Blue, created by the French artist, Yves Klein in 1957. It inspired the song Volare (Blu dí pinto dí blu). It is rumoured that the chemicals used to make the colour were so toxic, that they led to the artist’s death in 1962.
