@KHONAMII

Right?!!
@CAROLUSPRIMA
Ай бұрын
You are correct that it is relevant. But stay with me. Character and bad act evidence cannot be admitted to show behavior in conformity with that bad character or bad act. It can be admitted for other reasons though. Here I’m sure the prosecution argued that its admission would show motive and a common scheme or plan. But there’s another hurdle. The trial judge must make a determination whether the relevance is outweighed by the danger of UNFAIR prejudice. It’s a balancing test. Here the judge determined that the danger of admission of the other crime unfairly prejudicing the defendant’s right to a fair trial outweighed its relevance. Close call. Especially the common scheme and plan argument. The ruling could just as easily gone the other way. I’d have filed an interlocutor appeal on that single issue and awaited the outcome before offering that terrible deal.
@nicholashodges201

@@CAROLUSPRIMAit can and *HAS* been used, and often so, in the cases of those who kill more than once as it establishes a pattern of behavior and methodology of the offender. Particularly when the case is built on that pattern of offense like with her This is just another example of the P*$$y Pass in action. The judge eschewed STANDARD court practice in such cases and went easy on her because of her gender. Just like that absurd plea deal she was given. No unbiased judge have EVER approved it for a premeditated murder. Further if she had been a man who killed his GF in the same manner, her sentence wouldn't have ended until her natural death. This entire case is a bad joke

@@CAROLUSPRIMAare you a lawyer? I'm not asking cuz I think you're wrong. I'm genuinely curious. I remember a murder case from New Mexico where some lady was accused of killing her husband. Looked like there was no way she was innocent. She claimed that she shot him when he came to their house late at night and she mistook him for an intruder. She had a boyfriend 25 years earlier that was killed by her under nearly identical circumstances. The prosecutor wasn't allowed to mention it to the jury. She was acquitted. Even without the killing of the boyfriend I thought it was obvious as all hell that she was guilty.
