Seems a far reach to say a passenger in a vehicle they do not possess can be charged with possession of something they didn't possess. If it were in their hand they would be possessing it. However, if it's in no ones hands then the vehicle is possessing it and the owner should be responsible.

Why would the cop be concerned about marijuana though? If the driver is high at the moment then yes, it's a public safety issue, but if the driver is sober there is nothing immoral about possessing a natural plant.

sucks that a Texan who is violating the law (speeding) while also transporting marijuana might actually be help accountable for both violations. Almost like the laws apply to everyone.

If the car smelled like marijuana and you got in. You knowingly took that risk. I still dislike the idea of joint possesion. But if an officer can find probable cause in minutes and you didnt notice. What im most curious about is how this law will be applied to say ubers or public transport.

And does it only apply to drugs? Seems real odd. The passenger could be under the influence but not in possession. Are both the officer and the passenger in possession of the officers gun just because of proximity or is there some other law that governs when the officer has lost possession to the passenger. In the drug case as well as others...possession should mean possession.

Unfortunately, (hope this statistic is still accurate) 20 percent of states still have laws like this in place. I’d rather what this guy lays out end in a dui rather than a drug charge 🤷

Name the actual crime of smelling something to give probable cause. If I was speeding and that’s all it was the agreement is we both know I was speeding now if you can’t actually see the weed in the car or have evidence of it being in my car then there is no reason for the officer to go through or say I smell weed. This guy is a joke.
