@@nb-user25 I agree to a certain extent. This defense attorney is stuck in the 80s and doesn’t understand that long hair makes old women appear even older. She needs a makeover, but the judge really can’t admonish coiffures. However, we’ve watched her make a defendant spit out his gum. I wish she would privately admonish this defense attorney about appearing professionally in court. I’m wondering if the compliment to the defendant about her attire was meant as an admonishment to the attorney.

I am retired military, getting a copy of your DD-214 is EASY. Yes there was a fire in the national archives, long before this guy was born. It happened July 12, 1973, and approximately 16-18 million Official Military Personnel Files were lost and the records destroyed was for veterans from Nov 1912 to 1960. That guy is not 63 years old. Which I doubt he ever served in the military and is just looking for another ex-con free ride. I think Judge Boyd does a great job on probation hearings as some Judges basically lets them go free.

@bubbapate5740 Yeah, in this digital age, files have back ups that are probably stored in several secure places. Computers were used even back in the mid-1970's, but of course back then, they were using punch cards, and recording tapes for programing and data storage. But a lot of records were getting stored on microfiche, even before the computers became cheaper, smaller, more powerful and easier to use. But into the 1980s and with the floppy discs and with scanning devices...old paper records were getting digitized, and I would think that by this time, the military would have current records stored/backed up, even as they work on digitizing going back into the more distant past. I didn't catch the age of that man in the video...but he looks like he's in his 40s. So if he went into the military at 18 to 20 years old, that would have only made his service starting around the late 1990s, to 2000ish. But even if I'm off by 10 years...and he joined in the late 1980s early 1990s. There has still been plenty of time for the military to be storing back up information on important things like who was actually in the military -- and again, that data is probably backed up in a number of safe places, so if files were corrupted or destroyed at one spot, there are still copies that remain safe in other spots. I just have a hard time believing that guy is a vet. Because I don't think it would be that hard to access one's service records.

The judge said sometimes he shows up with oxygen, sometimes he doesn't. I work with someone who needs oxygen, and she doesn't go without it. Judge may think he's using that to get sympathy and a possible lighter sentence - which is why she wants proof he actually needs it. Also, the people with that guy refer to a form - so there is an actual form to get records. Now it may be that it has to be the veteran themselves (or someone legally authorized to represent them) who can get the records, but this guy can't be the only veteran needing records. His problem is he doesn't HAVE any, because he was never in the military!

The statistics on the amount of people living with depression and anxiety who also have to work, is staggering. There are treatments and resources that are meant for addressing the symptoms, coping skills and medication that most people have to access to be able to work. Your husband is in prison for something your husband did. You, yourself, are now on probation for something you did. So now, tax payers are paying for you and your husband.

There was a terrible fire that destroyed many service men and woman’s military files in St. Louis on July 12, 1973. Approximately 16-18 million files were lost. The fire consumed 75 to 80% of service personnel files for people discharged between November 1, 1912 and January 1, 1964. Back then there was only paper records and many were destroyed. It was thought careless smoking by one of the night watchmen caused the blaze. Vietnam era service people weren’t affected because their records were in another building. I don’t think Judge Boyd is aware of this fact. I remember the fire. I remember pictures of this huge building completely engulfed in flames. I had been discharged from the army in 1971 and was concerned that my records were destroyed.

I LOVE Judge Boyd, but she is 100% incorrect in this case. The man's claims are TRUE! My father-in-law was in the Army in the late 1950's and his DD-214 was burned up in Kansas City along with tens of thousands of other soldiers records. We had his honorable discharge papers and other documents luckily, but he was denied VA benefits for years because of the fire and not having his DD-214. After 5 years and hundreds of hours of arguing with Army and VA officials, they finally issued a letter to him, stating that his DD-214 records were destroyed in the fire and that that this "new letter" from the Army was sufficient. There are literally tens of thousands of soldiers that have fighting this problem for years.

Your information is incorrect. Do you really think the military would house all records in just one place? If it was the backup location, then there were original locations. (MULTIPLE) Plus, there is hard copy storage as well as electronic backup storage that is transmitted to multiple places. If we had all of our records in just one location, whether it be military records, top secret plans, secret service datum, etc, then the USA would have the sophistication of a third world country. When someone severs service with the military I believe there are 7 or 8 copies of the DD document, of which only ONE is given to the service member. That documentation exists… somewhere, and that’s what the judge is alluding to. It’s ridiculous for anyone to assume that since one place burnt down that there’s no record of his service anywhere and that they are SOL.
