The Gurugram Developers Association in its statement has said that the ban on the fourth floor construction in the city amounts to losses to owners and contractors.
The Gururgam city's ongoing 13th-month ban on the construction of the fourth floor is causing a lot of uproar amongst the Gurugram Developers. From time to time, developers have been demanding the government to get rid of the fourth floor policy Gurgaon.
The Fourth Floor ban policy was implemented in the Gurugram City in February 2023 and then a committee was formed to submit a status report. The committee then submitted their report in June itself, still there has been no initiative to take any decision regarding this matter.
It is resulting in a significant amount of loss for the developers, plot owners, and contractors. Especially the investment of developers in such plots is facing the wrath of this policy banning construction of the fourth floor in Gurugram.
The Gurugarm Developers have been raising this issue for more than a year and almost nothing has moved in any direction to date regarding the problem. Their demand is to restore the earlier policy as per the old zoning plan and as soon as possible. Otherwise, all the stakeholders will keep incurring heavy losses on their investment in the city real estate business, putting up the sector in a bad light in the Delhi NCR Region.
In October last year, Narender Yadav,who is the president of the association for developers in Gurugram City, had raised this fourth-floor policy Gurugram issue in their then-held meeting. Mr Yadav said that as per the old zoning rules and regulations for the construction, it was necessary for the property owners to leave more space for setbacks in the front and rear of the building. That resulted in more open spaces between the structures.
The association has earlier claimed that this fourth-floor ban policy is causing around a 15-20% increase in property prices in Gurugram city, due to the impact of a shortage of residential homes in the form of floors.
History of The Fourth Floor Policy Gurugram
In a report from the Hindustan Times, the president of the Association of Developers of Gurugram, Mr Narender Yadav said ‘’The availability of flats in the city was already low due to the launch of new group projects in 2020 and 2021, but the floors made up for the shortage. The ban has put property owners, contractors, and brokers in danger because several people have taken out loans and invested money to build a fourth floor.’’
As per the association, the other major issue that needs to be solved is that many of them had already built their fourth floor by following the then-existing rule of DTCP (Department of Town and Country Planning) and HSVP (Haryana Shahari Vikas Pradhikaran). But since the new rule banning the construction of the fourth floor is implemented, it has put their investment in jeopardy.
Also, the association has said earlier that the issue of infrastructure in Gurugram City can be resolved only if the government spends thousands of crores collected as external development charges, (EDC).
In 2019, the Haryana Government allowed the registration of the fourth floor as an independent floor. However, in 2023, the state government again imposed a ban on the construction and registration of the fourth floor in the city. This policy was challenged in the Punjab and Haryana High Court and also the matter was raised in the Haryana State Assembly.
Those who oppose the construction of the fourth floor are of the view that it adds strain to the infrastructure of the building as well as existing amenities and utilities.
After this, the Punjab and Haryana High Court gave directions to the state government to form a committee to inspect the matter thoroughly.
The committee was led by P Raghavendra Rao, Chairman of the Haryana State Pollution Control Board, and its report was submitted after the detailed study of the matter on June 29, to the Haryana Government. Since then, 13 months have gone by and the government is yet to decide and make any move based on the committee recommendations.
