Cort को उस डीलर आदमी से भी पूछना चाहिए था कि जब आपको मालूम है कि sele agreement मे stemp paper allow नही है तो वह सिर्फ stamp paper ही क्यो बनवाता है लोगो से , आम तौर से गरीब जनता कानून के बारे मे इतना नही जानती , लोग डीलरो पर आँख बंद करके विश्वास करते है , उस डीलर व्यकि को इमानदारी से साफ साफ बताना चाहिए कि की आगे Cort से ragestered कराना चाहिए, इसका मतलब जब डीलर लोग लोगो के साथ धोखा करते है , इन डीलरो पर भी Cort को सवाल करना चाहिए और इसी के आधार पर डीलरो पर भी कार्रवाई करना चाहिए , तब सारे डीलर ईमानदारी करेगे और case भी कम होगे और धोखाधड़ी भी रुकेंगी , यह डीलर तो सबसे ज्यादा धोखाधड़ी करते है इन पर सबसे ज्यादा शिकंजा होना चाहिए , डीलर जानकर सारी बाते नही बताते , कानून को जानने के बाद उसका खिलवाड़ करते है , Cort को इन डीलरो के लिए भी कोई कानून बनाना चाहिए

sir Indian courts are creating problems. On one hand even plain paper agreements and contracts act is valid , on other hand why sales agreement need to be on stamp and also be registered. This is contradictory and merely to collect taxes by state governments. Due to too many taxes and complications property values ,litigations and fraud are increasing, Once seller took some money and signed a written agreement he is bound to fulfil it. Supreme court should not twist simple contracts . This is too much

It’s not only about taxes. What will you do if someone sells the same land to 3-4 different people and does a sale agreement? What if you are one of those 4 people? With sales agreement registration it is not possible to do that… Since it’s registered after 1st sales… the land doesn’t belong to you after 1st sale and it’s in government record…

@@himanshupatel4045 don't confuse between sale agreement and sale deed. Government does not keep record of sale agreement at registrar data base. sale deed is now single data base hence multiple registration not possible.

अगर किसी आदमी के ख़िलाफ़ किसी lower court में एक decree pass हुई कि आपने फ़लाँ आदमी को पाँच लाख की रक़म ब्याज समेत लौटानी है और इस decree के अनुसार उस आदमी ने पाँच लाख रुपए और ब्याज की एक किश्त लौटा दी और उसके तुरंत बाद वह आदमी गुज़र गया। परंतु वह अपने बच्चों के लिए कोई ज़मीन जायदाद छोड़ कर नहीं गया बच्चे बालिग़ हैं और किसी तरह अपना और अपनी माँ का पेट पालन कर रहे हैं। अब कोर्ट से समन आया है कि उनके पिता की जो देनदारी थी वो लौटायें। सवाल:- क्या पिता के मर जाने के बाद बच्चे इस तरह की देनदारी के लिए ज़िम्मेदार हैं जबकि पिता उनके लिए कुछ भी कोई संपती या बैंक में भी कोई रक़म छोड़ कर नहीं गया है ??

Hogwash..IMHO- the supreme court has erred- registration or non registration is not important- what matters is whether there was an agreement or not ? written doc and registration are only procedures and a procedural lapse should not whittle the substantive agreement - unless it can be shown that the agreement itself suffered the defects like - unlawful consent, duress, not free will etc.

I think SC has erred, what needs to be seen is that when the sale agreement was executed what was the intention of parties. Registration is technical glitch only.

Technicality BHARAT me sabse bari samasya hai. Ise agar dekha jae to Balramji ki or se sidhe taur par Breach of Commitment hai. Agar aap advance leke bad me commitment se mukar jate hain to koi registry kaise karwa lega- ye one sided to nahi hota. Purchaser ki jimmedari hai final payment ke din amount ready rakhna.

Govt. Kewal paise ke liye kisi bhi kanoon ke mool bhawana ko hi khatm kar deti hai. Kewal registered nahin karaane se ki nhi do parties ke tay ikrar kaise galat ho sakta hai. Das rupaye ke hi stamp paper par likhi baat ko jab tak false nahin mana jata tab woh agreement sahi hai. Kewal govt. Ko paisa nahin milne se woh paper ka saboot baseless nahin ho jata. In fact basic law of agreement men agar verbal agreement bhi supported by sufficient and believable hai to woh valid agreement hoga.

Bhai saheb ek baat bataiye ye to sach hai ke Kalo devi nai paise diya 14k phir vo baki paise de rahi hai to problem kya thi registry na kawane ki Asa lagta hai jameen ki keemat badd gyi thi iss liye seller mukar raha hai aur phir sarkari stamp paper jaari kyon kiye jaate hai jab oski value nahi. Khridne wala sirf 10 rs ka paper nahi lena saath main aur bhi kharcha karta hai.

Bhai aapko aaj pata laga hai. Everyone who has purchased a house on resale, know this. 100 INR agreement which is notarized, is not legally admissible. The agreement is just a document of 2 parties who has decided to come to a mutually beneficial transaction. The document while not legally admissible, is not a totally worthless paper though. It is a valid document basis which any of the transacting party can avail loans etc. Basically signature on a stamp paper has value. But still not an evidence of ownership of an asset.

by registering an sale agreement it becomes a public document and any one can check who is the owner of the said property. stamp paper is nothing but a tax Paid to the government for the said transaction and required to be paid so as to be taken in evidence before the court (if there is a dispute). notarising a document is nothing but attesting the document that yes I have either said this or done or will do this; in the presence of a Notrary officer i.e. affidavits or power of attorneys etc.

When the possession of the property is with Mr Balram after unregistered sale to agreement how can he ask to give back my property back to me. Sale agreement is only to take a certain amount of money and not of giving the possession

Sir, if conveyance deed is lost and also has no copy of it. also came to know that it is not court registered, after got copy from the Govt record what is the solution? Do we go to execute for the fresh one on current date or the copy we get from record can be put for registering। Pl guide
