My understanding is that cannabis can have that kind of effect on someone with existing psychotic tendencies that haven't yet manifested. If she didn't know that she had those tendencies, and especially if she'd had weed before and hadn't experienced that, I would argue that it's legitimately not her fault that she had a very serious and very uncommon adverse reaction to a substance that's usually safe to take.

More about the stabbing girl: they ruled she had been pressured by the man into smoking, she had a psychotic break, and stabbed him. They only gave her community service because she didn’t want to get high and was under duress, she was afraid and gave in to the pressure.

@@bear4278she stabbed both herself and her dog which was there, and some places report she was still having a psychotic episode when police arrived and had to be tasered several times. Real pretty privilege that she didn't just get shot. Because of innocent until proven guilty, the prosecutor has to break down her story. The defendant being the only witness can make this feel very unfair.

I’m not necessarily denying the psychosis part (although, it is possible she could just be pure evil and decided to kill her dog and stab herself afterwards as a cover story), more the “her boyfriend forced her so the whole thing was his fault” part. Technically where I'm from, I believe the city is supposed to fine people who don't shovel, but I think that rarely happens.

Having worked at a landscaping company during winter, contracts dictate response within a specific time, generally an hour, and it must be either worked on previously (for storms) or clear by 6am local time. With better weather technology they are expected to be out before snow starts spreading salt and during to stop buildup.

With regards to Shaw Law....In New York sidewalks are public easements and the underlying property still belongs to the property owner. In addition there are laws in place that require property owners to maintain their sidewalks not only in snowy weather but also general maintenance. Right or wrong, Shaw Law WOULD be responsible for anyone slipping, falling, and injuring themselves in New York (Which is very good at passing the buck away from themselves and onto everyone else)

In the UK most people believe that you should NOT clear on the pavement outside your home in case someone falls where you have worked. You can actually clear the pavement as long as you don’t increase hazards to pedestrians. Don’t uncover ice and just leave it at that, for example, or bank up snow on other parts of the pavement. I have to do it because my driveway is on a slope and sometime I can’t get the car onto the driveway due to the tires spinning. I once returned home after a night shift and coaxed the car onto the driveway, which was covered in snow. Had breakfast and went to bed. Got woken up many hours later by a neighbour asking if I might want to move my car that had slowly slid back down and was now completely blocking the road. 😂

In Pennsylvania and Ohio property owners are responsible for the sidewalk adjacent to their property. Edit: Businesses and property owners have been successfully sued in both states for falls on adjacent sidewalks due to icy conditions. In Pennsylvania there have been successful cases against businesses for falls on uneven/badly cracked sidewalks also.

From a quick Google Fort Wayne requires property owners to shovel the sidewalks in front of their property. Indiana has no state law but I know Indianapolis requires the same by local ordinance.

As a Pennsylvanian, you can and will be fined if you don't clearly snow from your sidewalk as a property owner. Had a family member who got one of these fines. Speaking in terms slips and falls on those sidewalks, that's still on the state. PA simply has laws that fine you for not clearing snow, much the same as many local ordinances that allows them to fine you if your grass grows too tall in your yard.

This does change things quite a bit. Taking drugs and committing a crime is very different from being drugged and then committing a crime. That said, the judge's wording is still questionable, and I really feel like this is birds coming to roost on decades of war on drugs bad information. For decades kids in the US have been subjected to educational material and bad science linking cannabis to effects more consistent with PCP, and even with the growing spread of legalization and destigmatization a great many adults still don't actually understand what drugs really do.

Considering that there are OTC drugs that can have similar horrible psychotic reactions, I'm inclined to believe it is possible, if highly unlikely, to have this reaction.

Sometime that I haven't been able to learn about the case is if she was in jail during the trial. This happened in 2018 and she was arrested while still apperently still high at the scene of the crime, so if she had to sit in jail or had house arrest that's a lot like an additional 5 years to her sentence.

I just feel like the excuse used for the light sentencing for murder sets a dangerous precedent. "She had no control or responsibility in the outcome because she willingly took a chemical substance known for altering one's mental state and actions before doing it" is a huge statement. Does this mean alcohol is in the clear too? What about other narcotics? If you get absolutely loopy on dilaudid, get behind the wheel of a car because you have "no self control," and "intentionally" plow the car into a guy on the sidewalk (the drug made it seem like a good idea, you were so out of it you thought you were playing grand theft auto 6 early access), should that also be only community service? After all, this judge says it's not your fault if the drug makes you think it's reasonable, or gets rid of your ability for reasonable thought. If drunk driving is a crime, i feel like brutal stabbing while way too high should be up there, is all -- and I can't help but feel that this judge should be resigning.

I think the vagueness in "known for altering one's mental state and actions" is doing a lot of heavy lifting in this comment. Marijuana is known for altering your mental state, yeah, but the ways in which it usually alters your mental state is well known and absolutely doesn't include stabbing someone 108 times. The reason DUI is illegal is because drinking, smoking grass etc. can *easily be predicted* to cause your driving to suffer. Also, apparently she didn't willingly take it; the fuller story, at least as accepted by the court, is that she was pressured into smoking when she didn't want to.

Think of it like muscles. The lazy eye is a weak muscle. You wear the eyepatch over the good eye and it forces the lazy eye to put in the work to get stronger.

Case is much more complicated than the short Tom.watched tells us. Most significant overlook is that her lawyers successfully argued that she was unwilling but forced to take the bong hit. Supporting the psychotic episode is that she also stabbed herself and her dog several times. The crime was in 2018 and she was arrested at the scene. I don't know if she had to sit around in jail for the over 5 years the case took to resolve, but that would also change the intensity of the punishment.

I don't know the case but the only situation I can imagine this verdict to be realistic if the guy had given her the weed without her knowing or something like that.

Texas man should avoid judging snow 😜 Judging from the footprints, it was probably late morning and had seen considerable foot traffic. Also, most jurisdictions that regularly experience snow require property owners to clear the adjacent sidewalk

If you have underlying/preexisting severe psychological issues (bipolar/bpd/schizophrenia etc) cannabis can exacerbate psychotic symptoms
