If police reports are framed, falsely, to be within department policy, then there should be criminal prosecution of the officers involved, rather than termination. These officers should then be prevented from taking any jobs in law enforcement from that point on.

There was a cop who was caught on body cam framing drivers with drugs he planted in their car as he searched it. Over 150 drug arrests he made were thrown out and he was fired. That's right, he was fired! Not arrested and charged, just EFFING FIRED!!!! ???? You have got to be kidding me, that man ruined people's lives!!! Fired!?!?!? I wonder if he is a cop somewhere else now. I am going to look into that.

Apologies but you're using the word "framed" incorrectly. In Beau's words he means the officer puts his actions in context of policy. Not the vernacular of "unsubstantiated charges"

@@why-even-try-brotendo Yes, I think I know the cop you are referring to. I don't believe that this cop was the only one who engaged in this practice. Since the "war on drugs" was started back in the 80's the prison population exploded with an estimated 20% or more non-violent drug charges, many of which were for marijuana. Many times, the officers involved were promoted based partly on their conviction rates. Even when these cops came under scrutiny it's possible that it was covered up so as not to overturn convictions. Larry Davis shot and wounded several officers back in the 90's. He was a drug dealer who claimed he acted in self defense. He claimed that he was supplied with drugs by the cops. It was revealed during his trial that the weapon used had been in police evidence from a previous case, yet Larry Davis had it in his possession. Before the conclusion of his trial, several officers were caught transporting drugs in their patrol cars.

Never EVER give them permission to search you, your house or vehicle. They are fishing for a chance to punish you. A mistake is a McDonald's worker still putting onions on a burger asking for no onions. Standard procedure is to put onions on the burger. Pulling out a gun instead of a taser is just straight up carelessness and negligence and should never happen.

I still don't believe the gun instead of taser claim. I've worn a utility belt before. There is no logical reason for the holsters of both weapons to be on the same side of the belt, so logically there should be no mixing up the two weapons as they should be on two different sides of the belt. They have very different trigger shapes, handle materials and weight. Pulling the gun is a deliberate choice as was firing it.

Especially when the gun is on one side of the body and the Taser on the other side. I've seen photos of the LEO having his hand on his gun, ready to take it out before he even reach the driver's side door. And what's wrong with a gun that uses rubber bullets and a second one with regular bullets. Rubber bullets do damage but don't kill.

I used to read George Will quite often as his logic was impeccable but the basic premise had to be taken "in context". doctors and nurses also need a license to practice and if they fork up badly enough they are stripped of their license on top of facing a malpractice suit. I cant think of a single reason why cops dont have to do the same thing.

In other countries, they take protecting and serving the public so seriously that the training program lasts a couple of years, during which they are taught many skills besides just drawing their gun. Our cops need to do their jobs without guns for awhile, to help develop those other skills. They should have a probationary period when joining any community, where they go out and interact without a firearm.

If you listen to many (I can only stand a few) Trumpist you hear all manner of misconception and misinformation. Ted Koppel challenged both Hannity and O'Reilly with facts tied to ideology. There's not stand alone facts with these people and it drives me crazy.

Civil asset forefeiture should require the successful conviction of the defendant in order to proceed. This doesn't mean that the defendant should have full unfettered access to something seized pending the outcome of the trial, but their property should be returned to them if they aren't convicted, so long as that property is not itself something entirely illegal like hard drugs.

Colorado limited it and so did Connecticut. In Colorado if the cop is found at fault he is liable for a nominal amount of money iirc $25k. In Connecticut if he's found at fault by reason of malice he has to pay back the town, county, or state their litigation costs.

I am a retired PO and we were taught that PO’s would be held to a higher level of legal responsibility than the ‘ordinary’ man in the street. The same holds true for senior officials who administer the law. To that end, we obeyed the law and were always cautious in doing so. However, the issue of ‘qualified immunity’ has overcome what was the advice and training we received in the late 70’s. As you mentioned “Policy’ has been used as a ‘shield’ but in fact is not a legal doctrine, merely internal procedures and nothing more and capable of being examined and dismantled. The concept of Qualified Immunity if taken literally makes those you enforce the law, be beyond the law and that was never the intent. Training and responsibility of actions are what counts, but sadly they have declined rapidly in the past three decades bringing us to the intolerable position we find ourselves in now. Agree with your comments wholeheartedly!

Lehto’s Law channel has a recent video on this also. And speaking of insurance, there was a small town in Oklahoma that had a cop that kept getting the city sued. The city’s insurance company dropped them and no one else would insure them at a rate they could afford so they had to disband the police department. Now the town relies on the county sheriff for police duties.

How do you feel about H.R. 1280 the Police Reform Bill? It passed the House, but still needs to pass the Senate. It's supposed to do away with QI, but what I like best is that it would create a "bad cop" registry that follows them always and prevents them from hiding in a different precinct.

@Sam I've seen a video on an invention for traffic enforcement vehicles that consists of a telescoping arm that extends up to the drivers window, containing a display, microphone, and speaker. Show it your ID, it prints out the ticket, everybody goes home safe. No more turning a broken taillight into a fishing expedition.

so like the lil asian lady, the guy punched in the face... it was so funny seeing him toated off on a gurney LOL... but the lil lady still had the board and was understandably and obviously upset... but the beauty was the woman, in uniform, not sure if she was police, medical or what... but the way she calmed the lady, a gentle hand on the hand holding the danger, and loving, calming words... geeeessssshhhhhhhh what a beautiful thing... thas what we need on most calls for the police... ... ... it is an awareness sublime...

This was a good question. You may have known about the subject but many did not. I for one fell for the establishments use of qualified immunity as pertaining to criminal charges against bad officers.

I think the silver bullet would be that any time a policing agency or, for that matter, any government entity is sued successfully, whether settled in court or outside court it should be made open public information including full disclosure of what the accusation(s) was/were.

The main difference in qualified immunity between police and other professions is that the former hinges on an identical legal precedent (ie an identical case, often in the same legal jurisdiction) to show that an officer knows it’s wrong. Most others only kick in when the person is acting in accordance with rules, policies, best practices, good ethical standards, and showing good professional judgement fitting their job.

Thanks for providing that context, I hadn't realized removing q.i. completely would impact other professions as well. I'm truly (not) shocked that defenders of law enforcement would lie or not understand the law. It still needs changes, but yeah, that law of unintended consequences should always be minded.

Qualified Immunity basically means that as long as a cop believes he is doing the right thing he cannot be punished for stepping out of line. That is what the "Qualified" part of it means, they are "Qualified" to make mistakes. Sounds pretty stupid right?

AFAIK, it's actually intended for people doing the best they can with the information they have when the situation is moving faster than the intel. E.g., I live in Canada: several provinces have decided to delay the second dose of COVID vaccine up to 4 months in order to get the first dose into more arms. That's ~60% immunity for more people instead of ~95% for the most vulnerable. If your parent gets of COVID, and you're pretty sure they wouldn't have if they'd gotten that second dose... You can't sue for negligence. That's qualified immunity. (Or at least, what it's intended for.) So leaders can make that call without being paralysed by fear of financial consequences. (Also, being personally responsible for everything might skew the political field even further against those who don't have super-deep pockets.)

@@iloveprivacy8167 That's what Qualified immunity is intended for. Not so a cop can beat someone senseless because he was jogging near a crime scene. It gives them the green light to react instead of interact. Itchy trigger fingers are also caused by this. "Just start shooting and when the smoke clears we can sort it all out."

Actually it's worse. The violation literally has to be found within "clearly established law" which means previous case law within the jurisdiction the violation occurred. This means even the plainly incompetent and those who knowingly violate the law are protected if the violation "isn't clearly established." And not only does the officer not have to be liable for damages, he/she is also immune from suit! That means no discovery, no trial.

From what I recall of the Chauvin trial, qualified immunity was not brought up during the trial once. A lawyer can explain the difference better but basically criminal cases and civil cases are not the same thing. In early March the Floyd family won a $27,000,000 settlement from the city of Minneapolis weeks before the actual trial even started. In this case qualified immunity prevented the Floyd family from suing Chauvin but not the city. Qualified immunity for police officers should be eliminated but the only practical effect will be to allow people to sue police officers in civil court.

re: PROCEDURE -- I've heard cops say that they have learned to say "Stop resisting" so that it's on bodycam even when the perp/detained isn't resisting. It then justifies anything that happens after that phrase.

In large part what it means is that an officer's actions are considered 'official' and the officer can only be sued in his or her capacity of the position held, which in-effect means suing the police department, municipality, or other government subdivision, rather than suing the person. The problem with this is that people act with emotion and with their own personal motives, and people may interpret or ignore stated or published policy without facing personal peril for their violence if they claim that they are acting in their official capacity, even if they run afoul of policy or if that policy itself is excessively vague or permissive. There are two parts to the breakdown. First, the officer is shielded from direct financial peril from the victim. Second, the officer is often not held to-account by the employer (ie, the city or police department) when a judgment is found against that agency on account of that officer's actions. A solution would either be to allow the officer to be directly sued, or to allow or mandate the agency employing the officer to in-turn sue that officer when that officer's actions costs the agency a large sum of money. Or both frankly.

Qualified immunity came out of Pierson v. Ray in 1967 and modern test for qualified immunity was established in Harlow v. Fitzgerald in 1982. As such thing go it is a relatively recent invention.

There are some out there, I've met a few. In rural Greenfield TN even. The story is to long to tell here, but when my truck broke down there, took 3 days to get repairs, the police and folks in that little town were there to protect and serve. I am a grey bearded white guy, may have made a difference.
