Lizzie Borden was acquitted because the case was based only on circumstantial evidence. There was no forensic sciences in 1892, fingerprinting was accepted in US courts in 1911 and being able to distinguish between human and animal blood in 1901. So unless the perp confessed (assuming it wasn't extracted under coercion or force), was caught shortly after the murder covered in blood and holding the murder weapon or there was a witness, it was hard to convict for murder. This also made the Jack the Ripper murders impossible to solve.
