The prosecutor committed a Brady violation withholding the notes about the victim’s girlfriend. It’s improper for the federal court to overturn the dismissal bc they think the jury still woulda found him guilty. That also raises the problematic issue of it being an all White jury bc it kept him from getting a fair unbiased trial!! The fed court is basically saying, “Even with that evidence pointing to the gf, the all-White jury still woulda convicted him. So, why bother doing the right thing when we can stick to what we’ve always done?” They’ve been using the system to put & keep Blk & Brn ppl in prison-that’s what this boils down to & it’s deplorable!

@@vibingroup3460 The burden of proof is on the prosecution to prove their case, not the defense to prove innocence. It should be innocent until proven guilty and it would be in a perfect world. Unfortunately, we don't live in a perfect world. Do you care at all that the prosecution refused to look into the police's belief that the girlfriend could have committed the crime? Or that the prosecutor intentionally withheld evidence from the defense (and yes, the prosecution IS required to turn over their evidence to Green's lawyers)? A lot of prosecutors never want to admit when they get it wrong. The state needs to caring about innocence as much as guilt.

In my opinion, it’s no surprise that prosecutors would withhold evidence pointing to a defendant’s innocence. Prosecutors are out to get a conviction while the defense attorneys try to obtain innocence for the defendant. That being the case, you can’t expect prosecutors to turn over evidence of the defendant’s innocence because prosecutors work to get a conviction. Prosecutors and defense attorneys are adversaries of each other and a prosecutor turning over evidence of a defendant’s innocence would be like the prosecutor helping his adversary. I don’t understand why nobody has picked up on that fact and why people still expect prosecutors to turn over evidence of a defendant’s innocence regardless. It doesn’t make any sense to me.
@theloftons8297

That’s ridiculous! It’s the prosecutor’s job to convict the right person not ANY person. So, if said prosecutor has evidence of someone’s innocence, they probably shouldn’t even bring charges in the first place. If the evidence would prove someone’s innocence, go out and find the right person. You don’t just try innocent people to “get a conviction.” I’m sure you would understand this better if you were on the bad end of this story. You’d want the prosecutor to do the right thing.
