Since we filmed this video, at least one administrative law judge held that Maryland State Police's (MSP) disapproval of an application to purchase a firearm was improper, because the Maryland expungement statute is broader than the expungement statute in the 10th Circuit case relied upon by MSP (Wyoming v. United States). While MSP could still appeal the decision, this is great news and shows the importance of seeking legal assistance. This particular judge's case is not binding on other judges, but is certainly persuasive for future cases.

After the Supreme Court decision in Bruen, Maryland has become a "shall issue" state. However, that does not stop state and local officials from still trying to deny issuing concealed carry permits on other reasons. One such reason that has come up is instances where the Maryland State Police will deny issuing a CCW by using expunged convictions against the applicant.
In this video, Attorney Morgan Leigh discusses the fact that the Maryland state government is relying on a 10th Circuit case out of Wyoming to claim that Maryland's expungement statute is inconsistent with the term "expunged or set aside" under federal law. She also discusses how Maryland's expungement statute is actually much broader than the Wyoming statute the 10th Circuit analyzed.
