3:41 to clarify Pyro a Miranda warning doesn't sign his rights away, he can ask for a lawyer at anytime after and they have to stop (though they will probably persist to still get him to say something) no matter what; him not answering doesn't prevent them from questioning him either. The reading of the Miranda warning is required to basically warn someone that they are being formally questioned, and that they have the right to not say anything and lawyer up; this is why the police often try to phrase it in a way that's not as obvious or say that "it's just routine" to down play it- it's a giveaway that they actually suspect you of something. The reason he's probably not answering them is that he's too strung out from withdraw to care, and / or just dragging things out to make the detectives give up.

Thank you so much for this comment that's literally what the Miranda rights are for you're not signing them away their informing you of your rights and you choose whether or not you want to say anything or invoke your right to remain silent and get a lawyer. I'm not familiar with the laws of this state but it is very unsettling how they're not stopping the interrogation for the lawyer he's asked for a lawyer multiple times and they just won't get him one of they just keep sending in more officers.

You can absolutely still get a lawyer after being read your Miranda rights, even if you have acknowledged that you understand your rights. And you can invoke your right to remain silent at any time as well. They have to read you your rights, and you acknowledging just helps them prevent you from arguing later than you didn’t understand your rights, such as if they read them in a language you don’t speak.

Also, Miranda Rights is a perfectly reasonable term to use given OPs sentence, given that the officers would be reciting the rights that protect the individual and not the law that forces an officer to recite the rights.

Bad Santa is a based as fuck film btw, I'm so glad it's referenced in this video because it doesn't get enough attention. It's supposed to be a dark comedy but there's a deeper meaning, with clever cinematography decisions to hint at certain things. The soundtrack is almost exclusively classical music, which contrats the dark and gritty nature of the film and its done really well. Its actually my favourite film ever

The document you sign when they start an interrogation doesn't remove any of your rights, you can at any point stop talking or say you want a lawyer and they cant do shit about it. All it is is you saying you understand what your rights are, as the police have to inform you that you can stop talking or get a lawyer before they can ask any questions.

They can’t “take away” rights. At any point during the interview he can invoke his right to legal counsel. Yes the detectives tend to manipulate people into not requesting counsel, but they cannot prohibit his access to a lawyer.

Pyro is completely wrong at 4:00. They do try to make it seem like a formality, but what they're trying to do with signing it is not try to get them to "sign their rights away" that's not it at all. They're reading his Miranda rights (Google it, it's named after a famous case) and they want a signature so that it can show that he fully understands his rights during questioning. They are doing this so that the guy can't later come back in court and try to claim he didn't know he had the right to an attorney or to remain silent, or something. They're really just trying to make it so whatever he says in that room actually WILL be usable against him in court later. Without signing it he has a defense of "I didn't know I had the right to remain silent" in court for instance. Which would then make anything he says here inadmissible. This guy signing that paper doesn't lose him any of those rights. If anything it better informs him of his rights if he reads it properly. The cops want to glaze over it and get a signature quickly and move along without him thinking too much about it so that he doesn't start invoking those same rights they just explained to him, which is a pretty scummy thing to do, honestly.

When the interrogator reads someone's miranda rights, it's to inform them that they DO have the right to remain silent or get a lawyer. They are not signing that right away, it's just a safeguarding measure for the interrogators to ensure that, when it goes to court, they don't just say the suspect was forced into a confession or just didn't understand that it would be used against them which is why the interrogators have the suspect very clearly verbally agree to the fact that he IS allowed to just shut the fuck up and and IS allowed to request a lawyer. The miranda rights are actually THE best instructions on what you should do after agreeing to them. The interrogator's job is to make the suspect agree that they understand they have those rights and convince them to continue to talk in spite of that

You can't legally sign away your rights, the second Jeff said I want a lawyer, the officer interviewing him cannot legally say anything to him at all.. This cops not doing his job correctly.. this could get this case thrown out based on the fact they continue to question him after he's asked for a witness. Again he's going through withdrawal and or still under the influence of heroin his story cannot hold up because this individual if undrr the influence cannot be used as he cannot understand his rights due to the fact that his intoxication has on his decision making process

Getting read your Miranda rights is a requirement BY LAW before any questioning that may cause the suspect to incriminate themselves without knowing their rights, and it quite literally includes how you may stop questioning anytime or can ask for an attorney to be present during questioning
