Mental health issues are difficult issues for families. If you have a family member that has been diagnosed with a mental illness you have probably experienced a great deal of frustration if you have tried to get help for them or get them to help themselves. Legally there are not a lot of options available to family members who want to help their loved one who has a mental illness. The law presumes the mentally ill person to be competent. They have the right to not be forced to take medication and to not be forced into a mental institution. You want them to get medical treatment but their illness often leads them down a different path.
I’m Antoinette Bone, estate planning, probate, and guardianship attorney in the Dallas-Fort Worth Metroplex. Today we are going to talk with Mark Tittle about a resource families should know about if they have a loved with a mental illness who finds themselves in police custody, the mental health jail diversion program.
