Undiscussed bill cannot become legitimate law. Mainly a criminal law. For giving a judgment the discussions of Parliament are the base. Hence there is no discussion there is no base.

My personal opinion is the Supreme Court should strike down these 3 new law as there were many draconian laws. What old and irrelevant laws need is an amendments. The BJP government is trying to fool the Indian people but not everybody can be fool by BJP. Secondly, there is a hidden agenda behind these new laws.

Privileging hindi over other languages gives North Indians an unfair advantage and reduces others to second-class citizens. Just because time has passed or been given has no bearing on the controversial aspect. Apart from minor changes, the criminal laws are only ammendment worthy, and not repealing the act, just because it is old. Plus, not enough deliberation have taken in replacing for such cornerstone acts.Even in countries such as USA and UK (who have similar laws), replacing laws is a massive excercise. BJP has done this in a summary manner. All the changes done could have been easily been encompassed in an ammendment. These reforms are a marketing excercise.

What kind of pre-judgemental headline - "Controversial new criminal laws" ? Anything can be made controversial, by merely having someone shout against it. That doesn't make it wrong yo begin with. Judgement should be made afterwards. Atmost you write - critical analysis of new laws, ot problems with the new laws. But what do you mean controversial?

Additionally, UP has the highest number of cases where victims are wrongly charged with crimes (FIRs get filed against them in a State where police often refuse to file FIRs) instead of the actual perpetrators. Govt has embodied colonial mindset rather than de-colonising with these new legislation which gives more draconian powers to police. The Chief Justice has called for improving the judge-to-population ratio, but this has been ignored. The changes introduced using the new criminal laws are: 1. The defination of treason is very vague & ambiguous. 2. Introducing duplicated offenses like attempt, abetment, & conspiracy (applies to not just organised crime, but to legitimate peaceful students & farmers protestors or on KZitem by journalists). 3. Increasing punishment to death sentences! for such non-homicidal acts done by journalists, farmers & students for simply voicing their frustrations, under the Bharatiya Nyaya Sanhita. 4. Removing the min safeguards from the UAPA. The government has replaced British-era laws with even harsher provisions . The new criminal laws perpetuate the colonial mindset of a powerful state, threatening rights & liberty of every Indian citizen. These laws are designed to maintain power & control over the ordinary people, rather than to uphold justice or protect their rights.

Did he say that no. And yes, when you do not deliberate on cornerstone acts sufficiently, and even the final draft bills having mentions of the old IPC chapters, shows the bang up job. No eminent jurists were consulted. I recommend you take BNS and IPC side-by-side and compare them. The controversy comes from that all lawyers, clerks, judges in criminal proceedings will have to memorise new section numbers for no productive reasons. Only increasing the backlog of cases.
