I am the Developer sir. I took land for development from land owner. Total Flats are 10 Owners share are 5 flats Developer share 5 flats I received the OCCUPANCY I have 75% GST BILLS. Now what is the GST I must pay to the department as a received the occupancy. After completion I will be selling flats without collecting GST from the buyer. But should I as a developer need to pay GST for the government for the rest of the flats???? I won’t collect, but is there a rule that I must pay to the GST department from my pocket?

Thanks for enlightening with GST. If the buyer of apartment has a GST number, can he ask the seller to provide his /her GST number while paying to government. Can the buyer take the GST credit back ?

Mr. Rao question might be GST applicable from the date of building completion an obtaining the Plinth completion certificate or from the date of OC ( occupation certificate ) which is mainly given for providing the amenities after charging.

Dear Sir, it's a practical example, I have purchased a flat at KNR which is not a metro city, unfinished flat charged Rs.34,00,000+1,00,000 car parking =35,00,000 got registered. The share of land is 64 square yards, flat area including common area 1700 square feets. Now builder is asking to pay the GST @5% On Rs.35,00,000 to him not to Government directly. as 1700 sft is mentioned in Sale Deed, GST should be paid to the Builder ( not to Govt ) for 1700 sft ( not on carpet area ).

what is the ratio of commercial and residential area. If commercial area is more than certain percentage...they may charge very high (12%)...if commercial area is less ...then 1 to 5% depending on carpet area

Sir, Landowner needs to pay any GST in case he is keeping his flats and not selling to anyone. Also, can you please confirm the best time for the landowner for his flats registration (before Completion / First occupancy or after that).

needs to pay GST....irrespective of before or after occupancy certificate. Your development agreement is liable to GST..you are exempted from GST if you construct the apartment in your own place and sold after occupancy cenrtificate

@@Pavanramkumar Occupancy certificate అంటే Indirect గా GST అని అర్ధం. అది complete కాకా ముందే కొంటున్నారు కాబట్టి GST కట్టి కొనాలి. ఒకవేళ complete అయ్యాక కొంటె బిల్డర్ అనేవాడు occupsency సర్టిఫికెట్ (GST) కి కూడా డబ్బులు కట్టి, including gst occupency value కి మీకు flat ని అమ్ముతాడు, అంటే (Registration value+ flat value +Gst) ఇది మొత్తం కలిపి ఫ్లాట్ value కింద లెక్కేసి మనకు అమ్ముతారు. In case మీరు under construction లో కొంటె (Registration value+flat value)మాత్రమే లెక్కేసి మిగతా gst (occupency)మీ దగ్గర వసూలు చేస్తారు. ఇక్కడ GST అన్నా, Occupency అన్నా రెండు ఒక్కటే. GST=occupency. Constructio ఫీల్డ్ లో gst ని occupency అని కూడా అంటారు😊

not land value, need to pay on the registration amount.For example if the flat costs 50 lks including additional work, but only registred for 30 lks, registered amount is liable for the GST
