Alanna - you and your partner should have done the following 6 things: 1) Inform the letting agent of ALL these problems straight away as one happened. That's what letting agents are there for. 2) Informed the local council of all these issues. 3) Employed a solicitor to write letters to the landlord *from the outset of these problems* to advise him of his legal responsibilities and your legal rights. 4) Found another place to live PDQ 5) If needs be put the whole matter in the hands of your solicitor. 6) If you can't afford a solicitor, go to the CAB (Citizens' Advice Bureau). In the case of the dodgy wiring in the property, this could easily have proved fatal. I believe I am correct in saying that not only does the *landlord* have a legal obligation to supply a current Gas Certificate, but the *Letting Agents ALSO* have that legal obligation - unless there is no gas supply to the property, that is. The behaviour of the landlord was unacceptable and you should have informed the police. In fact, coming into the property without prior notice is illegal. Rogue landlords like this need to be shut down in order that future tenants do not have to suffer what you guys suffered. He was in contravention of the law on each and every one of these incidents. This guy earns money by letting out his property. Where a landlord uses a letting agent, the landlord should NEVER suggest that you go to them first if there are problems. This in and of itself shows a complete lack of professionalism on his part and should set alarm bells ringing. In essence, this man should be spending time behind bars at Her Majesty's pleasure. Sadly, as the tragic and entirely preventable fire at Grenfell Tower demonstrates, many landlords cannot be trusted, and the laws which regulate the letting of properties are often not enforced.
@1mlister

It's tricky though. The renter experience is normally... 1) The letting agent will completely ignore you. You can never speak to the same person twice. They side with the landlord and generally gaslight you for making any complaint, while also being just generally useless at their own administration to the point you can't bare to talk to them anymore. 2) The local council... same as the letting agent but with more admin and less staff. Possibly no humans to speak to. 3) Employing a soliciter - Generally the only good option but only possible if you have the money. In most cases you decide it's not worth the cost or hassel and you just survive and get out of the contract as soon as you can. 4) Leaving as soon as possible is the realistic option. You just accept your fate and that you have to pay a fotune to live in a crap flat until your contract runs out. AND to top it all off you need to also accept that you will lose your entire deposit because the landlord will blame you for all the problems. Add on top of that, the landlords tend to be wealthier than you, have access to a lawyer, understand the system better than you and have leverage over you because they own your only shelter. And when you try to find somewhere else to live, the landlord can make your reference a pain unless you play nice with them. The entire rental system protects the interests of landlords, and even when you want to excersise your rights as a tennant, it's costly, difficult and generally more stress and time than it's worth. So bad landlords thrive.

I thoroughly endorse your advice to get everything documented and photographed, and never, ever, move into a property where the landlord promises to fix faults once you've moved in. He had the habit of just turning up at any time and several times turned up where the girls were taking a shower! Fortunately it was near to the end of their stay, but the Police and the University were informed about the situation. His properties were not included in the recommended properties for students in their second year. We have heard worse but not going to go into that, these people who behave like this are scumbags that don’t deserve customers! That sounds horrendous. I can honestly say, in thirty years of renting, I've never had an experience that bad. For most of that time, I've lived in the North of England. I spent a year in the South, and found it more complicated to rent than in the North, where most of the landlords were small-with no more than a handful of properties-and no letting agency. Also, housing associations are usually better than private landlords, for those with a low income (ie., me). I don't see the private renting situation improving any time soon because many politicians are private landlords, and they will go to any lengths to protect their income and power. 😒

The self serving excuses abusers make all the time is nothing more than cod psychology. And the importance about reporting the abuse to the police and other regulatory authorities is that it protects any future possible renters from becoming victims. I am not seeking to absolve abusers of their crimes. Nor is forgiveness mine to offer; only those they have wronged could do that, and it is entirely up to them whether or not to do so. "Connected to the mains" is British for basically, "plugged in". The "mains" is the main electricity. An appliance can be plugged in like you would plug in a hair dryer or a lamp, or it can be "hard wired" into the mains, meaning the wirers are tied into the wiring of the house.
@1949corek
2 жыл бұрын
From what the electrician was saying I would say the latter was the case, that it was wired directly to the mains. Useful that you do not have to pay for the electricity it uses, but the down side is that it is illegal and you can get arrested.

@@1949corekWhay makes you think they wouldn't pay for the electricity? Electric ovens are often hardwired into the mains (no intervening plug and socket) but the tenant still pays for the electricity.

I think it means it wasn’t on its own circuit. Kitchen appliances use a lot of power and in the UK the voltage of the supply is quite high. So to avoid the risk of shock, large appliances should either have their own circuit individually or sometimes be jointly on a smaller circuit separate from the circuit/s for the rest of the house ( the mains circuit). This means they can have their own circuit breaker to cut in if needed and avoid the risk of electric shock.

I'm so sorry you and you're boyfriend have suffered this appalling behaviour. I've no idea why anyone one would want to cause you so much upset. You don't come across as ever wanting to cause anyone any trouble and I take you at your word that your partner is just as lovely. I hope sharing this has helped you process at least and you have a lot of happy days in your new home :)

My daughter is a landlord she has six houses. She’s had the usual bad tenants and good tenants. However on of her very good tenant left and left r he house in a very good state of repair. Whilst walking round the house with the estate agent to check everything was in order the estate agent said there’s some toothpaste. Round the bathroom sink do you want me to cancel the return of the deposit. My daughter was horrified that they could use this as leverage to keep the deposit. Absolutely not she said she will get her full deposit and I wish all tenants were like her. But it just shows you what sneaky things they do

Landlord claimed he had to hire a cleaner to do the room up and kept my 100 quid deposit. He was ex raf. and a professional arse. A fun situation.

Most of these problems are down to the landlord not maintaining the property, but the failure to ensure that the electrics have been tested is a fault of the letting agency. Thankfully no electrocutions, but the first flat I rented 30 years ago was not the best experience. It was in the basement of a large Victorian house in London and the landlord lived upstairs in the rest of the house with his family. We had a separate entrance but there was a shared internal vestibule to the landlord's office that also connected back to the main part of the house. One day we came home from work and our sofa was gone. It was a folding futon style sofabed. We asked the landlord where it was. "Oh we need it for the weekend, we have friends staying, so we've taken it upstairs!" So we had nowhere to sit for two days apart from the hard dining chairs. The landlord's wife (new-age hippy) decided that she was going to start a group with her friends to bring all their kids together for social activities at their houses every Saturday morning. There were three of them in the group so every three weeks our Saturday mornings would start with a gang of kids doing a dance class in the room immediately above our bedroom. It sounded like a gang of baby elephants rehearsing for "STOMP!" ( kzitem.info/news/bejne/un6hvKpvp5GpZ6w ) We paid the electric bill for the flat ourselves and after a few months realised it was unusually high. We turned off everything in the flat and checked the meter and it was still going round (they still had dials then) - there was power still being drawn from the supply. Turned out the landlord was running half his house from our meter. He tried to deny it, but it was obvious. I waited until it was dark, then turned off the incoming supply at the consumer unit. All the lights upstairs went out. Eventually, we gave notice that we were leaving. "Oh no, please don't go, I don't have your deposit to pay you back yet." Back then there were no deposit schemes, but the landlord was required to keep the deposit separate to his own money. We spoke to the agent and he sided with us. There was no maintenance issues in the flat, so the agent and I agreed that I would simply withhold the last month's rent in lieu of the missing deposit. Landlord pleaded with us to pay the rent cause he needed it. Why would I if I knew that he was not going to be able to pay it back at the end of the month?

Hi Alanna. I am a Landlord myself, and this story really resonated with me. Be assured that the vast majority are nothing like this guy - who sounds like he has Mental problems. There will always be predatory people who will take advantage of decent, nice people; it has happened to me in the past. I hope you and your partner who sounds lovely, have gotten some resolution. It's a cliche, but "what doesn't kill, you makes you stronger" - seems very apt in this case. Your inner beauty still shines strong. Now get back to drinking and eating 😉🤗

So glad you both were successful in getting your new home in time, and ditched the very dodgy landlord from hell, then had the guts to do all the right things to avoid the follow up scam. I remember watching at the time, you giving a limited version of your cautionary tale, with less detail pending possible proceedings, beyond a broad "renter beware", presentation. Must have been seriously hard to keep it objective and keep it together making it given the types of issues and implied "ex-miliatary with a key", stuff. Glad for you, its done with and you're somewhere far better, and extra marks for sharing the saga to inform others in similar circumstances, or help avoid them. As a hopeful cheering footnote, my first manager who openly admitted he thought a key part of his role was trying to find reasons to fire people, and kept referring to being an ex-para (paratrooper ie badass), except we found out he was actually in the catering corps for the Terratorial Army... a nasty little bully, but rather sad and laughable ultimately, who accumulated enough black marks for questionable methods, didn't get his contract renewed with implied prejudice. Perhaps his former services to bad tea and lumpy potatoes potatoes helped his later career, but.... 😊 🥂

I am so sorry that you have had all these problems with your nasty ex-landlord. I am a Brit and have not had too much letting experience but I did have one awful experience where I had a break in. When I stayed in a downstairs bedsit in Manchester, England. I only had two visitors to my bedsit, ever, my fiance and my landlord. I only had one item worth anything at the time; an electronic typewriter (this was pre word processor or home computer era) which I kept concealed between two armchairs -it could not possibly be seen by anyone prying from the street window , I made absolutely certain of it. The day after I moved in the landlord came and looked everywhere. He saw the typewriter, he said ' That looks valuable; it will be stolen there it can be seen from the window!' so I said, 'No it cannot I did check,absolutely and only you and I know it is there!', about a month later I let myself in the building front door by key only to find that my bedsit had been broken into and my typewriter was the only thing gone. I called the police. They asked if I had informed the landlord and I my reaction was, 'I think he knows!' I got a council flat due to being 'vulnerably housed', possible at the time as I was registered disabled and on my own, I took the Land lord to court for my deposit which he was refusing to return. I won plus expenses. He then pretended that he had no money on him and no cheque book or ability to pay. The court ordered him to pay by cheque by a certain day or would be liable to further court proceedings. (Which i would have to institute and pay for). I never got that cheque. I am so glad you had a better outcome. There are b/tards in every country, don't let it mark the rest of us!

Whenever contemplating renting a given property, always *demand* (not ask, but demand) to see and to be given photocopies of the following: 1) Current (and valid) Electrical Certificate. 2) Current Gas Certificate (if the property has a gas supply) 3) Feedback from former tenants. If the landlord or letting agent refuse to do this, then move on to another property. But you can tell them that under the Freedom Of Information Act (2,000) they have a *legal obligation* to supply these upon demand. You can also inform the local authority (town, city or district council) that the landlord and/or letting agents refused to show you these. Rogue landlords are a menace and need to be stopped in their tracks.

We've had issues renting in the past but nothing like this! Well done for negotiating the return of your deposit. Actually thinking about it our previous landlord (we bought the house off our last one) was going to sue us, but never did. We paid them half the debt they claimed we owed but they never responded. I hope this video helps you to come to terms with the experience. Like Adam Clark said your partner sounds awesome I think I might be having a bit of a man crush already!

My goddaughter was having trouble over her deposit and it was stressing her. After a conversation we decided seeing her uncle was close at hand he should go with her. She went to the agency which was owned by the landlord with her uncle, he waited outside. The landlord shouted at her and her uncle went in - as a 6'2" ex rugby player he doesn't get shouted at much. After a short discussion where the landlord still refused the deposit he handed him his card which had the name of a medium sized Edinburgh law firm. His name, QC and partner. Then there was a letter before action giving him 7 days. She had the cheque before she left.

On the plus side, now you’re clear of that situation, you can be thrilled that you survived and learned from, an encounter with the legendary Arfur Daley ( tv show ‘Minder’) Also, using the famous “Dong dong” from ‘Law and Order’ was an inspired choice! There is nothing exaggerated or clickbaity about your story. I have had all these experiences* with landlords and/or letting agents (although, thankfully not in the one rental). *with the exeption of the Ring doorbell part, they weren't a thing when I was renting. ETA: Apologies for commenting on an old video, I've been rabbit-holing back through posts I'd not watched before. My wife is a landlord and what you are describing is a horrible experience with an awful landlord. What they are doing sounds illegal (unsafe wiring, entering the property without your permission). Lesson learned. If going through a property manager, or "letting agent" ALWAYS go through them and never contact the landlord. That's what the landlord pays them for. Never pay half of anything. Repairs must always be done ASAP and not "when they get around to it" another good reason to only deal with the property manager.

You never get the deposit back in full... I was told at my last place that the kitchen seemed "sticky." I am a professional chef and that doesn't happen in my life. £150 deducted for cleaning. The carpet is attached to the floor so that is covered by building insurance that a landlord has to have. And top tip change the locks on the door... they would never know and when you move on give them the new keys. A landlord does not have a"statuary right of entry" to your home. £20 well spent and you've done them a favour because what ever reason you want (the key broke, someone put glue in it etc.) but they have to ring the doorbell then rather than just turning up in your living room.

What a load of horror stories here Alanna, it goes to show that landlords are not on the side of their tenants. Even "the best" landlords there are can only be as good as 'decent enough'. The whole relationship is about power and need. It's been said, "landlords provide housing like scalpers provide concert tickets"
