Me and my husband asked an officer to help us with car issues officer # 2 opened the passenger door and searched the vehicle unconstitutionally and one of the guns was a p80 the others were factory guns they are now refusing to return the p80 and without the firearm I don’t know how to serialize it the da in the case clearly showed her bias by saying and I quote “I’m tired of dealing with this shit” even though the way I understand the law I don’t need to have it serialized Just curious is you have any thoughts or advice I would appreciate it Thank you, sarah

Part may depend on what state you’re in. There could be a state requirement of serialization. Under federal law you do not have to serialize your gun. It has to get serialized if it gets taken in to possession by a licensed dealer, the dealer has to serialize it. That said, if it wasn’t an authorized search you could talk to a lawyer. They can FOIA body cam footage and go from there. P80s aren’t illegal and my understanding is they have no legal right to seize your personal belongings. You may have a 4th amendment lawsuit.

@@Gunner411 it was in Maryland and the search was clear as day on dashcam and the judge allowed the evidence anyway claiming officer safety even though it wasn’t a traffic stop me and my husband ask the cop for help then lead to that happening

This is my personal view on this whole 80% lower frame issue. Before I begin making my comment I want to make this very clear I'm not an attorney so any information that I provide I would suggest you consult an attorney that is first in federal gun laws preferably a gun attorney who's very acquainted in these type of laws with that out of the way let me just say the following. Prior to all this political correctness on the attacks of what they call ghost guns where I prefer to use the term self-manufactured firearms the new problems is whether or not you may need a serial number on your firearm as you know California requires it so you would register your firearm through the California database system which personally speaking I think it's a bunch of nonsense but you know how California is they want to be unique. But the caveat is other states that totally prohibit the ownership or possession of what they call a ghost gun or a unserialized firearm whether it be a 80% Glock frame or an 80% AR-15 AR-10 or an 80% 1911 frame oh yeah there is 80%, 1911 frames out there as well. If you live in a home state where you're not prohibited from owning a self manufactured firearm then you're good to go however if you cross state lines in a state that may frown on self manufactured Firearms or as they call it ghost guns you may be putting yourself in a predicament legally. Now in the past the Bureau of Alcohol Tobacco and Firearms said that if you wanted to sell transfer or trade a firearm you have to fill out a form become a manufacturer and then only then would you be legally allowed to put a serial number on a firearm for sale distribution or whatnot but there was never a provision for these 80% kits. My suggestion would be a special form for self-manufacture firearms which would allow you to be issued a computer-generated serial number by the Alcohol Tobacco and Firearms which would allow you to have a jeweler or a person who could do laser engraving that meets the criteria of the ATF regulations for serial numbers and then you would be allowed to either trade sell or profit from the frame but remember once a serial number is placed on this firearm it could be in a database and that is the caveat and one must maintain so what I tell people is if you're going to cross state lines with a self manufactured firearm you better acquaint yourself with the neighboring states laws as they may not be receptive to ghost guns as they call them food for thought

Basically federally register it then do your own engraving. I could support that, especially in the restrictive states. As it stands there isn’t any registration in “free states” when the firearm is serialized. The FFL just has to put their identifier preceding any customer desired # or number it as they see fit after their identifier

The main point of discussion on that is Cerakote work. However, taking it in for engraving, etc. There are non-functional things that qualify as “gunsmithing”

@@Gunner411 True, but you can simply buy a Cerakote lower and as far as I know you are not required to go to a FFL for engraving work? I may be wrong on the second part, but I don’t think I am. This new rule is dumber than putting a stock on an AR pistol is a felony or that putting a hand grip on a Glock rail makes you an instant criminal. I am overjoyed that the Supreme Court had ruled all gun control is illegal, but it will take five years of nonstop battles to get rid of it all.

@@jessebarnett4205 engraving of firearms or firearms parts requires a FFL 100% now. It used to be that as long as the owner didn't leave the premises it was allowed because then the engraver never "took possession". Now working on firearms belonging to anybody but yourself in any capacity requires a FFL 100%. And yes, I agree there are court battles ahead. I think the issue is going to be that they'll drown people in debt and then plea down or dismiss charges so there isn't any type of conviction that somebody can appeal and take up to the supreme court.

@@Gunner411 Normally I would agree with your court assessment and I have no doubt the ATF and lower courts will attempt exactly that, but things are rapidly changing. Courts are now excepting cases simply for a violation of rights without the need for charges as demonstrated in the most recent Texas court decision. It is not necessary to be charged with a crime to file a civil rights violation. The FRT rule for instance is an infringement of rights even if you never owned the trigger.

Are you saying that now, if somebody makes a PMF they can't choose there own serial number to put on it (themselves)? what if I scribed "Fuck the ATF69" on my PMF before, but never reported it as a serial number? Thanks for your video!

I suppose that if you have your own tools and can reach the required depth, a dealer would never know when that serial number was applied so they'd have to take it as it was. You just can't take it to a dealer or anybody else and pick your own serial number any more.

So I have an 80% arms glockenspiel lower. I have not finished it yet because I don't know what the laws are on hand guns not having a serial number. Can I finish it and it still be legal? No intention of selling.

Yep! No issues there. If you ever take it in and have to leave it with a dealer they’ll have to serialize it but old kits are grandfathered in.

Once they try to require the 4473s be sent in upon completion or in circumstances other than denials, I agree. As it stands, nobody knows somebody bought something except that dealer unless they're in a state that has different laws.

Did you make it? If so that’s awesome. An individual putting a serial number on a privately made firearm has always been an option, now FFLs are just required to serialize them a specific way and it isn’t optional if the FFL has to log it in their books.

You work for the atf? Serial number = they have a record of where to come confiscate them.

Serial numbers are logged on 4473s and a log book at the dealers premises. That information does not get sent to the ATF unless the dealer goes out of business or they have some reason to look in to a specific person. When I run a background check ZERO information about the specific firearm is transmitted to them. Only whether it’s a handgun, long gun, or other/frame/receiver. They don’t even know the firearm gets transferred on an approved background without actually contacting the dealer.

That’s a myth, one that we refer to as “FUDD lore”. The ATF part is the 4473 and logbook (mine are all still in paper form so no one sees them unless they come to my shop) and the FBI runs the NICS check (some states do their own checks). The two do not talk. The only way the ATF even knows I did a check is because I write an NTN on the 4473, which is gone from the system in 30 days. The FBI only knows I’m doing a check for a gun, they don’t know the make, model or serial number, that information is not part of the check. Trust me….we don’t like running them or the paperwork any more than you do. #repealtheNFA
