I watched this with interest since the County of Los Angeles may very well enact similar ordinances when their moratorium expires in March 31. Notice how much the City of Los Angeles is trending towards a situation where a no-fault eviction has a punitive financial cost for the property owner. Once they move in, it's very expensive to move 'em out. Looks like the only breath of fresh air is that if you rent out your single family residence home or condo for a few years because you move to another temporary location, you can move back in, exercise a no fault eviction, and only be liable for one months rent for relocation. Looks like this is last similarity with times past. Summary: It looks like rental properties are very poor investments for small landlords. All of these laws are supposedly to combat homelessness, when in fact they drive investors out of the rental market.

Great explanations on so many landlord-tenant ordinances in LA. Thank you. I am an owner of a single-family dwelling (exempted from RSO) in city of Los Angeles but under Just Cause Ordinance (built before 1978). I do not owe any other rental properties in LA nor have another SFD in a separate lot. I Rented this my single family residence for 3 yrs to a couple but they now want a relocation fee. Do I fall under JCO and require to pay one month relocation fee?

What is everywhere whether you pay your rent on time, been there number of years the landlord will evicted claiming remodeling up grades and then jack the price up or they raise the rent so high knowing tenants can't afford that so they have to move. Greed in all areas for all people will be the down fall for soooo many whether you are a landlord or a tenant. Karma is energy whether it's good or bad and it will come to everyone no matter who you are. A lot of people will not make it past the next three years.

Can you possibly help clarify something? I'm in an owner occupied 1923 RSO LA CIty duplex. Because I live in one side and always have, is the rental side except from AB1482? I keep hearing owner occupied is, but my understanding is that it's just the owner occupied side that is exempt, which seems absurd, because of course it is, I'm not going to evict myself. So the only think it really means is I don't pay the fee for my unit, just the rental. Thank you.

If the tenancy started after you moved in, then yes, the duplex should be exempt from AB 1482...as long as you gave the exemption language. And yes, this means the other unit you don't live in is exempt from AB 1482. But in your case RSO is more strict and you would most likely not be exempt from that.

I am an attorney helping out a friend who is facing a no-fault just cause eviction. I don't do this area of the law and find it confusing so any help is appreciated. I can't remember which statute/ordinance/code provided for 90-day notice for no-fault eviction and one year for a qualified tenant. I can't find it now and I don't know if it applies or not. I see the rental assistance is listed for no fault evictions like owner move in and ellis act/remodeling...but do you know how much time the tenants receive to leave? Depends where it is. Ellis Act terminations do have different regulations and those may change, as well. Owner move in for LA City should be 30, 60 or 90 day notice.

I did a no fault back in January of 2021. I gave the tenant a 60 day notice. One free month of rent and a relocation fee equal to one month. I guess I was lucky.

Hello, I am a question. Last year a bought my first House. I got a duplex. My agent didn't tell me about moratorium eviction. He just said as soon as I got the house, I would just send a 60 days eviction letter and I could live in the House. I didn't so, but unfortunately I face with the law. I would do the eviction. The big problem is that my monthly mortgage payment is $4400 and the tenant are Just paying $800 for each house. It's been so hard for me to keep paying my rent and the mortgage. My question is if now I could evict them? They are only two women, the mother in the back house and the daughter in the front house. As I said, this is my only one property. How much would I have to pay for relocation assistance?

Make sure you discuss this scenario with an attorney...that was potentially negligence by your agent. Is this in LA City? Then, you should be able to pay one month's rent for relocation assistance and follow the other steps for owner move in...you probably have to wait until the LA County Eviction Moratorium is over, discuss with an attorney.

LA City Eviction Moratorium is over, it now defaults to the LA County Eviction Moratorium until March 31, 2023. In other words, if a landlord in LA City tries to evict for nonpayment of rent due to COVID, the tenant could use the LA County Eviction Moratorium as an affirmative defense through 3/31/23 because LA City sits in LA County. Another great episode. Could you explain what does "single-family dwelling" mean in SEC.165.06 item(6)? I thought a condo unit count as "single-family dwelling" but now I'm not so sure about it. I definitely own fewer than 4 units and I don't have more than 1 single family home on separate lot. It's the part it says the property has to be a "single-family dwelling" I don't get. What does that mean?

I believe they mean condos as well. In the beginning of the ordinance, they define "Residential real property" as any dwelling or unit that is intended for human habitation. I think they intend a single-family dwelling to include any type of dwelling for a single family.

However this is not what LA city council stuff and LA housing department told me. They told me the language in the new ordinance basically means "single family house" and for condo owner you still pay 3 months + 1400 for relocation. I don't really know why they did it this way. They mentioned about giving small property owners a break in council meeting but they're not doing that. Now they also make owners can't afford to quit. One unit with $10k is already bad, imagine that a owner with 4 units got hit with $40K relocation assistance before he can quit.
