Maybe we should bring back the old drop and stop, I know a lot of corpo rat executives would be getting their necks measured and I'm okay with that, they've certainly done enough damage to society and the country, they shouldn't be allowed to simply pay a fine then keep on breaking the law like nothing happened.

What puzzles me, why would the victim need to undo it? Can't the victim not simply go to the police, or a court, report the crime, ask for an injunction that all involved parties need to undo the fraud on their own costs immediately. And WHY has NO court so far decided that the administration needs to fix the problem within x months or be held in contempt?

I think it is because it is considered a civil matter rather than a criminal one. Someone breaking into your house is a criminal matter and someone squatting in your house is a civil matter.

Because that's the way the system is rigged. The individual has to jump through a thousand hoops to fix something that wasn't even their fault. Credit card fraud, bank fraud, identity theft, etc. The onus is 100% on YOU to fix it. The government and businesses don't want to help you unless you force them to, and even then they drag their feet to the point in can take years to fix what should be a simple clerical correction.

Nah, the courts and law enforcement will just miraculously find the resources and motivation to resolve it in record time and the criminal gets max sentencing. Until people stop thinking politics is something external to how the society in general thinks and behaves ain't nothing changing.

My grandfather once told me if I ever bought land, put a structure on it and visit at least twice a year. Seems something like this incident happened in his family back in the 30’s. So not new by a long shot.

When I entered the real estate market in 1979 as a sales person or “ realtor’, I recognized that things like this were very possible. I’m not surprised in the least bit. It’s actually quite easy under the right set of circumstances. Absentee owners are the easiest.

@@Gypsygirl9 The title insurance company guarantees the validity of the title to the person who bought the coverage. It is in no way liable to anyone else. The real estate brokerage could be sued, but that probably won't be worth the legal cost and bother.

Bought some land in Germany a short while ago. The notary had everyone involved bring a photographic governmental ID (and had his clerk check each for authenticity), sale documents from the previous owner and had taken about one and a half month to go through all of the records and finally approve the sale. Sure, this ain't cheap. But this kind of fraud is almost nonexistent here as a result.

I had an issue recently where we owned a piece of land and went to sell it because my father had become ill. We felt there was no sense keeping it and figured a few thousand dollars would help with his medical bills. I called a relator and got it listed. He also sent a letter to the neighbor of the property to which the man was interested. When we went to do the actual paperwork, we found out that the township had sold it to a development company ( who owned the industrial park bordering it ) claiming it went up for tax sale. Supposedly, this had happened at least a year before we went to sell. We never received any communications from them BUT the ironic part is they continued to send us tax bills for the property. I really think there were shenanigans, but we ultimately decided it wasn't worth pursuing ( talking under 10k for the lot ).

If they sold it for taxes. Then the taxes of each year the taxes were paid left a paper trail. Starting with your receipts. I go and pay my taxes and I got receipt for each year. My cousin pays at her bank who is authorized to collect the taxes from the people. She has receipts issued by her bank. Papertrail. Even a money order has a paper trail.

Crimes like these, in the old days, were punished HARD. If we treated crimes of fraud with the severity that they're due, instead of "slap on the wrist" treatment, it would go a long way towards ending this sort of thing. Rob a bank of $5000? 20 years in prison. Defraud someone in a transaction for $500,000? Maybe they serve 2 years, then paroled. This makes NO sense.

Agreed. and it is NOT just the Fraud person himself that should be punished. Cause while they Forged fake Documents, it should ALWAYS be up the the Bank, Retailers, and Insurence company to actually DOUBLE CHECK and INVESTIGATE to make sure it is all 100% legal. If they do not, if they just accept the papers blindly, they are ACCOMPLICES and should be faced with the SAME Punishment. Cause THEY have a Legal Duty to make sure the papers are LEGAL and CORRECT for the Transaction to be Legal. If the Transactions is not legal, THEY, EVERYONE involved besides the victim are ALL 100% at fault, and the Penalty should hit EACH of them. ^ Do this, and Fraud would fucking VANISH over night. Every Realter and Insurence company would request in person meeting, with ID, Birth Certificate, and the PHYSICAL DEED in hand, which will be checked against the system to make sure it is 100% legal and in your hand, and not created recently. ^ Cause honestly, THAT is the BIGGEST bit that I don't fucking understand! How do you SELL THE LAND when you DO NOT PHYSICALLY HAVE THE DEED! It should be FORCED that you have a PHYSICAL DEED present to sell land, a Physical Deed that only the last known owner can get, or get a new copy of. There should be a paper trail, to EVERY copy of a Deed, from it's FIRST creation to NOW. There should be a Record for every time it was copied, what happened to those copies, every sale involving that deed and new update for the new owner. It should be IMPOSSIBLE to sell land without proper legal ownership of a physical deed with the deed database company being fully involved, supervising, and recording everything about that Deed being happened, in person, and ESPECIALLY now a days, it should be RECORDED, on Camera, and preserved, every single Transaction that happens and Transfer of Deed to new Owner and then updated with that information. Cause back in the old days, you had physical deeds, and you had to HEAVILY PROTECT THEM, cause without that Deed, you LEGALLY did not own a damn thing. And thus someone Stealing or Destroying a Deed, was Equavilent to Destroying Property, cause you could not longer legally be the owner of that land. Moving it over to Digital, was the WORSE possible mistake, cause it falls onto an Honor system, and belief that system isn't broken, and that people aren't lying about being the owners.

Here in UK we have a _land registry_ and can register to be informed of any access to our land records, so we'd be informed directly of any attempt to sell out property, or even to obtain planning permission (to build on). It is legal to apply for planning permission on somebody else's land, and can be used to find out whether the local authority would consider the development suitable, before making an offer to the landowner. But as I have registered I'd get notification.

How does the land registry know you address? Could a scam setup up by changing the land owners address so that the original owner does not get the notification? Do you get a notification of address change to the old address? Could I intercept that address change notification? We are speaking about identity theft. Things like faking ID and Utility Bill are trivial in the context of that.

In fact, i just bought a house this year. Not only did i have to provide proof of ID, i also had to provide proof of financial ability to pay. And any time i had to sign documents, it was countersigned by either my realtor or my lawyer. I was actually checking how thorough they were, based on watching Mr. Lehto's channel. Plus, it was a fairly sizable amount of money, and i was super cautious.

I have a difficult time wrapping my head around this. I have been to a number of settlements here in PA, and it is neither a simple nor easy thing to transfer a real estate title. All parties involved need to show multiple forms of identification, and all taxes must be paid before a transfer can take place. you just about need a letter of reference from the Almighty to accomplish this here. Then I hear about these transactions taking place without the owner's knowledge???? How is this even possible? Surely not here in PA!!

Presenting ID's at closing is for the notary ,also at closing, to verify signatures.. If the "seller" is not local, then a notary on the seller signatures is accepted, the paperwork can be sent overnight, out of state for (fraudulent) seller signature and notary. The taxes(and mortgage balance) in Lehto's story were paid at closing.

@@scottnunya1 My point is that it is simply not that easy to do this here in PA. They check, recheck, and triple check everything. Once that is done, the paperwork goes to the recorder of deeds to be filed. Nothing simplwe about it. I have about 5 pounds of paperwork from my last settlement.

Bank needs 2 IDs because they are on the hook for a mistake. The government makes it so they are never responsible for a mistake, which is why they 'trust' the notary stamp/etc.

Most county recorders are understaffed and overworked. Most people have two primary interactions with a recorder's office: Voting and property sales (usually "warranty deeds"). However, the recorder's office can have several dozen document types they handle - also known as "recording instruments." For every 100,000 people living in a county, a county recorder will move (record) about 100 documents per day into their systems. That's a rate of about one document every 5 minutes. Phoenix has about 1.62 million people, so that county probably moves 1,600 documents per day or roughly 1 document every 17 seconds. When you sell a home, a tree somewhere is sacrificed and dies. The documents may be standardized but will be fairly extensive in nature. Most county recorder's offices digitize incoming documents into a searchable format for easier storage and retrieval. So it is easy to see how a county recorder would say that it's not their job to police the accuracy of the incoming documents - they simply don't have that kind of time to do that, especially during election years where they still have to do their primary task of processing recording instruments and also handle tabulating votes for election results.

I know someone that got defrauded out of a multimillion dollars piece of property. They had his bank account numbers forged a contract and transferred money into his accounts. Case even went to state court if appeals and he lost. They gave him 2 million for a 5 plus million piece of property. The ultimate scam. He was a close personal friend and I have never seen so frustrated, angry, violated.

My brother once had to submit a form that had a "raised seal". He is several states away from where the original document is stored and they don't issue copies by mail. He took his copy and stamped it with his own "from the library of" stamp and submitted it. It was accepted because nobody ever reads the raised seal.

We had fraudulent buyers. One guy would put an offer on something, try to rush the sale, claim he was traveling in Canada, send a big cashier check for more than the sale and closing fees and without waiting for a settlement statement then request a refund. We told him we wouldn’t deposit it and called the issuing bank, they said the cashier check was voided and fraudulent.

Surprisingly the documentation process DOES NOT require the court to VERIFY the documents. It happened to us around 2008 when we refinanced. The notarized stamp was in a DIFFERENT state NOT where the documents were signed. There MUST be some VERIFICATION process from the Notary, Title company, County Court Registrar! Otherwise, ANYONE can claim any Property at will.

I expect a a significant increase of this in Maui with all the chaos and confusion. "Yes, I'd like to sell the land here that I totally own to these real-estate companies that everyone knows is trying to buy up burned land cheap. I'm totally someone who is desperately trying to sell my ruined land and move away. I'm also all these other people too." I wouldn't be surprised if some of those companies try to pretend to be some of the people they want to buy the land from and rely on the chaos to cover it up for long enough that nobody can find out who impersonated the actual owners, and pile up enough of it that it's impossible to sort it all out (on top of nobody trying to sort it out in the first place).

Without a realtime central database of who owns what property (in an ideal world) this is a tricky problem to solve. Ownership of things should be secured so that they can't be taken and fenced, land is no exception.

They should be treated like any other case of stolen property. It’s stolen, unlawfully sold and still legally belongs to the person who rightfully owned it. And if you refuse to give it up now you’re in possession of stolen property. I hate to say it, but the buyer needs to go after the person that sold it to them. The person who had his property stolen shouldn’t be the one getting the biggest run around.

I inow a lady in Fern Forest who bought three acres in the forest. Her and her husband did all the work. Built a cabin, a greenhouse, put in the catchments, everything, the solar, the genetators, etc. Then she got a letter from someone in Japan that she was squatting on their land. She wrote the people back and told them to come on out and theyll deal with in court. She hasnt heard back from the people in Japan.

A one-sentence makes almost all title theft go away overnight: Require a government-issued photo ID and thumb print to file a deed. Just like cashing a large check at a bank.

In Canada it’s pretty standard to offer title insurance as part of the purchase transaction. It’s as cheap as 50$ one time and is transferable to any future buyers. It covers all the legal costs associated with correcting this type of thing as well of title fraud. If anything like this exists in the us i recommend everyone reading this that owns a home look into it.

Also just a nice piece of advice. If you pay off your mortgage the bank sends you a discharge letter that you take to the title office to discharge the mortgage (in Canada) nothing says you actually need to discharge that mortgage. It’s got a zero balance so obviously the bank isn’t asking for money. But if anyone tries to pull any shenanigans on your title they will see the mortgage and need to have it discharged that requires a trip to the bank which they are not going to do so 99% of the time they will just move on to the next home (looking for one that’s free and clear title) When my dad paid off his mortgage he framed the discharge cert from the bank. Years later when he passed away we sold the house. The lawyer pulled title and saw the mortgage. I had to run back to the house grab the framed certificate and bring it back before they could finalize the transaction.

"Cost all of ONE Postage Stamp"? People don't understand how expensive it can be to move paper, this did not help. Cost of the Stamp, Cost of the Envelope, Cost of time for a Hired Employee to acquire material, use material, move material. Rent/lease for the real property, "office" equipment purchase/rental. plus other expenses; so that a 15USD or 20USD fee is easily attainable as a cost expense on a billing. Don't lawyers fees include these too? Off topic, My sister & her husband owned a piece of property, they cannot sell it. Because it is on a dirt road. A buyer would Have to pave the road, and install utilities (sewer & water, maybe gas) should it be bought according to 'new' zoning laws enacted years after they purchased the land.

Makes me nervous...actually thinking of buying my piece of "retirement land". Things like this don't make me feel comfortable doing so. This guy did everything right, and it is only blind luck that he didn't lose his property. Methinks the title company should reimburse him for his attorney fees, since they had no problem reimbursing the defrauded buyer. Wouldn't surprise me that this is a ring racket...and wouldn't surprise me if they struck again.

When the bank says it's a windfall they don't think that's fair, what happened to the money already paid to the bank? Did the bank keep the windfall? Was it given to the title insurance company who had to pay back the money to the buyer?

Surely there would be a centralised registrar that holds all legal owners of land. Given that there was payment being made, there would have been records of these payments. The county totally failed in its care of duty to not only contact the person making payments and to verify the person bona fide they illegal took possession of the land. This should never have happened regardless of whether it was occupied land or vacant land.

WE have adverse possessors moved in next door. I called the title company for help 30 months after closing to see what they said. They gave me a little free advice and told me to call my title insurance company. Could not get through to a person. Their policy is so heavily caveated and vague that I can't imagine they will help us. We bought without a new survey because one had been done within 12 months of our closing and the data reinforced the plat survey data and county GIS photos and adjacent property surveys filed publicly. I think title insurance is of little help once someone takes your land.

Perhaps -- and this is just a thought -- property needs to be defined in secure block chains where every transaction is embedded in the chain. Fraud would not be impossible, of course, but would be much more difficult. As for property in an unrelated matter, it seems the government somewhere along the line recently authorized FEMA to seize stockpiles from people and just give it to whomever they deem needy. Some how, some way, this has to be unconstitutional but it will probably never be questioned. Have food stocked up for an emergency? Armed thugs from the government are authorized to seize it, now that it is deemed due process.

I bought a watch from a pawn shop. There is a sign over the watch case TWO FORMS OF ID REQUIRED TO REMOVE WATCH FROM CASE. If they can do that, so can the official agencies involved in a land purchase. AND all parties involved int he sale SHOULD BE REQUIRED to be present IN ONE ROOM AT THE SAME TIME to conduct a sale of land, etc.,

Turns out, land is the most pilferable item there is. The title companies don't do anything beyond cursory searches for easements or claims of ownership or past liens, county clerks and courthouses do no validation of proof of legality for anything that is recorded, county clerks will not help a diligent land owner dealing with a boundary bugger trespassing neighbor to conduct an easement search though the labyrinth of old and unwieldy public records, laws enable adverse possession with often nothing more than a few statements from neighbors, taking by acquiescence is a thing apparently that is like adverse possession but does not even have to meet even that level of scrutiny, then there's "variances," where a neighbor can hook up with your local powerhouse realtor, a county planning and zoning guru and a well connected surveyor to take a portion of your land without you knowing until it's too late, then there's eminent domain. Cops aren't going to get involved ("lady we ain't surveyors or lawyers, this is a civil matter"), county staff won't get involved (gotta stay objective), and lawyers won't give any advice other than start a lawsuit and even then most wont touch these cases for taking of small parcels from a common citizen with not so deep pockets - let alone portions of parcels. So why buy land at all? Stick to a quarter acre, no HOA, in an established neighborhood, survey it before closing, and fence it within a week of closing and live ion it with security cams and no trespass signs and tolerate no one entering ever. That's the best you can do. Holding property for use later is certainly unwise.

Seems fishy, the purchaser knows who was involved, he purchased the land from a person and paid off the loan of the real owner…go after the person who sold it.

Why isn't the Title Insurance Company responsible? The regulator of the Title Company should look at this problem and report any need for additional regulations to the state, with input from realtor and the public.

Suppose they pull this on a plot of land with no surrounding neighbors? Say you inherit some land in a remote part of another state. You decide to hold it as an investment but since it's undeveloped you rarely, if ever, go there. Scammer comes along and sells your plot to an unsuspecting buyer. Buyer builds on the lot and lives there for several years before the scam is discovered. Could the buyer argue adverse possession if they were on the land long enough?

Most notaries have to have insurance. The owner could sue them in addition to the Title Insurers to get his costs back.

Why would the company that paid the nine thousand dollar mortgage not ask the owner to clear that up? Makes me think they were in on the scam and that is why they paid it, Doesn't make any sense otherwise.

Best way to fix the issue is to add a state law or better yet a federal law that adds requirements to the title insurance that when it is found to be fraud that the tile insurance is also responsible to cover any legal fees and damages to the true owner of the property as well as refunding the buyers. The law would work basicly the same way states require certain coverages for liability in auto insurance. Create a law that requires title insurance to also have a liability for damages and pay the victims costs to fix the issue. If this were added you bet the insurance company would be holding the title company to a whole new standard of how to ensure the title is free and clear before the sell.

Many States and the Federal Government have laws that state : Should a property owned neglected or made no effort to improve or develop may forfeit their claim to ownership if a person builds structures -ie- Home Barn,coral, establish ranching, farming, forestry, logging,sawmill,mining,- fence the land. And prove you have developed the claimed land for 5 to 7 years.- note I am not quoting the laws word for word -I'm trying to express the essence of these laws. This is why in many Western movies the plot of the ruthless Cattle Rober Barron. Claims 300,000 acres. The land is not developed because its used for grazing. A Homesteader in search of a homestead in a remote area. Where there is no available Courts or any means to publicly legally claim the land. The Homesteader builds a Cabin a Barn, coral,perhaps has a few head of cattle is farming and fenced the land. The Cattle Rober Barren discovers a trespassing, no good "nester" on his claimed land. Perhaps the Homesteader has fenced 1,000 acres. The Rober Barron must persuade- threaten,burn down,use force of physical and or armed assault. Many gun fights settled these situations. Often the Cattle Rober Barron hired gunslingers. I know there are simular Federal laws about Federal public land. You cannot attempt this in a National Park, National Monument, Regulations on National Forrests allow 99 year lease provisions. But finding when lease land is available for bids, you need strong inside political connections. I worked the Ocala National Forrest and I couldn't find out anything other than it would be publicly announced in news papers. They must post the available leases in some news paper- Far outside the the 2or 3 Florida counties that are partially in the Ocala National Forrest. The public BLM no not black lives matter- The Bureau of Land Management allows mining on areas of BLM managed land. You may under allowed regulations construct ore extraction stamp or other ore extraction methods. Build structures for a mining camp. However the BLM has the authority to demand structures to be torn down and removed to prevent the mining operation from attempting a permanent land claim. Also before and during the Pandemic there were National news and KZitem videos about people having their homes legally stolen by using some State Laws on a abandoned house claim. Usually after a homeowner leaves the home unoccupied for weeks in some states to months in other states. Its a form of organized crime. Usually a Realitor or Land Developer. Or other entity has hospital staff whether it be house keeping nursing staff or some other hospital worker. Hey realtor buddy, there's a patient here, going be here for at least 2 to 3 months. I get my usual finders fee? Cool. Here's the address. IF the property is paid off. A abandoned home claim is filed. A notice in the local newspaper is posted if there is no response in some cases as little as 11 day's in some jurisdictions the abandoned home claim is awarded to the claimant tittle deed and all. The locks changed the former property owner possessions are claimed to be discarded into the trash dumpster or burn pile. Note in Missippi when someone is evicted the tennants or former homeowner possessions must be set on the curb or if in a apartment complex, placed in the parking space. Should the management or matience removing the apartment belongings. THEY CANNOT TAKE ANYTHING AS A POSSESSION!😮😢. IF the former occupant observes their possessions. Taken by management or matience. They can be arrested for theft. Management cannot hold possessions for any reason including for owed rent. However Louisiana allows seizures of tenants properties for owed rent including the evicted tenants automobile, boat motorcycle- etc. The owner or management appears in court after a notice of eviction court summons. The owner or management asks the court for a writ of Seizure. Now if a evicted tenant appears in court they can ask the Judge for their Legal paperwork-clothing,baby and childrens clothing,bed blankets playpen,crib, carseat,cooking pots,pans, cookwear, dishes and silverware any medication. in the former dwelling..The Judge will allow necessary clothing kitchen essentials, childrens bedding walker, etc . MEDICATION and medical supplies, tradesman tools. If the former tennant asks to retrieve home essentials and if they can provide evidence that their computer is how they make a living, the Judge may allow the computer to be retrieved. If the former tenant doesn't appear for the summons they loose everything. The owner is allowed to sell or hold the home contents untill the rent owed cost of court and any incurred expenses are paid. Or the house contents may be sold. I once took a course covering Real Estate Law for Mississippi, Louisiana, and Texas, I was going for a Realitors & Realitor Broker License. I found Realestate Law quite fascinating Texas has some off the chain laws 😮. A sweet Red head green eyed gal and I decieded to Hop the rails for Portland. Spent the Fall Winter and Early Spring there having a great time and then we and some other of our friends decided to prospect for gold.😊 That's another tale.😮

Before taking on a new client, a competent Realtor makes sure their potential new client actually owns the property. It took multiple instances where a faux landlord was trying to lease out several townhomes for a year, at a 35% discount over the regular monthly rental value, before the LAPD got off their a$$e$. The faux landlord had a Realtor friend acting as the "property manager." The Realtor friend had to pony up at least one civil settlement. She either knew he was a faux landlord, or didn't bother to check actual ownership. The faux landlord was able to get the keys to the property because he'd earlier done some mortgage razz-ma-tazz to save the properties from foreclosure, and was briefly on title. In Steve's case here, it'd be interesting to know if the seller's Realtor faced any criminal, administrative, or civil ramifications.

One thing to think is I inherited my father's stuff that didn't go to the dumpster by my younger brother. In that 'stuff' was a Notary seal. What I did was to destroy the seal by cutting a slot across the metal sealing device.

Here in North Carolina (and I’d imagine most jurisdictions), notary seals and journals of notarial acts found as part of a decedent’s estate are to be returned to the Sec of State or whoever commissions notaries for destruction (among other things, it lets the Secretary know the commission is no longer valid). Most executors don’t know this unless the deceased notary thought to tell them what to do with their seals/journals/records.

Annually - I receive from our local county a listing and valuation of all the real property I own from the county appraiser (so they can bill me for the taxes of course). If that document did not have my 10 acre vacant lot listed, I'd be in the appraiser and county clerk's office the next day asking. BTW - about once a month I receive letters from "speculators" making offers for that 10 acre property. They send a purchase agreement for me to sign with a promise to send me the check promptly. Yeah right....

Somebody else got scammed, but not the owner. Owner should take possession immediately and let the actual scammed party be the one to "straighten it out." WTF are they using a broker for something you should do in person?

The bank got $9K from the fraudulent party to clear the lien. Then they told the owner sorry we don't feel it's right you get a windfall. So they said he had to pay the $9k. Help me out, upon undoing, where did the original $9k go? Cuz if the bank kept it, plus made him pay another, he should file a complaint. Especially considering these bank dopes were part of the bad transaction.

I was traveling and needed to do my laundry. Went into a bank for some change. Teller made me fill out a form, started typing away on her computer and after waiting for what seemed like forever I said forget it. In and out of 7 11 in no time flat with 3.oo in quarters.

Notary stamps are easy to fake. I have seen them for sale at estate sales plus a talented person can print one.(some states allow printed stamps, some require embossed). It’s sad that we are basing trust on people that charge $3 to stamp something. How easy would it be to bribe a notary?

The whole notary process is effectively useless at this point. Some years ago there was a lawyer in Florida peddling an illegal way to mandate HOAs where they werent already. Essentially, most people didnt realize you need more than a simple majority, and even fewer know a property has C & Rs. To accomplish this, at least one neighborhood org would pressure people to sign votes, then brpught them back to their office and had a notary rubberstamp them all at once (had to be notarized in presence of signatory). Issues abounded, but one was how the law considers that stupid notary stamp foolproof.

I believe the buyer’s real estate lawyer and title company are the parties that are responsible for the process. They should be on the hook for all the expenses to both parties.

I have a kind of similar problem. There's a strip of land between my neighbor's and my property that, according to the city's own map, belongs to both he and I. It's only about 8' but, it appears the same 150'X8' strip of land was sold twice. This can't be legal, can it?

When they were un-doing the the whole thing, the bank complains about him getting a windfall? Then the bank says that he has to pay off the loan that was already paid off. Doesn't it seem wrong that the bank gets paid twice? It is no wonder that banks' customer satisfaction is right around trhe same level as cable companies.
