Unfortunately Karma is the only thing you an rely on here. It's a sad situation. People who smoke will find money to buy smokes !!! it's like drugs, but they actually never have any change on them. Same kind of deal for their phones. They just don't have any liquid money because it burns holes in their pockets 10 USD at a time. The fact that they went for "meals" at their friends place and never left until they got dinner ........ I feel sorry for this woman who tried to help them out.

I'm inclined to believe her side of the story, specifically as a single mother myself. However, how or why on earth ppl. That's a tough lesson for the plaintiff but on the other hand the defendants should try to make payments if they're decent people. He got paid for the work and got this money on top of that. Bottom line; get a signed promissory note that states "loan" somewhere in the document and keep records of any ongoing communications. I've been burned by two previous roommates who lived with me for a period of time and neither one of them were consistent with paying their share of the rent. I trusted them both and didn't have them sign a rental agreement with me. As a result I will never have another roommate again. It's just not worth the hassle.

This was definitely a loan. Judge Judy would’ve made this a 5 minute case. She would’ve asked 2 questions to the defendants before ruling against them. 1. How did the plaintiff know the exact amount you needed to pay your bills? 2. Can you tell me how the conversation went when you first told the plaintiff about this settlement? She would’ve had the defendants double talking. Contradicting their own statements and looking dumb in the courtroom before ordering them to pay the loan back.

What awful people, I feel so horrible for the plaintiff. I can see myself doing what she did and I could not stomach someone I love and trust and called a friend being so smug to my face about a promise that was made. She fed you and your family, kept a roof over your head, and gave your husband work. If this is how you repay kindness, I’d be scared to see what karma you’d be attracting down the line.

@@jonathanmoore8886 not always. Depends on the parties in the lawsuit. Most frivolous ones that the most time. More often than not bigger ones settle out of court for an undisclosed amount. This also allows them to be done without publicly taking responsibility

It was mentioned that he did get a big settlement from the law suit. The woman announced it to the plaintiff and the plaintiff asked for the money after he got his settlement. The woman was even telling the plaintiff to ask her husband for the money after he got his settlement.

These are the kinds of cases that really teach you so much about how important documenting is. I do say that I never give anything expecting it back. And I've been a fool most times by helping a person out more than once, but I've had to learn to say no. It's never just the money it's more the fact that people just take without making a single effort to repay. She's a good lady and good karma always repays back one way or another. She needs to make peace and move on and stay away from those people. At the end of the end the day its just money. Keep your peace and learn to say no. Judge Milian was very kind to the plaintiff by trying every which way to see how this lady could show her any proof. I mean she asked so many times for something, ANYTHING, a slip of mouth--something to help this lady get her money back. Kudos to the judge's kindness on this one.

I think that in her heart of hearts the judge knew it was a loan, but there simply wasn't enough evidence even for a preponderance of the evidence. Shame, since the plaintiff seems like a good person who got burned by a couple of slimeballs.

Agreed. The plaintiff was even vague as she described the circumstances. Easiest thing to do is write "loan" in the memo line on the check. Done. Lol-- oops, that was just the advice given.

the fact that he claims he went back to "return the check" as though he couldn't just tear up the check or keep the check without cashing it is evidence that the defendants are making all of this up. There's no reason to go to someone's house to "return a check.' That's such a bad lie. LOL

I love how what courtrooms really boil down to is exposure of the fact there is always one person who is either lying completely or who is lying more than the other liar. You look at these people while knowing at least one of them is dishonest.

Marilyn Millian was right. The Defendants are the worst kind of people in the world. Vampires. They suck the life out of a person and leave them bleeding from the heart and soul. So true, I have gifted people money at times, not often, but I don't want to chase someone for money. The people I did gift money to really needed it. Sometimes, I will help by driving someone in need to the Dr. or the grocery store. Even bringing dinner over for someone. I'm no saint, but this way, there's no hard feelings.

I think it is really cool when a friend in need remembers "loans", if or when someone can't pay me back I just write it off. I think that most of us have hit a rough spot and try to pay it forward. I try to avoid becoming an ATM however.

That’s what sucks is that a lot of us have been there where we can’t make ends meet. Decent people would be trying to find a way to make money to support family, not sitting on their asses fishing all the time. I remember Christmas’s where my husband and I both did seasonal jobs on top of our other jobs that weren’t giving the hours. We want to pay it forward as much as we can now. I’m a huge tipper in everything, it makes me feel good to over tip hard working young people.

Even if someone changed their mind about a ''gift'' and needed the money back, give it to them. Plaintive fed them about 5-7 times a week, defendants would go to her house straight from work and not leave until 9 p m, only when it was time to put their son to bed. I totally believe her.

My mother once loaned someone a bunch of money before she married my dad. When she lived in Taiwan, she had a friend who asked her if he borrow $10,000 for his upcoming wedding. She did so out of the kindness of her heart, but he had to promise her that he would pay her back. Nothing was laid out in writing at the time. Several months after the wedding, he ghosted her and my mother made several attempts to contact him about paying her back, but he never did. And so, to this very day, my mother vowed that she would never loan anyone any money whatsoever unless it is all in writing.

The husband is the reason that their in this situation if he would just get a job and keep a job I understand he has a lawsuit going I don't know what the lawsuit entitles even if for some reason I believe that it was a gift when in your times of need you and your child could have been homeless this woman gives you money to keep a roof over you and your child's head give the lady the money back even if you don't have a heart even if it was a gift this woman feels unappreciated because you now won a lawsuit and didn't offer her a penny understanding that you need a roof over your head but you don't even take her to dinner instead you get yourself a Playboy stud earring one day you're going to need someone again

Lesson 1: If you are going to anyway, WRITE A PROMISSORY NOTE. If the people taking the money are not honest, they won't sign note or if they don't pay it back promissory note would hold up in court for them to pay it back.

I know!!! And then to have the nerve to say that work was how they paid the plaintiff back, implying his work was worth even more than what she paid. Plus, it sounds like she still had to buy the materials-that was just labor! I know in other cases Judge Millian questions contractors based on her own family’s background. I was really hoping she would make him explain what all he did for that outrageous amount!

What gives me peace is knowing that people always reap what they sow. In this case, the plaintiff is lucky in that she lost “friends” that are about as useful as tits on a bull. The defendants may think they won, but sadly, all they did was demonstrate the type of people they really are.

Don't loan money to friends when you KNOW they can't afford to pay you back. The defendants were broke, out of a job, closed bank account, it was wishful thinking. Might as will give out of your good heart and not expect anything in return
