When it came to the movie “when they see us” the actors and producers worked closely with the victims for accurate accounts of the events, even though their story was already public, they were carried along with the making of the movie, even the press conference, premier, awards on the movie. I feel pity for this lady and if what she is saying is true this, I hope they do right by her and I wish that she eventually finds closure.

He went to his hometown in Carolina, visited his place in ATL etc. He's daughter held a service for him when he passed away. That's respect and love. Well its 9ja anything goes. They also claimed production started in 2018 but only contacted Tobore in 2019, O wrong nau! She has to get compensated and be paid for damages. I can't express enough my pity and concern to this brave lady. On a good day, MoAbudu should be compensating this lady, big time! Then, in a law court, facts are discussed. First, MoAbudu claims she bought the story. The fact that MoAbudu contacted this lady prior and during the making of the movie shows that Mo isn't telling the entire truth, cos you couldn't have bought the original story and still went to the rightful owner of the story... It doesn't add up. Mo must have got extra information from this lady, and very painful enough -- claims the story was bought. That lie can't be bought by any sensible Judge. But having said that, Mo has chats with the lady, which somewhat shows there was cozy relationship up until the release of the movie on Netflix. This is where the court would side Mo. For the lady to demand compensation shows that something somehow went wrong in her relationship with Mo. I hope she gets a good lawyer to fight for her. Cos the rich can be very very greedy.

I read the article on her ordeal in 2013 on premium Times if I remember correctly. When I watched Oloture I knew it was her story but I thought she must have given the story to Ebony life and was part of the movie herself. Am surprised to hear she wasn't credited, thats sad. Cos I remember this story, the difference between the movie and her story is that in the article she escaped at the border but in the movie she was caught trying to escape. Even the killings of the girl by the madam at the pool side was described in the article. Am very surprised at Ebony life but will like to hear their side of the story
@HumongousMan

She and Premium Times were credited on the film. What is an issue is monetary compensation to her. However, according EbonyLife, the monetary compensation part could have happened if the film had gone to theaters but this couldn't happen because the film went straight to Netflix. This is what i think should have happened: 1. Her contract with them should have covered all grounds. 2. She should have contacted Netflix with concrete evidence instead of demeaning the company in this interview.

Ebony's comment you will find on Mo Abudu's instagram handle. It's sad really, but in winning this case, I hope she has evidences or like contract copies, in order to back up this emotional side. Otherwise, Ebony will continue with the claim that there are similar stories as this and not hers completely. Like for me, I keep thinking was there a time she sat down to tell them the story and was recorded by all the film makers. Like you know how oyibos do it na. I don't know much, I have just been thinking how she can pursue it legally, asides the interviews. But in all , I pray that justice happens and the rights of all in this is duly compensated.

This is like a story of her life that is nothing so close to a normal story but a serious criminal activities that involves homicide, exploitation, human trafficking, sex trafficking just name all that does exist in the underground world. What I am still baffled about is when investigative journalists are working on a top notch dangerous topic like this, do they work all alone or in conjunction with the security apparatus of the State or to what principal achievement that could make people to embark on such project, I don't want to believe it was for movie making or to benefit from the lucrative aspect of the story that is by the way because with the engagement of the security apparatus she already got all the coverage of the authenticity of her story covered that could implicate anyone that breach that rights of the intellectual property that she owned exclusively. Secondly how did the story slipped into the hand of the producer, was it duplicated from any journals or how?! coz I didn't get that part. Lastly in the real sense of the matter, why do we have these devilish, satanic, reckless inhumane people that have no respect for human lives in our society?! This is a serious problem we are dealing with in this society and it seems we are only interested in the money making of every aspects of our lives, even if it is to kill for a meager of bread there are people that are willing and on standby for it. What is wrong with us, this could happen to anyone of us but we always take everything so lightly. So seriously I am more scared of my fellow compatriots than the government we all intend to attack all the time and accused of wrongdoing. We have a long way to go in #Nigeria like so seriously.🤔🙄😱😭😭😭😭

The article she wrote about her experience entitles her to copyrights and moral rights. Someone may dispute this fact and say: "1) she transferred her copyright to her employer 2) moral rights do not exist in Nigerian law." Yes in case she has transferred the copyright to her employer, she cannot claim compensation nor royalties on this basis. However, she has grounds to invoke the violation of her moral rights which are: her right to disclose the story, her right of attribution (right to be duly given credit), the right to the integrity of her work. Such rights are found in civil law countries. Yes it may sound like I am speaking Chinese to some Nigerian lawyers. But I am pretty sure Nigeria has ratified the Berne convention which enshrines moral rights. Finally, she can argue the (psychological) injury suffered, resulting from the release of her traumatic story without her consent. So this woman may have a very strong case. PS: Moral rights are not transferable and any contractual clause stating the opposite shall be null and void.

So sad, you can tell she still needs a lot of help and therapy. She definitely needs compensation.....I understand it was her job but sometimes no job is worth your real life and lively hood, her being one person could never stop corruption and trafficking, if she had died it would have been for nothing.

No. You missed it. It was not just a job to her. It was a calling. Even if she didn't get salary for it. She would still pursue it. Your calling is always bigger than you. If it means taking your life, like the passion of Christ, so be it. So its well and far beyond a job for her. Am married to an investigative journalist myself and I feel everything she said. That drive in them is not what money or any material thing can satisfy.

I've seen a couple of statements claiming that since her employer owns the copyright, she has no grounds to pursue EL. I'll just copy paste my reply to one of those comments because I strongly disagree. In my humble opinion of course. "Copyright - in common law (author's right in civil law) is extremely different from the other IP protections e.g. patent. It's understood in our milieu that an author's right is so attached to the person's creative spirit (oeuvre d'esprit - you can google this for a start) that it can't be treated in the same way as a design or technical invention for instance. Creating music, writing a book, writing code (for a software) are so inherently part of the author's identity, mind and soul that legislators had to distinguish for this particular IP protection, 2 types of rights: moral rights & patrimonial rights. The latter is transferable and the former is not. That's the argument. When an author transfers their rights to their employer or an agency, publisher etc. they are transferring their patrimonial rights, which then enables the agency, employer etc. to translate, market, sell, basically bring in the cash and get their share. However, for the reasons explained above regarding l'oeuvre d'esprit, an author cannot transfer their moral rights. Even if they signed a contract saying so, the judge will most likely see the pertinent clause as void. That's how much the author's "spirit" is protected. Now, to go deeper, this is more prominent in civil law countries than in common law countries like Nigeria. But, since Nigeria has signed and ratified the Berne convention (containing very strict provisions on oeuvre d'esprit), Nigerian law has to comply. So, if we really want to be honest and speak from a legal standpoint, the journalist pretty much has every right to demand monetary compensation, not for the patrimonial rights she transferred but for her moral rights that were so unfairly overlooked."

Exactement! Les droits moraux (droit à la paternité de l'oeuvre dans ce cas) sont inaliénables, imprescriptibles et perpétuels. Et elle peut invoquer le préjudice causé par la violation de ce droit moral pour demander réparation. But if I am not mistaken, I noticed that she was given tribute at the end of the movie and this can translate to her right of attribution (droit à la paternité de l'oeuvre) being complied with to a certain extent.

@@jenniferd.7646 Oui, c'est bien ça. I think it depends on how you look at it - it' s a glass half full or half empty kinda thing.

And since Nigeria has ratified the Berne convention which recognizes the author's moral rights (as opposed to copyrights only known to Nigerian domestic law), she has a case!
