This is utterly absurd. There appears to be a wilful undermining of the intention of the legislation. Who were the “experts” the police consulted? It’s good the AFP have a good relationship with them, but the purpose of the legislation is paramount, and should not be undermined by public servants. Thanks James for your attention to this.

There was supposed to be a one year mandatory sentence set by parliament but there was something in the over-riding legislation that gave the Judge power to ignore it - and he did and then there was a subsequent visa breach. That judge needs to go back to jidge school.

Thank you senator Paterson for doing your job. The obstruction by highly paid, over- rated public servants whom you've previously questioned has been nauseating. Also that of the ALP. As I heard Mike Jefferies say on 2GB not long ago, such ambitious people "fight like weasels on meth" to advance above others up the public service greasy pole, then do SFA once there.

The State in which the Commonwealth matter is heard has no jurisdiction. The State Court should be closed then reopened as a Commonwealth or Federal Court and it deals with that legislation. Indeed, the very reason for closing then reopening is to avoid this multiple agency conglomeration

Its a tough one. On the other hand, 75% have not reoffended and are now more likely to add to society through tax rather than such a drain through incarceration. Our criminal system will process the reoffenders, hopefully severely. These members of the police force are not to blame and a credit to our society. And so is Senator James Paterson. Unfortunately there have been victims who I hope are at least compensated throughout this mess, which Senator Paterson is right to look to the opposing Minister for at the very least, education, support and training, and if necessary, the opposing Minister's job if negligence persists.
