I think Roux may have lost the plot somewhat. These witnesses consistently consulted their partners, received a response and gave thought to different scenarios. On the other hand Oscar did not consult his partner, he issued instructions to her but did not wait for a response before proceeded to shoot up the toilet door. We've now found out that there was a 3rd person in the property whom he gave no consideration to before he decided on his lethal course of action. Don't think he's helping his client with his quantity over quality approach to witnesses.

Note that Roux did not ask a man to replicate the crying sound. He could've asked Mr. Nhlengethwa to attempt to recreate it. Far more striking (and obviously high-pitched) to hear it from both women. After all, it's hard for a man to 'scream' isn't it. Everyone testifies that it was definitely a man crying - wailing would seem to be the verb they're all groping for - so there's no confusion as to gender. Roux seems to realise the only way to make a male wail sound like a scream is to ask a woman to recreate it. Pretty cunning.
@islaarundel3741

I suppose Roux's main job is to highlight uncertainty. Accentuate any confusion. I do think he's set out from the wrong position, though, and he's badly advised Pistorius. Putting a tertiary-educated twit on the stand as an 'expert' does ask serious questions about Roux's overall judgement. Hindsight's easy, I guess. But surely Roux should've realised the best prospect the prosecution had of a conviction (and still do) was culpable homicide. The case for pre-meditation was always riddled with uncertainties and tenuous assumptions and hearsay. It seems now (given Nel's short, sharp cross-examination of witnesses mostly centering on their interpretation of 'accident' or 'mistake' etc.) that the prosecution is content to put pre-med on the back burner and simply hammer home the point that Pistorius clearly meant to kill someone, regardless of whom he thought may or may not have been behind the toilet door. And that's fair, I suppose, because it's all that can be definitively proved. And it's enough to prove that. He fired when he didn't need to, he acted rashly and unreasonably, and he's criminally responsible for that. The only question left is how the judge decides to treat him. And that's anyone's guess...

Isla Arundel Ha! The now distant memory of Dixon... Did you see Time Magazine article: "Pistorius hires Dream Team." It then launches into a paragraph or two about Roger. lol. Guess it's true you shouldn't believe everything you read. His ACTUAL expertise as opposed to any of the things he talked about is fingerprint detection on metal surfaces such as coins, locks, or guns. More useful in a heist. Perhaps they hired him to detect Henke Pistorius' fingerprints on Oscar's ammunition stash since Oscar told them the prints would be there (by a miracle of some kind) but then they failed to find any...it's a real possibility. Re. thoughts on fair outcome. Deffo agree. Although there are 3 possible outcomes: culpable homicide (fine to 15 yr), murder (15 yr to life), premed murder (25 yr to life). * min to max sentence. And I really feel this case is almost immovably settled on the "2nd degree" murder conviction now. Because it can't really go higher (without controversy). There is an intention lasting much longer than a moment, but no evidence of planning before picking up the weapon. And he wouldn't have done it if he had reflected carefully. Unless he's 10 times crazier than he's letting on (...which is already fairly crazy to be fair...). So it's not a long sequential plan. But it can't really go lower (without controversy). Four bullets is a lot of lethal force, even for the intruder story. That's the best case Roux's got left. But the intruder story requires way too generous of a reading. Without the intruder, it is clearly a more than averagely brutal killing of a girl. Whether he realised it or not (due to the door) that is what it is. But then again it might go up or down just because the world is like that sometimes. For every Dixon testifying ineptly, there is a judge ruling erratically I guess...
@carolynnichols928

Nick Bauer That would be true if every man spoke in the same tone, and likewise, every woman. But everyone's voice is different. Anyone who watches Coronation Street knows the deepest voice on the show is Deirdre's. lol And one of the highest could be Tyrone's. Oscar's voice is very monotone, and in a mid to slightly higher range, for a man. I think it was pointless having the women try and demonstrate what they heard. You can't just sit there and replicate what someone sounded like in a highly charged situation, on demand.

***** That's a pretty spot on synopsis of the options. (Blimey, that's a lot of op sounds, isn't it. I have OP on the brain.) Surely the judge has to take into account the rather exceptional circumstances. You know I'm not excusing him on any level, but the evidence seems uncontested that he was on his stumps. I think of all OP's testimony, what struck me most, what really jolted me, was his description of scrambling about to find the gun, using his hands and stumps to walk on. That's a vivid image, isn't it? Floundering around like some panicked animal. And, yes, we're not talking any average man here, he's an Olympic athlete who's competed against able-bodied stars, but still, without his blades I have no idea how he feels. As much as I abhor what he's done, and his fascination for guns and obscene ammunition, I'm willing to accept he feels very vulnerable when he takes off his prostheses. And I've a feeling that'll be the 'exceptional' circumstance that the judge invokes to carry the verdict into culpable homicide territory. If he'd been advised properly, he may even have avoided jail altogether. A long shot, but if they'd admitted the gun charges and he'd got up on the stand and told the unvarnished truth, not inserting very obvious lies about speaking to Reeva when he woke, in an attempt to shore up the notion that he knew or cared precisely where she was, or telling half-baked stories about violent pursuits on the freeway... well, truth and genuine contrition would've gone a long way, I think. But it'll be the arrogance and complete inability to take any responsibility for anything that costs him in the end. I don't think he can avoid a custodial sentence now, can he? I don't know if the judge will give him the full 15 years - totally guessing here, but she may try to come down in some impossible Solomon-style middle ground and opt for 8 years. Just a hunch and probably way wide of the mark. Then Roux will get another good few pay days exhausting the appeals process, I guess.

Under cross examination Motshwane confirmed that she had not heard any gunshots. Rather odd then that the first suggestion to her husband was "it could be that maybe one of the security guards has been shot" Another & even more immense oddity to me is that although not naming his housekeeper, Frank Chiziweni was yesterday referred to as such & the only time that I recall Oscar making reference to him, was in regard to the usual position of the magazine rack. In Oscars precise testimony as to the sequence of events before & after he had shot Reeva, he had declared that he & Reeva were the only two persons in the house & made absolutely no mention whatsoever of going to wake Frank, nor was there any mention of Frank waking & coming to see what had occurred. Frank apparently saw & heard nothing, yet clearly for some reason he woke, vacated his quarters next to the kitchen on the ground floor of Oscars home and went outside before Reeva was carried downstairs, as witnessed by those who first arrived on the scene & saw Frank standing outside with the security guard.

This case will be decided based on the phone records of the various witnesses and the timeline. If you want to understand this case you need to understand the timeline. There were two sets of "shots", one at around 3:12 and another at 3:17. The defense says that the 3:12 shots were the shots that killed Riva, and the 3:17 "shots" were the cricket bat. The prosecutor says the 3:17 "shots" were the shots that killed Riva. However the prosecution's timeline does not stack up as I explain in my previous post.
@shnaz6665

The prosecution has not yet explained what the 3:12 gunshots sounds were, but they ruled out the possibility of it being gunshots. Perhaps they will argue it was the cricket bat. But that doesn’t work because both the prosecution and defence ballistic experts’ testified that the gunshots happened BEFORE the cricket bat, based on the crack that goes through one of the bullet holes. So it still is unclear how the prosecution is going to explain the 3:12 shots which multiple witness identified as gunshots. I think they will struggle to explain it.

OSCAR TELLS THE TRUTH What you are about to read has been extracted from Nells cross examination of Oscar on April 15 session 1 20mins in Nell was encouraging Oscar to tell in his own words what happened that night. So to make it a little more readable I have taken out all of Nell which consists mainly of “ and then what happened ?” and joined up Oscars answers in the order he gave them to give a flowing account. If you listen to his dialogue there is very little mention of Oscars “intruder “ apart from when Nell baits him about the screaming. I have also added in bits of Burger, Johnson, Stipp and Estelle van de Merwe and some sensible links from me to join it up If Oscar ever tells the truth his confession should be fairly close to what he said We have to assume that a big argument happened and that it ended badly and she had decided to leave. That being so, Reeva’s status changed very quickly in Oscars mind from Girlfriend to Nothing to Enemy = Intruder. Oscar wanted her out of his house. I know some of you have brainwashed yourselves into believing that there was an intruder but he doesn’t exist does he so if you view it from a slightly different perspective and think that everything he does and says to the intruder is actually what he does and says to Reeva then everything falls neatly into place Make up your own mind if my input deserves to be in or not Oscars confession We had a great big argument that night and it ended very badly Reeva decided she wanted to leave and went to the toilet. I was so angry I wanted to kill her . While I was sitting on the bed thinking I heard the toilet flush and then lost my temper completely. I leapt off the bed and ran screaming down the corridor towards the bathroom shouting at her to get out of my house. I heard the door slam and knew she was in the toilet. I tried to open the door but it was locked so I tried to run into it with my shoulder - nothing happened. I was screaming at her to get out. I ran back to my bedroom went over the bed and put my legs on , picked up my gun and ran back to the bathroom. I grabbed the door handle and tried to shoulder charge the door and nothing happened. I leant back and stood away and tried to kick the door in . I realized that I wasn’t going to get access, I was desperate to get in so I ran to get the cricket bat, nothing was going to stop me. I ran back to the bathroom still screaming, I put the gun on the carpet and tried to strike the door. I hit the frame with all my might and felt the shock in my hands. Reeva screamed in terror . I hit the door three times. The next time I tried I aimed a little to the left so as not to hit Reeva. I hit the plank and the door split. With the next strike a small bit of wood broke off ,Reeva screamed for help, I was enjoying myself. I felt exited and screamed Help, Help, Help out of the window . I peered into the toilet and saw Reeva , she pushed the wood back to stop me getting in. I screamed through the door and told her to get on the floor and phone the police. She knew what was coming and screamed intensely she was very scared. I took a step back took aim and fired four shots at the door. I didn’t hear her fall or scream my ears were ringing after the shots. I walked back to the bedroom to get my phone then opened the curtains and balcony doors to get some fresh air. It then dawned on me that I might have shot Reeva, In panic I ran back to the bathroom and ripped the door plank off and looked in . Reeva was slumped over the toilet bowl, blood was everywhere , I was horrified at what I had done, I screamed Reeva, Reeva, I couldn’t stop crying and had to get help for her, she was still breathing . I phoned my friend Johan Stander then desperately tried to get her into the bathroom I managed to pick her up and carried her downstairs and waited for help to arrive. If only she had listened to me and got on the floor I’m so sorry I took her life I believe you Oscar !!

Yeah actually think the bats wasn't countable as some of them were crunching in door panels, so kind of a continuous cracking sound? Maybe that is why Dr. stipp says 2-3, Annett says 3, Michelle Berger says 4, Mr. Johnson says 4-6. This other lady says 1. Everyone try to put a number on it but the last bangs would be not so sharp if the door is also splintering...

AJ Bec Sorry!! says she 'heard' 1. You're quite right the the previous might have been what stirred her. I wasn't being careful there cos my point was how the numbers of bangs are very variable at around 3:14. In contrast to 'just after 3' when the stipps wake THEN hear 3 (same kinda thing you mention, that could be 4 in total), and Mrs Van der Merwe who is already awake hears 4 just after 3am. So there's actually - potentially - a complete agreement of witnesses for the num. bangs in first set = num. gunshots. it's very tempting for me to conclude they were the 4 gunshots tbh. lol

Nel should call him,but not fight him just let him say "Ididn't see or hear anything" Nel says thank u and let him go.

Obviously those neighbours that are closest to OP agreed to not hear the gunshots and disturbances. Not to hear gunshots and bats at such close quarters was incredible. They all said they only heard OP crying and wailing. Only 1 out of 5 heard only 1 bang! In practice it can't be true because there were quarrelling and loud noises hour before the fatal shootings and blood curdling screams. No wonder Nel had so few questions to ask. He has done his job and it is up to the Court. It is natural to want to help a neighbour you knew since 2008/9. The Arabs had a better solution I think to prevent all these charades and lies. OP's family is rich and should just pay 'blood money', apologise and move on. Whether OP goes to jail or not, will not matter much to the aggrieved parties as Reeva will not come back again.

@ValdemarGonzalez
10 жыл бұрын
Mr. White: Officers did NOT 'contaminate' the scene. Pistol-orius did HIMSELF by staging things, moving things, washing his hands, waiting to call the police - and then when he went back upstairs to "get" Reeva's identification - he tossed his watches in Reeva's purse, carried it downstairs - and then instructed HIS SISTER to leave the scene WITH Reeva's purse - which SHE DID. Alleging that police tampered with the scene is just a rift which goes hand in hand with his "I thought it was an intruder story" as he is saying anything and doing EVERYthing that he can to save his little white *ss from going to the slammer. But, alas, anyone with an IQ can see RIGHT through his little charade.....

All witness statements say they heard crying. But no gun shots hmmm would have thought gun shots would have awoken you up rather than crying. Prosecution certainly picked up on it. Very flawed witness statements.

Tina Johnson She said she heard one bang, and calls for help, then crying shortly after. No more bangs. Other witnesses testified that the calls for help were between two sets of bangs, and Pistorius himself testified to this, too. These witnesses do not help him, at all... in fact they contradict him slightly. That seems to be a pattern in defence witnesses. Dixon contradicted him, too.

I don't think the defense expected OP to be on the stand for five days. They certainly weren't prepared for the timing of the state's resting their case on a Tuesday, when they said they needed a couple of days to speak to witnesses not called by the state. There was also the lost week when the female assessor was sick. Perhaps the judge was going to retire and do some traveling after her verdict and the delays are cutting into that effort.

It’s all fine to declare OP guilty without analysing the facts and the timeline. However if you analyse the timeline based on the phone records the only version that makes sense is OPs version. The prosecution says the shots that killed Riva were fired at 3:17. Prior to that were the screams were of a woman. They also say he was not wearing his legs when the shots were fired (at the bail hearing they insisted he was wearing his legs at the time based on the ballistics!!). Next they say OP knocked down the door also without his legs. (!) (OP can barely balance without his legs. He needs some support. But he somehow broke a door down with a cricket bat in only two blows, without wearing his prosthetics? Even a strong non disabled person would struggle to break down a door in only 2 blows. OP claims it took 3 blows, and was wearing his legs. The prosecution ignored onr of the cricket bat marks. Why?) Then we know OP called Mr Stander at 3:19 and at 3:20 and 3:21 he made further phone calls, to the ambulance and to security. Then at about 3:21-3:22 the Standers arrived at OP house and saw OP carry Riva down the stairs - 3 minutes after 3:19 which is at 3:21-3:22. 1) So at what time, according to the prosecutor, did OP break the door? 2) What time did OP put on his prosthetics? So according to the prosecutor version there was only 2 minutes from 3:17 to 3:19, that OP managed to 1) break down the door (without a single witness reporting hearing the sounds of a cricket bat smashing the door down within 2 minutes of 3:17), and 2) put on his legs. For these two actions to have occurred within 2 minutes is almost impossible, seeing it takes at least 30-40 seconds to put on his legs. After breaking the door, why would he then rush to put his legs before making the phone calls? The prosecutions version that the shots that killed Riva were at 3:17 is extremely improbable. The only version that fits in with all the facts and timeline, is 3:17 was the cricket bat, prior to that were the screams and the first set of shots (testified by the Stripps and Mrs Nhlengethwas) at about 3:12 were the shots that killed Riva. The person screaming was OP. This is confirmed by the timeline and phone records Nhlengethwas who called security at 3:16. So the bang and screaming she heard happened BEFORE the 3:17 bangs. This is the only version that explains the timeline of events. In addition we know that the cries / screams the Nhlengethwas heard were the same cries that the Strips heard becasuse the phone record shows that they both clled at 3:16. So we know that what the Strips heard as a woman screaming, The Nhlengethwas who lived closer said it was a man crying / wailing. So far all the evidence supports OP's version and timeline.

Well spotted on this two minute segment, But it is the defense version not the prosecution. I saw it as well and did an in depth study of it. The defense strategy is that the whole event took only 5 minutes according to phone records from 3.12am to 3.17am this agrees with the Prosecution version Roux is trying to argue that he shot her first and then tried to rescue her . In other words Gun first followed by bat The Prosecution argue that it was a prolonged attack from 3am to 3.17 Bat followed by Gun Roux has disappeared 12 minutes Time evaluation after shooting Johnson Phone call - at 3.17 am . Shots heard shortly after Oscar phones a friend at 3.19 am Event ends Oscar from his testimony gave this list of activities in a time span of 2 minutes Kept shouting for R to phone police Stood there don’t know how long shouting for R Walked back to bedroom onto bed feeling for her Jumped off bed and felt curtains Went cautiously back to toilet Tried to open toilet door Ran back to bedroom and opened curtains and balcony doors Screamed help 3 times Put legs on and ran back to bathroom and kicked door Ran back for bat Ran back to bathroom Hit door with bat x 3 Ripped door plank out Leaned over bottom door panel found key and opened door Cried don’t know how long Tried to move her and eventually got her into bathroom Picked her phone up Tried to use her phone blocked by access code Ran back to bedroom for his own phone Ran back to bathroom and phoned friend at 3.19 am Just looking at this segment of Oscars testimony as a whole most of us would dismiss it as impossible to do all this in 2 minutes. Roux has it that the whole event took only 5 minutes. But most of us know that the first reported scream was at 3 am which gives an event time of 19 minutes which the above + everything else would fill if challenged. But the general thread of what Oscar said had to be close to actual events because they have to run parallel with his alibi. He has changed timings and order of events + Roux has put it all in a blender just to confuse the issue If you want to find a clearer time line and chain of events then Nells cross examination of Oscar should give you that It’s a bit like he is playing a tune on the piano and saying to us “ I’m playing all the right notes but not necessarily in the right order “

Rob Fell According to the prosecution: 3:12 Gunshots sounds has not been explained. But they exclude it as being gunshots because they say the only gunshots were the 3:17 bangs. What the 3:12 gunshot sounds were (that woke up at least 4-5 witnesses) have yet to explained. Prosecution: Gunshots at 3:17 Bat hitting door AFTER 3:17 but BEFORE 3:19 (becuase prosecution agrees the bat broke the door AFTER the gunshots). Not a single witness heard these sounds. Why? The first phone call was at 3:19 as I explained above, the prosecution timeline does not work. Defence: Gunshots: 3:12 "Help, help help" ... around 3:14 Cricket bat at 3:17 First phone call: 3:19 second phone call 3:20 third phone call: 3:21 came down stairs with Riva at 3:22/3:23 You say that according to OP the whole event took 5 minutes. That's not true. Only from gunshots, to the breaking of door took 5 minutes. Then till he came downstairs with Riva after 3 phone calls was another 5-6 minutes.

Rob Fell The only witness that states the first gunshots were at about 2:59 was Mrs Stripp. But her memory of the events timeline contradicts all the other witnesses. So I wouldn't count on her testimony. From the phone records of all the witnesses it can be estimated that the first gunshots sounds were at 3:12.

shnaz66 The main thing that convinces me that It was bat first followed by gunshots is the way the screams ended after the forth shot because after that everything went quiet after 3.17 am. If Oscar was attacking her the screams could have continued throughout the night Forgive me if I'm wrong but your first line reads quote--- According to the Prosecution---- when I think it should read--- According to the Defence. That's what prompted me to reply in the first place because all your timings start at 3.12am Its the defence that wants to compress it all into 5 minutes to make Oscar's version look respectable Johnson was on his balcony between 3.02-3.04 am hears a terrified female shouting for help closely followed by a male screaming for help way before the defence time of 3.12 am. You wont find Roux trying to justify anything before 3.12am Getting a time line is very difficult. If you listen closely to Roux 's cross examination of Berger he starts at the first set of screams then jumps to the end set of screams all in one sentence and when Nell tries to clarify it he totally fails to make it clear so all in all trying to join everybody up is a matter of confused common sense . So good luck !

Rob Fell There are many ways to PROVE that the 3:17 sounds were not the 4 gunshots, but must have been cricket bat. 1. Burgers say in their written statement that the screams continued for 1 to 2 seconds after the last "shot". At that time she was in a locked toilet with a closed window. The Burgers were 180 meters away. It is IMPOSSIBLE to hear a lady scream from inside that locked toilet from even 80 meters, nevermind 180 meters. But from the bathroom with an open window facing the Burgers house one CAN hear screams - because it had an open window. So the screams the Burgers heard moments prior to the shots and moments following the shots CANNOT have been Riva in the locked toilet. 2. The testimony of the Nhlengethwas who called security and reported hearing a man wail at 3:16 did not hear any gunshot sounds at 3:17. But they lived only 20 meters away! They lived next door but didn't hear the 3:17 gunshots! This makes sense only if the 3:17 "shots" were not gunshots (very loud)from a cricket bat (not as loud). In fact Mrs Nhlengethwas was woken around 3:12 from the gunshots and heard the last gunshot at 3:12. But she didn't hear the 3;17 gunshots when she was wide awake? There are many other ways to prove that the 3:17 "shots" could NOT have been the gunshots that killed Riva. I'll elaborate later.

***** You're absolutely right, Annie. His actions make no sense at all under ANY circumstances. Let's say, for example, that somebody else shot Reeva, and OP just came into the house and found her in the bathroom all shot up, with a head wound so bad that her brain was exposed. Who on earth would NOT call an ambulance, but instead, leave her body, go downstairs and get plastic bags and towels [and possibly a rope?] and lay them out in anticipation of carrying this body down the steps and laying her down on the precious carpet. It defies common sense. Yes, the 'experts' say that we can be so freaked out when we lose somebody that we do strange things. BUT a human being is not going to do something so unrelated to grief that proves you didn't feel grief at all. In other words, when the experts talk about doing strange things, they are referring to things like holding the body and singing a lullaby, or getting into a rocking chair with it, or trying to comfort it long after the person is dead (like a loved one will keep performing CPR long after the person is 'gone'). Their "strange" behavior is always related to the love they felt for the deceased; and trying to comfort and sooth the deceased...not love for your carpet. A normal man wouldn't give 2 shi*s about the carpet. His behavior AFTER he shot Reeva is enough to convict him in anybody's book. Providing their IQ is above room temperature.

Why does it not surprise me with these witnesses. Weaker witnesses I have never heard..even Mr Nel cannot question them as they did not hear much of anything. Selective hearing. The two houses closes to Oscars home did not even hear 4 of the gunshots prior to the Oscar crying for help? Yes Mr Roux, only you think your plan to get Oscar off is coming together well. Wow, some people really sleep through life altogether, right next to all the action, never heard a gun go off practically in their ears? Only heard poor Oscar crying after all the real noise, "Help!, help!, help!"???! Second witness doesn't know how to explain a bang??! Then the third witness, same? Is this even possible? Surely gunshots is what would wake you first. I feel their statements presented in court were a total waste of time.. WEAK, PATHETIC... OMG! A complete waste of tax payers money!

We now know why they weren't called to testify for the State - they heard nothing that would support Nel's contention of premeditated murder. They also didn't do the defense any justice since they never heard OP screaming and yelling for an intruder to leave his premises prior to the shooting.
