People should be questioning why the DVLA use an automated process to sell your details to these parking scammers. They sell on average 19000 a day and make around 1 million a month in revenue. It validates these crooks and gives them credibility.

No one should be able to access any bodies information without a clear CRIMINAL offence being committed. That being of harm or loss to another human being. Unfortunately a situation has arisen in this country where by as long as some company or other (I include police, councils and courts in this) is making a fortune from the general public then that is O.K.

I did complain to the DVLA regarding data protection , here was my reply The DVLA takes the protection and security of its data very seriously and has procedures in place to ensure data is disclosed only where it is lawful and fair to do so and where the provisions of the Data Protection Law are met. The Agency must strike a balance between ensuring the privacy of motorists is respected while enabling those who may have suffered loss or damage to seek redress. Drivers choosing to park a vehicle on private land do so subject to the terms and conditions set out on signage in the car park. The need to contact individuals who may not have complied with these conditions is, in most circumstances, considered to be a reasonable cause. Data is provided by the DVLA to enable landowners or their agents to pursue their legal rights and to address disputes. I hope you can appreciate that if this were not the case, motorists would be able to park with disregard for the conditions applying with little prospect of being held accountable. While seeking to ensure that vehicle keeper data is released only in appropriate circumstances, it is not a matter for the Agency to decide on the merits of individual cases or to arbitrate in any civil disputes between motorists and private car park enforcement companies. The DVLA cannot regulate any aspect of a company’s business. Any representations should be made to the landowner or his agent. DVLA releases information on the basis that reasonable cause is demonstrated. To help ensure motorists are treated fairly when any private parking charge is pursued the DVLA discloses vehicle keeper information only to companies that are members of an appropriate Accredited Trade Association (ATA). The purpose of requiring a company to be a member of an ATA is to ensure that those who request DVLA information are legitimate companies that operate within a code of practice that promotes fair treatment of the motorist and ensures that there is a clear set of standards for operators. The company in question ParkingEye Ltd are members of the British Parking Association (BPA) which is an ATA for the parking industry. The BPA’s code of practice is published on its website at www.britishparking.co.uk under the heading “Approved Operators Scheme”. If a member of this AOS does not comply with the code of practice, it may be suspended or expelled, during which time no data will be provided to it by the DVLA. If you feel that any of the practices used by the company did not comply with the BPA’s code of practice, you may wish to contact the BPA at Stuart House, 41- 43 Perrymount Road, Haywards Heath, RH16 3BN. They should also receive compensation for the stress and inconvenience put upon them by these parking companies in the wrong. Furthermore, it should not be up to the motorist to prove they were in the right, it is up to the parking companies to ensure they are acting on accurate information in the first place.

POPLAR are not independent. The parking cowboys pay a subscription to the BPA who run POPLAR, so their wages are paid by the parking cowboys. I mean as if anyone would spend 4 1/2 hours in a service station. If they were independent that appeal would have been accepted.

Private parking companies who own hospital car parks are the absolute scum. Imagine making money off people potentially visiting their loved ones for the last time. I got one for my nearby cinema. The company "Forgot" that the cinema is part of the leisure parks car park. Clearly advertised on their sign. They're telling us that we need to read their contracts. Which, by the way, are 10 miles long anyway. Then their staff can't even be bothered to read the signs themselves.

Parking Eye only dropped the first case because the driver told them she had clients willing to testify in court. The question needs to be asked of these parking companies; instead of immediately asking for a massive penalty of £100, ask the driver to pay £2.50 plus maybe a £5 admin fee. Then, if that isn’t paid within 28 days hit them with a £100 penalty. That’s a fair way to operate a car park. Drivers who genuinely forgot to pay or didn’t have the correct change are happy to accept their mistake and pay up. The chancers who have no intention of paying will obviously ignore this and it’s those drivers who can then be punished with a £100 penalty rather than everyone.

They are not "penalties" or "fines" and are not the same as police or court issued fines, although the PPC's like to dress them up as such to intimidate and esstentially blackmail motorists, and to force them to pay. They are parking CHARGE notices or "invoices" for a percieved breach of some made up and often twisted contract. Any PPC has no more authority then the milkman, esstentially ZERO!

The NHS endorses the actions and practices of Parking Eye , Gemini etc etc . Hospital staff receive the same abuse for the privilege of parking at work . They pay for parking . If late for work they're disciplined . If park in wrong p!ace they're fined . NHS is not a good employer .

One question needs to be asked first, do Parking Eye have planning permission to install their ANPR cameras, if they do not then they are being used illegally. Also the same applies to their notices.

Well it's a double edged sword on that one. I had something similar crop up in a case once (for my sins I've worked for and work for parking companies in court), the quite astute defendant noticed that they had nabbed him using ANPR but not put it on their signs that they used ANPR (which they should under the DPA and under their own industry codes). My argument to the District Judge was simply that none of what he said bore on whether or not he had breached the terms and conditions, and that he was essentially asking the court to exclude evidence on the grounds that it had been obtained improperly without having made us aware that this would be a line of defence, thereby ambushing us. In short, that the propriety of the ANPR on the site was a discrete, separate issue and that he was free to pursue a claim for misuse of private information if he wished, but that in the here and now the court should decide the case on the images in front of it. And similarly, in a case where there is no permission from the landowner....well that's for the landowner to sue the parking company over if they want, it shouldn't be a 'get out of jail free' card for defendants. The analogy in the criminal law would be to say, "The police car had a headlight out, my drunk driving charge should be chucked out"..

I have a pretty good idea how such system would be made and its easier to make than you would think. So its either extreme incompetence or its deliberate. Either way they should be forced out of business and perhaps jailed. For the record, i believe its deliberate and it works because a lot of people don't want to go to court and just pay up.

The court summons are fake. Usually no name or real signature is provided on their documenation, nor a genuine court stamp/ seal (usually it's a photcopied 'crown court' logo 😂) no proof of prior contract is provided, nor proof of full disclosure, nor proof beyond reasonable doubt that a breach of contract (if proof has been provided at all) has taken place. None of us has any obligation to do anything other than reply to their notices. The burden of proof is on them as they are making the claim.

Ignore all threatening letters they have to have prove who was driving the car, I’m in Scotland got a parking notice of £100 that would be reduced to £60 if I paid in 14 days ! considering I didn’t get the notice till the 14th day , I’m just waiting on the fake lawyers letter to scare me in to paying lol which would cost more for a lawyer to do than the parking notice itself why would they do this ? And if it ever goes to court which it never does cost them too much money ! they still have to prove you we’re driving the car , (they may have the registered keeper but may not be them driving NEVER ADMIT WHO WAS DRIVING) and if it ever does go to court (it never does) all they can get is the original parking notice of £100 if proved you were driving . The only parking fines you should pay are police and council fines .

They stung me because their machine was broken and I couldn't pay for a ticket. Mysteriously I didn't receive my appeal rejection which also contained my POPLA reference so by the time I found out it was too late to appeal. Complained to BPA, spoke to POPLA but may as well not bothered.

I recently got a parking charge for driving on to a pay only car park and staying 11 minuets collecting some one at the shopping center . I made the mistake .......I appealed and lost the appeal popla is load of BS as they up held the the pnc . I have writen the the parking companey since paying the pnc stating that if they send me another demand for payment tjat they have agreed to my terms and conditions of £10 to open said letter £15 to read and file such letter And £100 to write a reply . They do it to us so it should work both ways .

Just recieved a ParkingEye fine in the post for overstaying in a car park. I remember checking my phone, an andriod phone which keeps time via GPS signals, according to the phone I had 3 mins to go until my ticket expired as I left the car park. Even so, Ive recieved my fine through the post. Motorists should refuse to use car parks that use ParkingEye and send a message to the businesses that emploly these cowboys!

Also check the date of the incident and the date of the issue because if they are over the 14 day period they have no right to pursue as defined by POFA 2012 section (5) sub-paragraph (4).

The appeals process is not independent......The owner of Excel Parking Services is one of the board members of the BPA and they are probably the most corrupt private parking company in the UK. The whole system is completely criminal just like the insurance industry in this country!!!!!! Simply disgusting!!!!

As an ex member of the AA I found them a but rich. I was a member for one year and called them twice. On both occasions they were of no help and in fact made matters worse. I complained and went to Greenflag, before my year was finished. I asked for a refund they gave me £50 compensation but refused a refund. I feel this was unfair. If I buy something that's not fit for purpose I get a refund. The AA in my opinion was not fit for purpose.

What I think is this, private parking companies are owned by shareholders who work in government who then allow for the DVLA to easily sell details which in turn allows for their shares to go up in value if the volume of fines are successful, so in short its a massive corruption. Do a bit of research and you will find this information for yourself.

I was parked roughly same time of year (2017) and I had fell asleep for just up to Two hours I left just after my two hours.. I have had various tickets for £197.. (Letters over 3 years) Had I knew I was just between 5 minutes and 10 minutes over I would have paid the parking fee of £5 just to cover myself. The real reason for parking there I was very tired driving, The car park in question is London Gateway.. The toilets are handy and coffee nice.. The letters have gained me a CCJ . But parking eye has basically sent me 3 letters with 28 days notice and now 14 days notice.. Tempted to pay but for Five minutes or more is really expensive..

Hi Sarah, you say the letters have gained you a CCJ. Can I ask how the letters earned you those and are you sure? From my point of view, the legal process is relatively straight forward and I don’t want you to panic. Say you & I were in dispute, you reckoned I owed you money. Firstly you would have to send me a Letter Before Action. Then you would have to take me to court. Then I would have to lose the court case. Next I would have to refuse to pay. Only then would I have a CCJ and you could send the bailiffs round. So a letter wouldn’t be enough for a CCJ.

We'd be really pissed off here in Australia if they tried that with us... This is typical of the collaboration between these kind of companies and the BBC. The BBC make it look like they report and hold these companies to account when in reality they are as bad with threatening letters demanding TV licence money, yet when they report on an issue like this they take too much of a wishy washy approach with their questioning and leave said company(s) to carry on in the same way doing just as they please.

Also....if you believe that ignoring it all will make it all go away, is very bad advice,THE LAW CHANGED IN RECENT YEARS. If you ignore a court date and don't turn up, it will affect you if you are looking to lease a car, get items on finance or are trying to purchase a house, this will cost you a lot more in interest rates etc of you will be declined altogether. My advice is, return all documents to the court and have your day with them in court ( a small room with maybe 2 people), half the time they don't even show up which means that YOU WIN by default and they have to pay all costs, if you get a CCJ, you can settle it within 30 days, or if you're unlucky and knew nothing of the letters as they went to your old address and you find out a year later, I believe its a bit harder! will update here!.

Few Days back someone hit My Car at ALDI Holyhead the Driver was OK. but little shaken. We Exchange details, and then I went in to the shop. Today I got a notice for a fine of £70 for overstaying time limit in there car park. by twenty minutes, Parking Eye who run the scam have these little sign's of parking rules. Warnung Take note: All inhabitants have 90 minutes to do there shopping, and on evacuation are not aloud to return for 4 hour's, to this car park. All perimeter are guarded by electronic surveillance, and number plate recognization software, that are linked to registration list of owners detail.s. packing is aloud only within bay lines. BLAH BLAH Now here's a point, there's a furious row has broken out over an "aggressive" crackdown on customer parking at Aldi. Cameras record car registration details when drivers arrive AND customers then required to enter their plate number into a machine after finishing their shop Those who fail to do so, or who exceed the free 90-minute time limit in the car park, face a fine. HOW THE HELL ARE THEY ALOUD TO USE THIS ANPR TECHNOLOGY , I though it was only the Police that could access your DVLA details, but apparently not. something is seriously wrong, when foreign nation has access, or that a second party is exchanging details with them. isn't this a type of when cyberespionage information or divulging of the same without the permission of the holder, when not in Europe now. this sort of thing is far reaching. what are we doing allowing an other country our private details. and who has the authorization to licence this technology, to what are basically car park attendance I would of though you.ll need states approval or sign the the official secrets act, or at least some sort of Hippocratic Oath. But hell no give it to joe bloggs, there a hell of a security breach.

Best way to get rid of these cowboys is boycot the stores that are using them. Let the stores know your boycotting them for this reason. If you spend £100 pw on shopping there and 10 peopel do this £100, 000 a year the lose out on.. people together have power stick together and hit them where it hurst!!!

That's like highway robbery, for one parking is not contractual law. If they want can bring to courts. If parking is 10 pounds per day lets say just an example how can they say 50 or more is what a ticket should be. That again is robbery, should be a maximum for one day parking. Not to mention should be someone to verify what cars in the lots then if just issuing tickets that they know, opps may or may not be right. Simply greed maybe no better than a being held up just with out the gun. 50% will just pay to make things simple they make more money. Like most traffic tickets also, money grabs plead to a different charge they get their money fine no demerits. What the world has come to. They just want their money, rest don't matter.

By law they have to photo you coming in and coming out of carkparks If you over stayed the 2 hours simple cover up your plates and drive out the computer cant pick you up ...................works everytime they hate me telling you this.

Get this,I had one the other day for parking in a Aldi car park for 20 hours and 57 minutes,Like what the fuck, I went shopping at Aldi on 2 separate days and as i always pay by card the receipt goes onto my online banking.on my phone so i sent a copy of the letter and receipts to Aldi, 2 days later i got a email back saying no further action will be taken, Always appeal against these charges if you have done nothing wrong,But there is a rite way and a wrong way to go about it,Hope this helps someone.

I was issued a PCN via the post to a fine of £70 but reduced to £40 if I paid within 28 days. They said I was 1 hour and 52 minutes at the car park ( limit is 1 hour and 30 mins) that is nearly two hours which rung alarm bells as I would never be there for that amount of time. They say that I entered at 15.41 and left at 17.34 - they had pictures of my vehicle, The problem is that I Paid the £40 ( in panic) and not happy about it there was nothing I could do. IThen found a receipt of the day in question and purchased items on that date and payed for them at 16.30 hours via my debit card. This made more sense, enter at 15.40 and left at 16.30 - 16.33 . There is no way I would have left the shopping in my car and gone for a walk or talked to someone for an hour in the car park, I bought meat that needed to go into the fridge.I am totally convinced that the time on their cameras ( parking eye ANPR) is or was out for an hour. I spoke to 4 properties in my street who have or had cctv , 3 not working and the other ( POST OFFICE) only covers the pavement so would not pick my car up driving home ( i live opposite). I have sent an appeal to parking eye and sent them the receipts of when i paid for the shopping 16.30 and asked them to review their CCTV/ANPR. It was only when I found the receipt that I knew that I was in the right. Proving I left there is more complicated. I will wait for response of parking eye , failing that I can appeal to POPLA. I will go to local MP , local press , transport minister as I am so convinced that I was not at the site on the time they said , any suggestions?

MR T do you have a smartphone? You can use location services to track your locations on the day you received the pcn. I used this for my appeal to Horizon and they cancelled the pcn as a result

@@j.eleanor2249 I managed to find a receipt and it states the time i paid 16.30 hrs so i appealed against the charge, and they said they will send me a cheque and refund the £40 so It turned out ok , it will take 28 days to for them to send me the cheque.
