Thanks! I have to be more precise now now that we're coming up on another March...been in this craziness for almost a year! That one-time form is for anyone who missed rent March 2020 - January 2021. If someone misses rent in February 2021 for the first time or going forward, they do not receive this one-time form. 💪😀👍

I have friends who live in a condominium complex that has a HOA. Is the president of the HOA allowed to work exclusively for the management company? Assuming that is legal, to what degree would a conflict of interest arise if the president (without the boards approval) is threatening monetary damages for a claim that is clearly bogus?

To clarify, the president of the HOA works at the management company? That definitely seems like a conflict of interest...if the HOA ever decides to shop for a new manager, that would certainly make things complicated!

Hi! In the Bay Area, Alameda County, one question... landlord for commercial property wants to evict, rent is current, but there's no lease, it's a lot that was purchased tenant refused to sign a lease at the time of purchase, tenant keeps promising to leave each month but they're causing major destruction in the meantime and imposing more and more on other renters. I'm having a lot of trouble finding commercial UD laws that don't relate to non-payment due to COVID hardship... watched several of your videos in a row, amazing and clear delivery! Thanks so much!

SB 91 is only for residential real estate, but some areas do have a local eviction moratorium that also includes commercial property so you'll need to find a good local eviction attorney to navigate this. BTW, not having a lease is a not a good idea, obviously, but doesn't necessarily prevent a landlord from an unlawful detainer.

That's a good question and atopic I will have to cover. This would fall under "at fault" if the tenant is guilty of breaking the law by stealing. Any specific examples on what was stolen?

Not much you can do at this point, Dana. Of course, discuss with an attorney, but this will be a pretty weak route for eviction. Just keep delivering the notices and the blank declarations for the months that are missed.

The fact that landlords can now apply and get at least a staggering 80% of the back rent is unbelievably amazing. This could be once-in-a-life-time opportunity that no landlord should ignore, because this opportunity could be soon history while back rents accumulate, w/ even more potential for extension of tenant protections.

That is a great question, Drew, and one to run by your CPA...there can be exceptions for emergency withdrawals like this. This is really good info, my landlord and i had verbal agreement in 2021 for not increasing rent for 2yr. But this year he asked to raise the rent i was fine but the amount he is doing is almost 25% of the current rent. Which is horrible given the time he choose when i am trying to finalize kids school. I see you mentioned that TownHouse owner are not falling under this category, is there any options i have?

I wanted to ask 2 questions to help my friend who is having tenant problems: 1-Could he evict a tenant who is not unemployed for any COVID reasons in fact he is working but hasn’t been paying rent to his landlord? 2-Can he also evict another tenant who has illegally (without the landlords consent nor agreement) brought in another person within his rental who pays him rent but main tenant does not pay any rent to the landlord?

You'll need to run these by a good local eviction attorney. My nonlegal opinion: 1) Probably not, because the tenant can say it's COVID and won't have to provide any proof (unless considered "high income") 2) Most likely, yes, to eviction on this one for subleasing without permission. It depends on what the lease says and what a good local eviction attorney says.

I’ve been renting month to month for over 10 yrs The unit is in a triplex near the beach bc I’ve been in same location my rent is not at market value. The Property just sold and I had a chat with new landlord. The complex is in great condition but it is dated new landlord is going to do a complete reno. I do expect rent to go up but He wants to increase rent A LOT more than 5% it would be more like a 86% increase (which is a bit more then market). I asked him timeframe of when the increase would take into effect and he said as soon as next month!😳 Now I realize we were just talking and that He would need to give me an official notice. But wouldn’t that much of an increase be a violation of SB 91? Also can landlord renovate to the point of making it uninhabitable for existing tenants to live?

Rent increases can only be 5% plus CPI for units in a triplex, thanks to AB 1482. That increase would also need a minimum of 30 day notice. You'll want to reach out to Legal Aid in your area to discuss your rights.

Ultimately it will depend what the application for rental assistance says, but there is nothing that I saw in SB 91 (which created the rental assistance program) that says that it's only for those who haven't been paying rent at all. My thoughts on it are that your landlord would receive 80% of the rent minus the 25% that you paid. We'll know more soon, but I'd be shocked if complete nonpayment of rent was required.

I have multiple questions as I have multiple issues with my apartment and my landlord we have lived here over 20 years he bought the building from a company so theres plenty wear and tear issues here over the years through the past few years it's been me,my mother and older brother the lease was under my brother and in the beginning of the year he was not paying all the rent he wasnt giving him all of the money so he was accumulating debt for use because he had already planned on leaving us. Well he was back and forth but right before the pandemic my mother fell I'll and it turned out that one of the reasons was because she was bitten by a rotten she had ro be hospitalized for a week she had and infection because of that then had to do a week in a rehabilitation facility. Well in the beginning of the year before getting into debt we had let him know that we had a rat problem so he knew of the issue which was caused by his Plummer who came to fix our kitchen sink and made holes in the wall which the rats came in through. Well he also tore up the kitchen drawers in the process which left just an empty space there he just kept saying he was looking for somebody to fix it he barely brought someone about 2 months ago to repair the wall which took him about a year to do about 3 rats were left out here and I'm still living with rats. My mom had to stop working due to her hospitalization which was due to his negligence and so then we had it worse she mostly lives at my sister's house now but visits he decided to put me on the lease and take my brother off but he piled my brothers debt on me which isn't fair also I never officially signed anything I ended up getting laid off in December from my seasonal job but I was paying wayyy more then the 25% actually all these months I have just not the complete 100% I'm struggling without work this month I might barely make it but I can tell him that I've paid more then the 25% all this time so I can use that if I cant quite make the 25% right I'm at over 4000 probably gonna be 5000 of debt now but also wouldn't he have to honor the deposit we paid coming in here before he bought the building? Also can he legally stick me with the debt my brother amounted while he was under the lease? Also I have a broken window he wont fix LITERALLY half the glass is gone he said he would but by now you can see what kind of landlord he is I have roaches,rats broken window he neglects everything I know that I could have called housing authority on him but I didn't I dont wanna move he doesn't like spending money but harasses me when I've already told him when I'll call and be able to pay him please I need help things are really bad for me all alone here now also if there's a way to speak privately I would highly APPRECIATE it thank you very much for listening. 🙏 and if anyone in Los Angeles can help me find some work or anyone I can work for I'd your reading this I'd really APPRECIATE it too thanks 🙏

You definitely need to reach out to Legal Aid and the Housing Authority to see what your rights are. You can also visit www.lawhelp.org/ for help! SB 91 and LA's Eviction Moratorium will protect you right now.

In my house, I rent rooms to several people, with separate agreements, and only one is behind in rent. I do not see how SB91 applies other than to all the tenants combined. The one tenant seems to need the help, but the way I read the law, I would have to aggregate all tenants income and demonstrate that their combined incomes are less than 0.5 (or 0.8) of the area median income, before that one tenant and I could get her past due portion partially paid, correct? Secondly, I assume the pecentage options offered the landlord in SB91 (25% paid, 75% still owed by tenant OR 80% percent paid and 20% forgiven) are applied as percentages of the AMOUNT OWED, correct (not as percentages of that tenants normal rent, nor the aggregate tenants normal rent, in this case)?

Thanks for watching, Doug! You'll need to run this by a good attorney. If you have a separate contract for each person, then I am not sure that you have to add up the household since they are not technically a family household, but the application may clarify that when it comes out. As for 25% or 80%, it will be up to that amount, minus any rent that a tenant has already paid. So if a tenant has already paid 80% of rent, then there wouldn't be any rental assistance money for them (or if they have already paid the 25% and landlord isn't allowing the 80%).

Great info, indeed! As a landlord, I'm about to start UD as I want to move back in but tenant refused to move out. Would I still be able to file for the relief fund for the back pay if I want to maintain my UD?

Thanks for watching, Ming. You'll want to run it by your eviction attorney. It will depend on the fine print in the rent relief application and documentation. Some considerations: The intent of the relief funds is to help renters stay in their rentals. It's also unlikely that your tenant will cooperate with the application process if you have a UD going.

I’m in CA. What if a tenant was not paying full rent prior to COVID and were served a notice to pay or quit and then COVID happened. Landlord wants to sell and tenant is still occupying and not paying. Can they be evicted to sell?

Talk to a good local eviction attorney because it could easily go either way in this case, especially if they claim that COVID has effected them since missing that rent before COBVID. At the very least, you can list the property, then give notice to the tenant when you receive an offer with a buyer who will move in...

Potentially, she should definitely run it by a good local eviction attorney. As long as the upgrades are for habitability for the home, then she should be able to use that for the notice to terminate tenancy. It can't be just because she wants to do some upgrading.

Short answer is yes, in many cases. Some areas have a moratorium against increases right now, so research that. AB 1482 will cap the increase if the property is not exempt.

Is there a MAXIMUM allowable amount a Landlord can increase rent to NEW Tenant? Is there a BASE amount that the new rent is subject to? For example: If current Tenants are paying LESS rent than comparable properties, can the Landlord evict the Tenants, to get new Tenants that can afford a HIGHER rental payment? And, if so, Is the new Rental Payment subject to last Rent charged? Or can the Landlord charge whatever the he thinks a New Tenant will pay? Thank You.

In California, there is currently no limit to the increase when setting the new rental rate after a tenant moves out (it's possible that some affordable housing or rent stabilized areas may have limits). Prop 21 was going to try to add a provision in that would limit the increase to 15% over a 3 year period, based on the previous rent that was charged. This is called vacancy decontrol. Prop 21 didn't pass. As for a landlord being able to terminate a tenancy just to raise rent, the answer is no...SB 91 currently prevents this. A landlord could theoretically _try_ to use one of the no fault provisions in SB 91 to get a tenant out and reset market rent, but SB 91 is trying to prevent this right now. Of course, run this all by a good local attorney.

If the tenant is on a lease, then you have to honor the lease term. Once it's month-to-month, you may be able to terminate the tenancy and move in. Definitely discuss your situation with a good, local eviction attorney.

You'll need to reach out to a good local eviction attorney to discuss...these days, changing the locks probably isn't a strong enough breach to allow an eviction, but an attorney will give you the best guidance on it. As for not paying rent, the tenant is protected by SB 91 if they are not paying rent due to COVID-19.

No, the proof of service doesn't need to be attached. It needs to be appropriately served, but proof of this can be separate, e.g. an affidavit of service.

@@UFOLLOWINME Yes, the Notice to Terminate Tenancy needs to be legally served. As for the on or off market, there's no easy test other than to keep an eye on it after the move out. Definitely run this all by a good local attorney to know your exact rights.

You own the whole 4plex, correct? If so, you're subject to AB 1482 and probably can't raise it more than the legal limit of 5% plus CPI. If they both moved out, you could take it to market rent. You'll also need to see if there are any local requirements, plus run it by a good local attorney.

Mr Walsh , I am a School Bus Driver still out of work and no sign of my EDD extension yet . I'm only 17 days late on rent and landlord gave me a " notorized" 15 day EVICTION notice . I know she's crazy but she also never gave me any of the Covid-19 forms that she was supposed to provide . Should I print a SB-91 Declaration of financial distress form off internet myself and give that to her ? And do I need to give her one each month until EDD releases my extension? 😕

You can reach out to Legal Aid to discuss. The 15 day notice is required, but she was supposed to give you the blank declaration as well to fill out and send back. Your call, if she didn't send it, then you don't need to return one. And yes, it would be each month that you aren't able to pay rent. Just be sure to get the 25% of monthly missed rent to her by 6/30/21.

Hi Wire associates thanks for the great video again. Could you please answer a question. For at fault just cause of breach of covenant for unsanitary property conditions caused for tenant if my property is residential and the tenant has been there for less than a year (however I have not given ab1482 disclosure) I initially fill a 3-day notice for breach of covenant to fix or quit. Does this initial notice should be followed by a three day notice to quit without giving chance to cure? Thanks I would really appreciate a response.

I extended the lease agreement to her but she ignores or have not signed and return the lease agreement to me. I also gave her the 15 days notice to pay rent or quit for February. She submitted the rent of 25% for the month but didn't return the signed Declaration of Financial Distress due to Covid. Would any of this be a reason for just cause eviction under new sb91? What's can I do for the next step? Thanks in advance.

Definitely find a good local eviction attorney for help. The LA Eviction Moratorium makes things more complicated for landlords. In my non-legal opinion, the short answer is that none of those maybe strong enough to get through an unlawful detainer. As for the Declaration, the judge would allow those to be turned in later.

SERVED BY LANDLORD 60 DAY NOTICE, to sell property. I get state benefits-Medi-Cal/EBT/ PERMANTLY DISABLED -MEDICARE. THE MONTHLY CHECK-I HAVE PAID RENT, INCOME LEFT AFTER RENT PAID $271. I BEGAN WORKING, TO COVER LATE UTILITIES, INS, AUTO. Now to apply for a new rental I must have income 2.5 above the monthly rental. My credit effected by Divorce. A partime job with school district put on hold since June 30, 2020, SCHOOL CHARTER. Cov-19 did not allow employment.

No, only if rent has been missed. The one-time notice is only if a tenant missed any months of rent between March 2020 and January 2021. Then you would give the 15 day notice and blank declaration for every month missed from February 2021 to June 2021.

Yes, SB 91 applies to month-to-month tenants.

Refusing to rent to them, you mean? My non-legal opinion would be that you can refuse to rent to them if their credit an income aren't sufficient for the rental. As long as a landlord has consistent screening standards for all tenants across all rentals (that follow Fair Housing guidelines) a landlord can choose who moves in.

If tenant owns big balance. The la county rent relief program only can pay a small portion flat fee of the rent owned. Plus tenant can’t apply for another rental assistant in March. That’s totally screwed... also it’s extremely not fair that If the March rental assistant come out later than the LA rent relief program which the tenant already been selected and worked the case. Pretty much the tenant is a sitting duck there to receive a small portion financial help, rather than really have a choice to choose which program helps better!! This is extremely frustrating... especially tenants who owns big amount of rent, known there is no fault on anyone who got locked down and financially deeply effected from this Covid...

That's interesting, Mathilda! I wasn't aware that LA wouldn't let you apply elsewhere for assistance. I am also curious of the LA assistance is from the Federal funds or somewhere else. Need to do some digging...

You'll need to reach out to an attorney ASAP to discuss your rights in your specific situation. You can look for Legal Aid in your area and/or visit lawhelp.org. You do have rights and the current law (SB 91) makes it difficult for a landlord to terminate tenancies.

Also the reason is to remodel Nd onwer move back in. I am the gra ddaughter who took care of grmma and raised in this property. Its a 2 house lot My aunt is recieving my rent and this was a suprose to her that she wasn put baxk in trust.

Yes, that can happen, but reach out to Legal Aid and discuss your options...some areas may have an eviction moratorium that prevents this.

So now there's an automatic lease renewal rule? it is so stupid that you can't end a tenancy at the end of a lease contract. If tenants can't afford the rent, they should be MOVING OUT at the end of the lease term, not staying and not paying rent.

It’s mutual.... tenants are screwed big time as well. Especially who used to make reasonable amount to be able to afford it with little financial help. We are grateful this channel jews us updated.
