This is what the state does to any that challenge capitalism. It’s perfectly fine with right wing militias and fascists to be its unofficial arm against the left (not the “leftists” like AOC and others). They have done this since the civil rights movement and before against any group from the proletariat to Black Americans who demand justice rightfully. I have a hypothetical question. Could the governor of Oregon have ordered the Oregon National Guard to protect the protestors from the federal police? To me, this is exactly what "a well regulated milita, being necessary to the security of a free state" meant to the drafters of the second amendment.

You pose an interesting scenario. I do not have expertise in this subject so my thoughts are my own opinions. My initial reaction is no... they cannot. If the federal police are there enforcing federal laws (which is their claim) then they are not attempting to overthrow or stage a coup against local and state governments. The state cannot bar federal officers from enforcing federal laws. From my understanding, the national guard is under state control but is also a federal entity... so I don't know who holds the ultimate authority over them.

It's entirely possible, but the President would say "lol no", and, as the commander in chief, the foremost power of the executive branch and the military, he would be prioritized. Also, the national guard should definitely not be used like that and the national guard is nowhere even close to a militia, it is a military branch, with military weaponry and training. Also some of those protesters dressed up like edgy people at night and threw bombs/molotovs at federal buildings, so it would probably not work out so well.

I was thinking about this, too. What would have happened if someone just thought they were getting kidnapped and started blasting? With the way some of these whackadoos who travel cross-country to "fight the libs" dress, I wouldn't hesitate to think a couple well-armed and well-equipped domestic terrorist psychopaths were grabbing me.

@@MissZXC16 While under state command they are the commander in chief but the president can federalize their command if your asking this questions its actually happened several times before at various points the most recent case was segregation which case they followed federalization order but there was several cases during the great depression they ignored the federalization and refused to supress protests in this case I think it strongly likely they would follow federal orders and being entirely honest if a president enacted the insurrection act they have very broad authority to bring order

I was there for the protests as I live in Portland. That singing and just....doing nothing outlandish was 99% of the protests. It was only the few people who came out late at night who wanted trouble that made headlines and labeled us as troublemakers and out of control. They had no interest in the movement, but just wanted to fight and break storefront windows under the guise of protesting. It really shed a bad light on us. His sister’s reporting was spot on and it was usually a great time!

Don't bother blaming those few people. The media was just looking for a reason to label the protests altogether - and you're always going to have those select few who turn to more violent or destructive means, whether because they simply were looking for an excuse, or because they understand that nonviolent protest alone is entirely ineffective at bringing about any real change. Blame the corporations behind the media, not the protestors.

There are KZitem videos many hours long of up to 9 CCTV cams at once along with cell phone footage showing people trying to burn down, barricade or vandalize federal buildings; throwing fireworks; and fighting with police. I get that the protesters marching during the day had little to do with what happened at night, but there's no point in trying to downplay the absolute fuckshow that was happening every night.

That "sword" swings both ways. "Hands up, don't shoot" never happened, yet it's being chanted by the crowd. People hate Trump so it doesn't matter what the actual facts are...he's wrong about everything. It would be interesting to see an equally thought out and thorough dissertation from someone with a more conservative approach. Then I could decide for myself what's important and stake a position. Also, acting like no harm is being done across this nation by everything that is happening seems silly to me. Two people were murdered in CHAZ/CHOP, in Seattle, while the police were "banned" so this so-called "summer of love" is not quite so rosey. Our society has problems and issues to deal with, there is insidious racism in our systems that "white" people don't know about, don't understand or unfortunately don't care about, and that needs to change. The faulty, white, rich, slave-holding men that formed our current govt did build a pliable, system that is resistant to "mob-rule" but can be changed. And that is a good thing. However, I believe we might be in the in the process of "throwing the baby out with the bath water".

@@jameskrivda1151 I highly doubt that the rioting has made people care more about racism. It's probably increased anti-Black sentiments. Peaceful protests work, we've seen this. Riots make your cause look nutty, because the people supporting it look like nutjobs. Hence anti-Islamic sentiments tend to rise after terror attacks, and thus Republicans tend to gain ground, because people seek comfort in law and order, which Conservatives tend to provide.

Question: What happens when local or state police observe a probably or possibly illegal arrest/kidnapping by federal troops. Can they intervene? Stop the unidentified feds and request papers and the legal basis for said arrest?

BUT this is a repeat of the 1960s those riots were in response to police brutality, lynchings, the disproportionate violence and deaths and effects of the draft on communities of color. The same things being protested today. Martin Luthor King Jr, who was critical of the riots but still said "Our nation's summers of riots are caused by our nation's winters of delay." If we want to eliminate these summers of riots we must eliminate the source of their discontent, you want to stop the language of the unheard? Hear them. Further, what we see here is the arrest of people who's crime was being found near where such things were taking place. Protesting yes, but protesting is not a crime, protesting near people who use protests as a screen for destruction is still NOT aiding and abetting a crime on the part of the protestors.

You're missing Article IV; the federal government may intervene in civil unrest in the states only upon application of the state legislature, or the governor if the unrest prevents the legislature from convening. Seeing how Oregon's government has done the exact opposite of asking for federal assistance, they don't have a leg to stand on; this should be a slam dunk case before even getting to the Bill of Rights.

Making the “joke” that they did not teach him to read the constitution while he was there. The commentator you responded to did not state anything that we could infer that he was confused about where these event were happening. Only if you thought that he thought that these protest were happening in California could you assume that but as I’ve clarified that is incorrect.

From what I've heard tear gassed was fired AFTER fireworks were launched at the courthouse and a fire set in the courtyard. Apparently many of the fireworks are commercial grade, pretty dangerous things. Hard to get a truly accurate idea of what's going on over there minute to minute.

yup, they can. if it is patently obvious somebody is struggling and the 'state official' approaches said altercation, declares himself, and the 'disguised guy' doesn't respond... the 'state official' then follows his training, education, and experience. it's just like if somebody 'dressed as a cop' tries to arrest somebody and a 'real cop' comes upon them.

No, because these officials are clearly identified with gold POLICE across their chest with a unit ID number on their body and patches on their shoulders showing exactly which federal department they are with. Every single one of those objects are larger than a name tag. It is dishonest to say you can't identify them as police unless you mean you can't from 25 yards away.

That's what's upsetting to me. The 2nd amendment crowd that always talks about tyranny is largely against these protests, but when a tyrannical government comes knocking they just sort of close their eyes 🙈 Arm yourselves, government overreach is only becoming more common. If we get another 4 years of Trump everyone should keep that in mind.

These riots have gone on far too long and are no longer about the original issue. These are just people who want to watch the world burn. Such people will not be satisfied until everything is in ruins. State rights' people understand that and thus aren't going to support states whose governors are too chicken to stand up to the thugs like the majority of their constituents want them to. These rioters are not supported by the majority of people in the states they are occurring in and need to be dealt with. The President's mistake is the same he always makes. Choosing the worst possible approach that still has a chance of working. He should have sent in the national guard not spooks. To be fair, the governors of the states should have sent in the guard long ago. They failed their duty so now it has to be the fed unfortunately.

LegalEagle - I am sitting through a second watch of this presentation. I have so many questions and concerns. I'll hold myself to two related ones. What will the legal morass look like when; An unarmed protestor is detained by unidentified camouflaged men pushing him into an unmarked vehicle AND 1) It turns out they are federal agents making a legal arrest. But the protestor resists the arrest. 2) It turns out they are not, and the guy is found dead. In the first case, can the protestor be charged with resisting arrest or anything at all? In the second, is the Federal gov't in any way accountable for creating an environment where "bad actors" can utilize the confusion caused by the Federal officer's tactics?

Padraic your second scenario is playing out right now. Peaceful protests are occurring and 'bad actors' are using the mass of people, all wearing black to violently attack police, and property all over the country millions of dollars, then slip back into the crowd, take off their sweatshirt and switch to something not black. As for using the tactics, every bad actor out there is using the absence of police to cause havoc, causing crime to skyrocket. If you look closely at the video the identifying tag is just above the Patch identifying the agency. And bad actors are identified and arrested immediately, see the article about the Kentucky protest where someone was posing as National Guard and immediately called out and arrested. Understand, there are not a lot of officers, so you know who is on your team, your agency. These are the elite officers, I can imagine they may even train together, and they were picked specifically because they are trained for protests and riot control. If anyone is accountable it should be the local politians for allowing it to get this far. Even cutting of all communication with the federal officers is a recipe for disaster if they do not know what is going on. There could be a shooter incident outside the courthouse and someone could get hurt or killed with cross fire.

Your second question pertaining to the second scenario doesn't make sense. In the second scenario the people in the "uniforms" are not police so the Federal officers' tactics are in fact not the Federal officers' tactics but rather the tactics of bad actors. In either case I don't believe you can hold law enforcement accountable for a bad actor impersonating law enforcement. Impersonating an officer is a crime and if you believe someone is impersonating an officer you should find an identified officer and ask them to investigate the supposed impersonator.

@Nogilthazaa CBP MORAT and SRT units with border patrol are specialized units, trained for riot control in detention facilities and at ports of entry. These are not normal uniformed units, they are elite units with focused training and experience for decades on the border. Watch press conference July 21, where the Director of CBP goes over what the units are trained for.

First, no part of this is legal advice in any way or even guaranteed to be factually correct. I'm just some random person on the internet with no education in law. I'd look up the term Deprivation of Rights Under the Color of Law, which states among other things that an illigitimate arrest is no different from a kidnapping and a unjustified use of lethal force by LEOs is no different than murder or attempted murder. There are supposedly even president-setting cases of people using lethal force to defend themselves from what the court ruled an unlawful and illegitimate arrest and being declared innocent by virtue of self defence.

People detached from what their constituents truly want, yet unable to be replaced by the common man as few others have the means to organize a campaign and run for office (costing millions). The money must come from those already in power, either by place of birth or through fund raising with company heads and lobbying interests (once again, the rich). That high bar for office means that the government intended to be “of the people, by the people, for the people” more often is of the rich, by the rich, for the rich. And they, they are only interested in keeping the status quo, the one in which they have all the power.

It's already difficult to impossible to identify who has been arrested by whom in all these cases of arrests by unidentified individuals in Portland, D.C., and all over the country, thus making it difficult to impossible to seek recourse for violations of your rights. So, do you think that actual criminals aren't going to take advantage of this to further their own goals? I mean it's _possible_ but it's not exactly probable. By far the more likely case is law enforcement entities (briefly) confusing who is from what department at a glance, but they all know they're law enforcement. After that, you get a risk of those "boogaloo bois" using the confusion to dress as nondescript feds and perform acts of terrorism. As for random abductions for the purpose of human trafficking? I'm going to be blunt: I think you've been watching too much Netflix. There are easier ways to acquire victims that won't launch a missing persons report (eg immigrants). Maybe run of the mill kidnapping could happen, but you could just, you know, kidnap them the way people have been doing it for years. Again, I'm not saying it's _impossible_ or that it would never happen. Dahmer dressed like a cop, I guess. The added threat by this is just so minute, to bring it up is distracting.

That is their assigned uniform, their assignment is not undercover why would they walk around in civilian cloths? That would be confusing not just for protesters who may think they are an Alt-Right group and confusing for the Portland Police Bureau who may mistakenly think they are protesters with weapons, which could end poorly. Just like uniformed police officers, there is no mistaking those in camo with weapons and police emblems and badges are legit police officers.

They're not confirmed by the Senate so they're considered acting officers and they can serve up to 210 days. After that time period a new person must be installed. Something to keep in mind these people are a lot easier to replace than confirmed appointees that's why Trump seldom bothers to get these people confirmed because then he loses the flexibility to replace them as he pleases.

@@userequaltoNull The surprising part is that the officers didn't rough him up and charge him with assaulting an officer when his blood splashes on their uniforms. I won't say that's normal, exactly, but that exact scenario of an unlawful arrest turned into a legal charge due to the messy results of an in-custody beating has happened enough in recent years to really stick in my brain. And that's just the ones I know about.

jeepien Dressing up in a uniform with a police patch and acting as an officer, stopping people on the street is also equally a crime under both federal (18 USC 912) and state law (ORS 162..367). Your argument seems to be that breaking the law to impersonate an officer is something everyone will do, but forging a badge is just so far beyond the pale no one would ever do it? To me the biggest issue isn’t the uniforms, it’s the unmarked vans. Just get some government vehicle prisoner transfer vans from the Marshall service. I mean, how hard can that be?

Very easy, it will say Police or FBI in giant letters on their front and back, plus a patch and identifying number or name tag. They will almost always be with others who look the exact or similar. The posture and attitude when they contact you should tell you where they are legit. It would be very hard and dangerous to impersonate any of those organizations, and to try and match the unit or agency from a surplus store would be nearly impossible. The uniforms you may find but everyone in that unit will know you do not belong and there will be hell to pay, especially impersonating a federal officer or soldier. I know Stolen Valor Act makes it a federal crime to impersonate a US veteran.

Thing is, there's a manual on how to deal with this type of thing; the military use it for dealing with this issue in foreign countries (FM3-24 - it is legally available for free on fas.org). The best thing you can do to increase popular support for a movement is to give them a security clampdown (especially if it hasn't been justified). Security clampdowns inevitably end up hitting bystanders, which will be blamed on the security forces and the government, turning sympathisers into activists and the general public into sympathisers. If you want to reduce tensions, then what you really want to do, while we're still at a stage where the movement has yet to turn violent (and no, a few broken windows don't count as violence), is give the movement the opportunity to vent their grievances (while detaining legitimately bad actors) and, where those grievances are legitimate, work to address them. In the meantime, you work to improve infrastructure, including things like access to healthcare, housing, and food, in order to make people feel less desperate and angry. The manual in question is titled Insurgencies and Countering Insurgencies. This isn't an insurgency yet, but if Trump continues to respond the way he is doing, this will turn really, really nasty. Once you have a full blown insurgency on your hands, you're looking at a minimum of 6 years to deal with it - more likely 10-15. Kennedy had his flaws, but this particular quote has always rung true for me: those who make peaceful revolution impossible make violent revolution inevitable.

Also, a virus is not a molecule. Although I'm sure no one would expect a lot of scientific accuracy or even logical thought from an anti-masker. So I can understand if you don't know that viruses aren't molecules, and why governments and health organizations around the world have recommended masks. hahahahaha

Thank you thank you thank you for addressing this and pointing out that Portland has not fallen into an absolute state of anarchy. I’ve actually had people online tell me, a resident of Portland and only 10 min from the protests, that I don’t know what I am talking about when I inform them that the “riots” are a few isolated incidents of property damage during an otherwise peaceful protest, and things only got worse when the feds entered. Portland is not in a “state of anarchy” or “in flames.” The vandalism is inexcusable, sure, but so are unmarked feds scooping people off the streets and shooting rubber bullets and tear gas at peaceful protestors because their shift is going to end soon and they don’t want to have to stay over.

This is one of the best episodes you have created. Concise and clear, it explains many of the complexities and distinct separations of federal and state law. A couple of observations and questions if I may. Federal enforcement of federal laws or property - why is the FBI not involved in the investigation or arresting of all suspects? Is it because they follow the law and identify themselves when asked? Is it because they have no authority to prepare in advance of a potential violation of law? Is it because they do not fall under the direct authority of DHS, but the DOJ and would leave a paper trail of legal arguments that identify the potential illegal nature of such actions by the DOJs Attorney General and abuse of authority? One of the more compelling discussion points is the power of authority by non-confirmed appointments in almost every Federal department under DoJ and Defense. It's an astonishing abuse of authority and oversight. This trend began two years ago with many implying the White House has intentionally taken this course to avoid scrutiny and ensure those who are appointed follow the Executive Orders of POTUS and ignore all Senate or Congressional requests for oversight, which in itself has created a serious legal crisis. I doubt you will run out of legal material for another 100+ days. Again, thank-you for informing the general public with critical knowledge how American law works in a respectful and honorable way.

Excellent points Doug. I, too, would love a video (perhaps he has already made one) about the legalities and restrictions/limitations etc, of an acting head of a department. It’s definitely one major loophole that the administration has used to bypass Congress and the Senate completely. Hang tight my American friends, this will get much uglier the closer it gets to Election Day. This is a warm up for deploying a private military on the streets once he loses the election or calls into question. I wouldn’t put it past some of these troops belonging to a certain Mr.Price.

Those are largely the people calling protesters 'Violent Thugs' and such. You see, its simple. They have a different idea of 'opression' then most, there idea of 'Opression' were things going against there 'Heritage' or there 'Freedom of Speech'. So here we see very clear and obvious opression. With civilians being massacred and assaulted, but it dosent fit into those 'My Guns' guys idea of 'Oppression' so people actually standing up to the Governant seems unjustified.

I'd argue that using the authority under border protection is done outside the context of the "spirit of the law". This is often given credence in decisions in a ruling the Supreme Court reaches.

There are border patrol officers there, but they have been deputized according to federal law and supreme court ruling that allows them to not only have authority on the grounds of a federal building, its interior and near it, but to also arrest anyone in any area that is committing or has been witnessed committing a federal crime.

@@Farmer_El The "spirit of the law" here clearly relates to protection of federal buildings though. It is pretty clear that the CPB officers who have been deployed are seeking out protestors rather than defending federal property. It is also pretty clear they are operating outisde of their jurisdiction.

In this camera-saturated world, I would think there will be plenty of evidence to prove they're not investigating anything, and the spirit of the law is being abused. But as we know all too well, "the law" doesn't actually matter anymore. It's just whatever the Prez says, and whatever his base will believe. And they believe everything he says without question, so...
