Oddly enough……a railroad company was at the heart of the American Civil War. They seized land, then gave the state’s the bill, meaning that the property owners were being taxed for allowing the railroad to take their land. It was a 20 year struggle, but when the top lawyer for the railroad became US President,(Abraham Lincoln )it became an armed conflict. It took me many years before I knew about that.

We are seeing this in Oklahoma. The tollway company want to build tollways where they are not needed, using imminent domain to take farms that have been in families since statehood. They voted and killed it. But others are not so lucky.

@@gillygil8747 Tar and Feathering only worked when Politicians were treated like average day citizens. Now a days politicians are somehow celebrities' who are deemed untouchable. A reality check to these people would do everyone a lot of good. They are citizens just like the rest of us, and they eat at the same table we eat at. They are not immortal and are in fact just as human as we are. They are but an arms reach, and it time they lose their personal security to show that.

What will happen next is this. The railroad will have the local government condemn the properties, take it for pennies in the dollar, in the name of economic development, then give it to railroad. KELO made that a "constitutional" use of eminent domain. This case is prone for reversing KELO.

If you don't stop this process every corp will do it. Businesses are not mentioned in the Constitution. If they had collective powers that would be a Caste System. That is why Business is not mentioned in the Constitution. The Bill of Individual Rights is inbedded in the Constitution, Seperately Ratified, Exclusive for the People only changes to Constitutional Procese and AUTHORITY!! The Citizens United case which allows corporations to donate to causes the same ss people defined corporations as people to give them First Amendment rights, so consequently I imagine a lawyer could and would argue that definition thus proving that it's not necessary for the Constitution to specifically mention an entity which didn't exist when it was written.

No it should not. Eminent Domain is essential for the government to build infrastructure, schools, and other needed public projects. Abuse of Eminent Domain, which has run rampant since the death of my grandfather in 1984, must stop. He spent many years rewriting the volumes of books, Nichols On Eminent Domain. I'm quite certain he would be appalled at the abuse that began in the 1990s for greedy or politically motivated seizing of property.

@@thealterego3187 The problem is you want to decide what "fairly" means. If an airport needs to expand, for example, it is in the public good and it's a function of the government. Same if a road needs to be enlarged or a slew of other infrastructure needs seen to by government. In most of these cases, some private property will need to be used, regardless of the desire of the owner to keep that property. In that case, a fair price must be paid to the owner for the taking of their property. That can be negotiated or litigated. Rarely will a private property owner be able to deny this because it's being done for the public good. You may not like it, but it is fair, in principle. The problem isn't eminent domain but rather the misuse of these laws to benefit private individuals or businesses, or failure to adequately compensate property owners for their property.

That derailment poisoned the water, air and the land. The people of that land didn't do it. It was neglegence and possibly on purpose by the rail owners themselves. There should be 2 engineers on every train, but the gov. allowed it to go down to 1 and the brakes are bad on the trains anymore too. :(

In the atrocious US Supreme Court decision in Kelo v. City of New London, they ruled that eminent domain is not a violation of the Takings Clause of the Fifth Amendment if the government receives more tax revenue. As if property taxes weren't enough of a violation of property rights, the Kelo decision drove the final nail in the private property coffin in the US.

Second amendment: "Well regulated militia." NOT "if they pass laws you don't like, just shoot em up!!" If that was the case, every election, you'd have the losing party committing mass murder because they don't like the new laws. This was NOT the purpose of the 2nd amendment, and it's sad and scary that you believe that. There was no large fast moving military available, so the well regulated militia part clearly stated in the second amendment was meant as a way to allow citizens to fight ON BEHALF of the government... not against it. That's what the constitution is for... an outline of how to run the country, and how to change those laws as times change. No where in there is there anything about killing people with differing ideas.

Roughly eight to ten years ago in Las Vegas, Nevada, a private company used eminent domain to take over some land so that they could build a private parking lot that they would use to charge people to park on and therefore make it profitable to them. They used the ruse of more tax revenue for the city and county. They were able to take the land and I believe even build the parking lot, however, the original owners fought back in court and ultimately won that this was an illegal use of eminent domain. I believe they took it to the State of Nevada Supreme Court. But this is an interesting case in that it shows precedence. Perhaps this could be useful in this and other such cases.

The Southern Company was allowed to take an acre of land from my Dad and hundreds of other landowners in order to run power lines from northern Alabama to the state of Florida in the early 80's. So yea, it can and probably will happen.

Well, let's hope that this manages to kill the Kelo precedent. (Exact same circumstances.) I would love to see the head of the "Wise Latina" explode. She was the one who litigated the original grab - and who didn't recuse herself when it hit SCOTUS.

That's like way back in the day when the railroad started and they used the Pinkerton detective agency to do force farmers of their land for the railroad. The railroad then was privately owned and operated but Government endorced. As soon as Government believed then the railroad could benefit them as well with supply transports for the troops for instance it used the Union Army to drive people off their land, generally with gerilla tactics like the destruction of crops and homes even arresting people for the mere suspicion on riding with Quantos Raiders during the Civil War. These tactics haven't changed much (no the army is not involved anymore), we now have the Department of Agriculture, the ATF, the FBI, the EPA, the IRS and many other 3 letter agencies that do the same bitting. And of course the law of Eminent Domain was created right around that time as well. Eminent Domain is one of the most unconstitutional laws that has ever been created and everybody that has fought it so far, to get that law abolished, has failed. Do not allow the Government to take what is yours.

SC has a constitutional law that prohibits eminent domain for economic purposes. NC however has rampant land theft because its eminent domain laws are so lax. In NC you could literally go to the clerk of courts and get land signed over into your name and just pay the fee.
