I have already uploaded video about Enquiry process in the cases related to corruption. The enquiry is mandatory to be initiated before registration of case against any public servant (patwari, Tehsildar, doctor or any other official/office). If during , it is felt that case should be register, then case is registered otherwise, if it is felt that it is the case of disciplinary action, in that case the matter shall be referred to the department concerned of that public servant. And if during enquiry, the allegations found to be false, the enquiry can be dropped. Before registration of FIR in corruption cases against public servant, written approval is required by Deputy Director, Director and Director General of Anti Corruption Establishment for registration of case against public servant in BPS 1 to 16, BPS 17 & 18 and BPS-19 and above. It is also provide in rules that no case shall be registered against a District Coordination Officer of a District Government, a Commissioner of a Division, a Secretary to the Government, a Head of an Attached Department, and any other officer of BPS-20 and above without prior permission in writing of the Chief Minister but in case any of those officers is in BPS-19, such permission may be accorded by the Chief Secretary. It is further given in rules that in trap cases, no permission is required.
