The pardon is an admission that our justice system is not even expected to produce justice. It's also an admission that we still kind of believe in kings, or at least a modified version of king/president who certainly has far too much power and too little accountability to be considered anything but a contradiction of the notion of the US being truly democratic.

I strongly support the idea of holding hearings to review whether some of the more recent Supreme Court Justice candidates actually committed perjury when they were responding to Congress during their nomination. It seems apparent that three of them did not tell the plain truth, and lying under oath is still a crime even if one is a candidate for Supreme Court Justice.

At the time these candidates lied to Congress, they were not yet Supreme Court justices. They lied in order to get a post for which they were not qualified. Having been found out, they are using the office obtained illegally to avoid culpability. Nice curcular argument.....

Miguel Rod ...When Richard Nixon resigned from the presidency in 1974 in the wake of the Watergate Scandal he was the first president to do so in the history of the nation. High ranking Republicans put pressure on Nixon to quit, and he caved. Trump has a lot of support from Republicans today, and his single term is over. I don't think we will ever see him perp walked anywhere by the FBI because there are enough people in government who have the power to spare the USA the embarrassment of seeing a former US president arrested and in chains. Watching older libs like Glenn speak so passionately about marginalized groups and atrocities committed against us so often, makes my heart fill with love. I'm seriously crying listening to him. I live in the south and was raised by two extremely hateful conservatives that literally tortured me as a child, and blamed me because they said God was punishing me. I was just a scared little gay boy all alone with no one to stick up for me, and everyone treating me like a mistake or a joke. I transitioned a little over 10 years ago and I'm now married to a Wonderful man who protects me and stood up to my parents. He speaks and sounds alot like Glenn. Gives me hope knowing others have empathy, and see the direction this country is heading in despite all the progress we've made. Im constantly scared, but this just eased my nerves a little

Legally speaking, a pardon is an admission of guilt for a crime, which ordinarily is a matter of public record, for obvious reasons. "Pocket" pardons conceal criminality and thus potentially endanger others.

It’s likely the DOJ is playing all this very close to the vest due to the players involved. And they may be playing a very calculated game of chess by “appearing” to slow walk this while making an airtight case behind closed doors and allowing public outcry to reach such a crescendo that prosecuting Trump and the rest of these cronies is the absolute and only option. At the very least it will totally ruin future political aspirations for Trump and any other officials that supported the coup efforts.

Ideological Justice Scalia, in the 2008 Heller decision, astonishingly tossed out the "militia" clause. That was such an egregious abuse of the Amendment that Heller will inevitably be abrogated.

While president, he was always on the job, very rarely played golf. When covid hit, he was up front and honest with the American people. He told us all that he would build a wall at the southern border to keep all the bad, ugly people out of our country and he made damn sure that Mexico would pay for it all. Did I mention he never lies? Trump was super, duper tough on Putin. He never made a dime off of the United States. He took the 2020 presidential loss like a man and walked quietly into the sunset. As it stands today, the right to bear arms comes at the cost of life and liberty. One person’s ability to own a gun comes at the expense of another’s right to life. This seems like something worth (legally) fighting about.

I don't understand why we are expected to take an oath in court seriously but those that we expect to uphold it aren't held to the same if not higher standard. This tells me that they do not believe in the law the way they should. That we can't do a thing about it is frightening.

Coherence and sanity don't get voters excited, don't hold their attention, don't make them follow the people who would lead with those qualities. Drama, comedy, controversy, "strength", "owning" the other side, "fighting" in an "Us VS Them battle" of the would be leaders' own design that divides us common folk and makes us less likely to question them : that's what voters want, that's what holds their/our short attention spans, that's what gets our money into their hands, and that's what gets our votes so they who would "lead" can hold power. This is what our country, the United States of America, seems to have become, generally speaking, of course, always exceptions.

A pocket pardon from ex-#45 for treasonous traitors against the United States in their coup attempt and insurrection should not be allowed. Questions from Mr. Tyler-Cohen and Commentary from Mr. Kirschner is much appreciated. The Supreme Court Justices must have a code of ethics, code of conduct, policies and procedures and should not have a life time seating.

I didn't know Glenn before this discussion but I can really appreciate his passion and rational arguments. The majority of the American public is on the same side on most issues, including the "big lie" and January insurrection. Legally convicted felons can run for office, even from prison. Trump could have been barred from running for president again if he had been convicted in one of his impeachment trials, but he was acquitted.

Let’s say for a minute that he has a pocket pardon for one of the crimes that would barre him from public office. By definition, in accepting a pardon (if a self pardon is even judged to be legal) the pardoned admits to the crime (otherwise one cannot be pardoned for said crime). So, if trump self pardons for sedition or treason would that barre him from office since he would be admitting to the crime? And if so, is the presumed win-win for the DOJ to charge with sedition and or treason?
