What happens if a legal heir/provisional members sell the flat to a person without the knowledge of society since no NOC is required for sale of flat. Now, when the person who has purchased the flat (buyer) from provisional member submits the document to transfer the share certificate in his favour. What should the society Do? a) Reject the application for transfer stating that the sale was illegal. b) Accept the transfer of share certificate. Since he has purchased the said flat via sale agreement. And can the other legal heirs who's interest are affected file litigation making society a party incase of such sale of flats. Then as society committee member's what should we do?
