Thank you for sharing. I understand some Hawaiian activists who say that Hawaii is an "illegal" state...We need to see both sides.

Same as us indigenous Mainlanders aka American Indians. If we go back before colonists. We all had land. But us indiginous dont think of land. Like European peoples. The land owns us. We dont own the land. So now its changed. Now we have to fight for the land that owned us.

Ali’i sanctioned the total pillage of ʻiliahi. They responded to an emergent market, driven by exposure to foreign activity. Why defend? That Kauikeaouli signed off on the Māhele was, while perhaps well-intentioned, also a response to emergent markets driven by foreign activity (the very concept of land as a commodity was new to kānaka maoli). Ten years later the law was changed to allow foreign purchase. This is how colonial power works- in phases. Shifting contemporary attitudes about the privatization of land hardly erases the reality of genocide level displacement. It comes off as a veiled defense of capitalism- of privatization. There will always be anecdotes of those who survive or even thrive in a hostile environment (ie Hā’ena) but exceptions do not make the rule. Rather than attempt to criticize those who see the end result of the Māhele as destructive, let’s put the privatization of land itself on trial. If the speaker infers some underlying, subversive principle intended to recreate a legal foundation for reclaiming land sovereignty, it was not clearly conveyed in this ad hoc lecture.

What's done is done, lands were sold and awarded. The question is what do we do with the information now.

You're Twisting Fact's about the Mahele...the Original Grantor's hold the Land Commission Award and from that it was granted an APANA (Portion of a Share, with a ROYAL STAMP, wording...Hoa'ilona Pai O Ke Alii) on the Document's Of the Proprietor's Intrinsic the Mahele and the SANDWICH ISLAND'S LAW'S Apply, NOT Everyone was granted the Executive Power to Manage the Land's, the Privy Council of His Majesty and the Makainana's are subject to the LAW'S with Privilege's for Reward's of his Toil (Work)...WAIPA, hope this clarifies the misunderstanding of Ancient base of Right (Kuleana)...ALOHA

I think you're conflating kuleana land with lca and RP. These are different lands and processes of acquisition.

You have the misconception of the Mahele...the Mahele contain the SANDWICH ISLAND'S LAW'S and the Form of Government is vested in the Na'Lii Aimoku, Alii Moku's (District's) and the Konohiki's are the Head Supervisor of an AHUPUA'A (From the Mountain to the Sea with Land, Water, Fishing, Hunting and Gathering Right's under His Control) under the Alii Moku (District)...the production of their produce or product was to TRADE with other Village's for HOME USE, NOT to SELL to HAOLE'S (Foreigner's, Any Foreigner, NO Discrimination) WAIPA
