Found this on the Bloomington newspaper website. It’s from Dec 14, 2022: “BLOOMINGTON - A Normal woman pleaded guilty to battery and DUI charges this week. Jahda R. Davis, 20, was charged in May with aggravated battery and resisting an officer after a traffic stop. She pleaded guilty Monday to one count of aggravated battery and one count of driving under the influence. Davis is sentenced to 92 days in jail, 24 months probation and 24 months supervision.”

Keeping a picture of your id on your phone is a good way to get your identity stolen. A lot of online vendors that run credit will verify identity with id, and if they take your phone and they have a copy of your id already.. bad times.

They’re not allowed to go through your phone without a warrant. Showing them a photo of your ID is not consent to search your phone.

Doesn’t matter if she texted her friend, “I’m so hammered, but yeah I can take you home. Meet me by my dad’s rental. We were planning to blow trees and smash mailboxes on the way home lololol.” There was no suspicion of texting and driving. The charge was drinking and driving. Which is now DWI. And she is indeed guilty. The half life of Xanax is on average 6-27 hours. And with her size I’d say she’s on the 27 hour end. And also needs about 7-8 hours to blow a 0.0%.

As someone who works in a large healthcare company in the southwest and has to take the HIPAA classes every year: 1. HIPAA does not allow the police immediate access to a person's medical records. An officer can't just walk up to any nursing station PC and get a print out or screen shot of toxicology reports on demand. 2. HIPAA DOES allow the officer, their associates, or the DA prosecuting the case to ask a judge to grant them a subpoena for your medical records that day. 3. While a blood draw at the police station may take months (depending on how backed up their lab is) to process, hospitals need to do those quickly for diagnostic purposes. We're talking minutes to hours, not months. 4. While alcohol will dissipate from your system in around 24 hours, your medical records will exist for years. I've heard around 7, but that's not a fixed number and can be much longer if there are valid reasons. The police and DA can take their time asking the judge for that subpoena. 5. While I am not a medical practitioner, I cannot comment the when and where a blood draw will happen. It is quite reasonable to assume that if you are hurt and in pain, they're going to run a tox screen so they know what's in your system. This is to avoid adverse reactions to any meds they might prescribe. You as a patient can refuse to let them do a tox screen, but that's most likely going to put any treatment on hold.

I have watched this a few times. I think her problems are - Did not understand how the rental car lights worked. Do not stand out. - Neither her nor the officer referred to the lights as "running lights" Learn to speak English. - She argued about everything. She got a DUI, then all that other stuff because she did not just take the running lights ticket. Don't sweat the small stuff. The same advice applies if you have a dead body in the trunk. You talked about the stair steps. You did not mention people want to get off the stairs. The great thing is she got rid of any drugs when she peed. Advice, if you are impaired just take the minor ticket and try to leave. If you get an improper left hand turn ticket because you hit a pregnant woman carrying a baby, do not fight the ticket. If you are a miniature girl, do not try to break and run from the back of a police car, after they have IDed you. Almost any guy can catch you running, or before you get the car moving.. Do not drive after drinking.

Love your channel! One thing I have to say: from her body language and behavior, her hands are not numb, she’s just trying to find a way out. There’s no real panic, no frantic attempts to move her arms, and not even a look of adrenaline on her face. She’s whining, not hurting or panicking. I’m only at that point in the video, but I’ll bet good money that there are no major injuries she can prove.

Her hands might actually be numb if she does have a concussion. Numbness could also be caused by respiratory depression, say from mixing alcohol and Xanax. Maybe she’s not panicking because she’s used to those side effects. Maybe she is lying but that would mean she has an uncanny knack for situational irony and foreshadowing.

In Florida, under 21 is .02 for DUI. For females, that's about a quarter of a shot of liquor. She's 20, so he isn't going to be wrong.

The delay here served a futile purpose. If she was 21+ that delay may allow enough time to get under .08. But no way will any delay will get her under.000.

Wow! She quickly turned a misdemeanor into a felony. That escalated quickly. My memory is not good, so I would never be able to memorize my license number. I also wouldn't feel safe keeping a picture of it on my phone. What I have is an online wallet that requires my fingerprint to open. It keeps my credit cards, picture ID (including my driver's license, and password all in one place. So, if I forget my wallet, I still have everything safe on my phone.

Derek: Thanks for a semi sequel to your Taylor Brown vs. Normal Police reaction. I recognized the female officer's "We are seizing your phone" voice immediately. Hopefully, the kid gets an attorney who may try to bring that defense at trial. "My client looks like and is similar age to Taylor Brown. Instead of helping her turn on the lights and be on her way, this department does nothing but escalate and escalate until they can get a black girl on the ground with multiple cops on top of her. My client recognized the abusive, unsympathetic, and civil-rights breaking officer(s) from the Taylor Brown video, and unfortunately, decided to flee for fear of them treating her like they did Ms. Brown." I know, I know, lawyer gets disbarred, the officer becomes assistant chief, and this girl will get 25 to life.

Think hard before fleeing from police in a car at high speeds. Just this week in one day six people were killed during pursuit, one was a FHP trooper. Two in Florida, 4 in Houston. The guy that was fleeing from the trooper in Florida was captured. He's looking at two 1st degree felonies possible 60 years and since it was a cop that was killed, you can be sure he'll get the max.

Yeah her tingling hands could be related to this alleged concussion orrrr it could be respiratory depression from mixing alcohol with Xanax. And she shot herself in the foot by saying she drank and drank while on Xanax which increases impairment. Then said she was taking a dose far higher than any reputable physician would prescribe which calls into question if it was prescribed to her by a doctor? Maybe she’s bad at decimals (0.8 versus 0.08% or 15 versus 1.5mg for example) , maybe she’s abusing her meds, maybe she’s self medicating. None of it helps her case.

This is one thing I'd like them to cover is the amount someone can drink to read a certain level on the BAC. Because here we have a female, who appears to be 115 soaking wet. She only needs two drinks in the past hour to be .08. Females can't drink and drive, they'll always test over.

New training course for High School and University students idea, how to ace the field tests. Followed by a training course on shutting the hell up once you complete them and refusing any further tests. If she had just refused the breath test, they would have arrested her and in court the defence team should have had a fairly easy job getting it thrown out. You could argue the ambiguity of if she admitted to drinking alcohol herself or just the rest of the car, and that she had only been drinking non-alcohol drinks all night. The phrase "everyone in the car has been drinking" can easily be argued that I misheard you and thought you were asking about everyone else other than me.

I can't state what the laws are in USA, but here in the UK if you are roadside breath tested (we don't do sobriety tests) the result of that roadside test is not admisable in court, but it is enough for police officers to arrest you for suspected drunk driving (DD) The results on the police stations calibrated mchine is the results accepted in court (or blood/ urine test whih is done by a medical nurse/doctor.) Refusal to take any test is an automatic failure,,,, you are charged with DD. and sentenced. Running away as this girl did, the police here would YES drag her out of the car, biting the police,,,, bad thing, but not the end of the road, she would more than likely be charged for the most serious charge and the rest of the charges would be taken into consideration, I.E a warning and a period that she will have to keep clear of any offences, if she breaks this, the taken into consideration charges can be added to these new charges. We don't have a tier system where you get a traffic offence, misdemeanors, felonys, here all of the charges are listed, evidence given to the court and the judge/ jury does the rest. She would more than likely receive a 6 to 12 month ban, £100-£200 in fines plus any expenses and sent on her way. We do not have our officers armed, we do have armed police who attend more serious crimes, but it is fairly normal that the criminals do run, they are caught (sometimes) but in court it is just part of the evidence stating we had to foot chase. Escaping or eluding in a car is dangerous driving. BTW the police here would not allow her to pee, it is against the law for someone peeing etc in a public place, so if our police allowed this they would be an accessory to that crime,,, so tough girl, you just have to pee your pants. But interesting on how different countries police in different ways. Why gont you do a video showing different police tactics between USA and GB? i love your videos, keep it up Ray

Ummm i’m not really at some colleges they will kick you out if you get a DUI. So for a college student especially for someone who has a clean record getting in trouble like this is a huge deal and then you also have to deal with your parents, family members because I’m sure she’s the type of girl that’s like goody two shoes in front of all the adults And not the most Cleanest girl on the up and up, you know what I mean like freaking the sheet style. But I understand this is the one thing that police officers have to think about. Human beings, naturally, when being restrained, or when you’re basically told that you’re going to have your freedoms taken away, it really messes with your head psychologically Especially if you’re not someone that plays around in the judicial system I actually felt really bad for this girl and low-key was kind of hoping she got away. Lol. I really think that the driving under the influence laws are stupid because not everyone handles alcohol, the same way Not everyone is shitfaced, drunk at .08 I have a buddy who is a functioning alcoholic, and he’s passed even the toughest FST’s but he’s rushing, so go figure lol. I know that they are there to keep people safe, but personally, I think they need to change these laws based on what the person blows rather than just have a set standard just my thoughts. Because she was not pulled over for swerving. She was pulled over for her tail lights. She was driving perfectly. And it was late at night. There was nobody on the road, but I’m sure some mothers out there would get MADD at me for saying this lol.

I memorized my dl # eons ago. Drinkers, trust me if you have been drinking alcohol. People who haven't can smell the alcohol from a good distance from you. J used to be a paramedic and trust me when you do this type of work for a minute you know that smell automatically. I walk into bar's now and can't stay long because of the smell and I don't drink and haven't in 30 years. Brush your teeth and get some regular fluids in you if you don't want everyone to know your drinking. Be good to grab a snack as well to get that pungent smell too chill out

Uncle Sam, "You ARE DRAFTED!!" But you can't tell your barkeep "draft".... MAJOR 14th Amendment issue. If you are 18 and an adult for everything including being given $5,000,000 tank to drive around a battlefield and killed in it except drinking (that list is growing), you're not old enough for that. 'But James, an 18 year old isn't mature enough to handle alcohol. he's not mature enough to be able to own a handgun, mature enough to understand the hazards of tobacco.' Yet he is mature enough to be given an M4 and the keys to a 120,000 pound Abrams tank? . And O.M.G. you're tell me college kids drink? Next you're going to tell me they like to have sex too... . no excuse for driving drunk or running but I think the drinking age is a 14th Amendment violation. But WHY did the officer not handcuff her? If it was a college boy, he'd be handcuffed.

I agree that drinking and driving is just asking for trouble. But I just have a problem with breathalyzers especially on the street 1) because anything could set them off: having a normal cigarette, something you had at dinner with a certain spice or seasoning and so on & so forth. 2) trusting your freedom to a flimsy piece of plastic just seems insane. And 3) if you haven't been drinking or taking drugs that would impair you just go to the hospital and have a blood draw. But if you look past the fleeing in assault on an officer and at the beginning of the video having a debate with the officer, what she was pretty good at, I'm sure a defense attorney like you all could have beat this case into Oblivion in court. It seems to me since the officers are so good at "at foxing people"that the best thing to do if you believe you're going to get arrested is to just assert your fifth amendment and be quiet and have somebody that can make several calls to find you an attorney to instruct a defendant on what they can and cannot do. That's just my personal perspective

The sheer level of ignorance displayed either intentional, or actual is infuriating in the first few seconds is annoying. With that said the fact car makers put daytime running lights in cars but dont also turn on the taillights is so dumb for this exact reason. I see so many people traveling with headlights but no tail lights. I dont know why there hasnt been a law to require BOTH to be turned on for DRL. But also dont get people who get a rental car and dont familiarize themselves with the car before leaving in it. You dont have to be a genius to figure out how light/bright switches work. They are pretty standard and easy to figure out in cars lol.

State ID no license. YOU CAN DIE FOR YOUR COUNTRY AT 18 BUT CAN'T DRINK AT 18. CHANGE THE LAWS IF YOU CAN'T DRINK AT 18 THAN YOU CAN'T JOIN THE ARMED SERVICES. LIKE MARINES, ARMY AND AIR FORCE. THE COP SAID I SLAMMED HER PRETTY HARD. DID HE JUST ADMIT THAT ON CAMERA😂😂😂. She was not drunk she did those test and passed with flying colors. She probably had 1 or 2 drinks but because of her age she should not be drinking at all. Running was a very stupid idea.

This video and analysis is useless. Of course you do not conduct yourself in such a manner. I don’t need three DUI lawyers to tell me that. Most of these videos are useless. They should show you investigations where the subject acts appropriately and is found not guilty in court. These idiots don’t care to explain that because they get paid either way. If you want to beat an OUI case you refuse a field test. You refuse a breath test and you conduct yourself in a calm respectful manner. If you are involved in an accident you request an ambulance due to a head injury. Again you admit nothing and you don’t give blood. You don’t ever give the cops any evidence. Show me a case these clowns won. If they did win it was because they had a good client.
