Rosh Chodesh Elul, shortly after the Borerus (ruling) regarding ‘Bobov’ was issued, I said that we will hear from the Gedolei Yisroel about the right thing to do, as per Da’as Torah (Rabbis knowledgeable in Torah). I asked the kehillah not to immerse themselves in this matter. I wanted Ellul should look like Ellul, with the tzibur immersed in Torah and Avodah. We assigned the dedicated leader who went around to the homes of Gedolei Yisroel and revered Rabbanim to ask their opinion in regards to obeying the verdict. Now I want to share with you what the Gedolei Yisroel said. The actual Borerus was incomprehensible to them, and every one of the gedolim used a different turn of phrase - several said that it is biased, others said that it is actually a distortion of halacha, while several used even harsher descriptions. There were even several amongst them who said that it is permitted to go to court to obtain a stop-order. One of the most renowned poskim in Eretz Yisroel, HaGaon R’ Mendel Shafran shlita, told me in conversation that “It is permitted to go to court to request a stop-order against the Borerus.” I asked him if I may publicize these words in his name, and he clearly replied that I may definitely do so, and that his words could even be recorded and publicized. Other Gedolei Yisroel told us to turn to a 3rd party Beis Din, considering that doubts regarding the viability of several Borerim that sat on the Borerus had been revealed, and we received a hazmanah (i.e. summons) from this Beis Din summoning several of the dayanim, as well as an ikul (i.e. stop-order on the borerus verdict). Since we have such widespread support against the Borerus, maybe it would be proper not to obey the Borerus that the Borerim issued. On the other hand, I fear that by not obeying, we will create a michshol (i.e. stumbling block), and going to court could result in chilul Hashem (desecration of G-d's name), fighting between one another. Nowadays, when the status of Batei Din in the diaspora is so weak, our disregard of the Borerus could cause the Batei Din to be even more degraded. There will be those who will say that in Bobov, the Borerus was not upheld, which means that one is not required to listen to Beis Din at all. This could chas v’sholom lead to transgressions. People will not realize that in our case, there was a specific heter, and they will allow themselves to follow our lead by going to court. This is extremely undesirable. Another hesitation that I had was that if we don’t obey the Borerus, it will cause the fires of controversy to burn even stronger. [end of Yeshiva world translation] The Mishna says: (Eduyus 5:6) Akavya ben Mahalalel ... he would rather be called a fool all his life than a Rasha even for one moment מוטב לי להיקרות שוטה כל ימיי, ולא להיעשות שעה אחת רשע לפני המקום - says the קדושת ציון (Rav Ben-Zion Halberstam of blessed memory) on this Mishna - that sometimes people make a big deal out of a money issues, and want to go to Court to fight it out, and a Holy man does not want to go to Rabbinic Court to fight it out, the 'Olam' (masses) laugh at him and see he will lose his money, he is scared, does not want the heart ache. But there is another possibility, the Mishna Avos 1:8 - Yehudah ben Tabai says that litigants who are standing in front of a Dayan - must be considered to be Resha'im (that he must cross-examine them, and not trust them on their word). But once have left the Beis-Din - must be considered as being righteous, provided they accept the Beis-Din's rulings. - The Almighty is present at the Rabbinic Court, and one must be viewed as wicked for the sake of fair judgement, so better to have the masses look at me as a fool than to go to Rabbinic Court. So even from one side that we might go to Court and win, but from the other side it might not be an Honor for Heaven, and better to be viewed as a fool my whole life, let them make fun, I could fight, but I don't want to be viewed wicked for even a second. The same Tanna from the Mishna in Eduyos in Avos 3:1- עקביה בן מהללאל אומר, הסתכל בשלושה דברים, ואין אתה בא לידי עבירה--דע מאיין באת, ולאיין אתה הולך, ולפני מי אתה עתיד ליתן דין וחשבון: מאיין באת, מליחה סרוחה. ולאיין אתה הולך, למקום רימה ותולעה. ולפני מי אתה עתיד ליתן דין וחשבון, לפני מלך מלכי המלכים הקדוש ברוך הוא. “Akavia the son of Mehalalel said, consider three things and you will not come to sin. Know from where you have come, to where you are heading, and before Whom you will give justification and accounting. From where have you come - from a putrid drop; to where are you heading - to a place of dirt, worms and maggots; and before Whom will you give justification and accounting - before the King of kings, the Holy One blessed be He.” The commentators say there are two distinct ideas, where we are coming from and where we are going. Many times men stand with two options and need to know the right way, from one side where are we coming from? When we have doubt, ask where are we coming from. The second thing is where are we going, what is the benefit of what we are doing? We must make these calculations of what the outcome of our actions will be. We must think what is the will of the Almighty. Commentators ask what is 'din' (judgement) and what is 'cheshbon' (calculation). Judgement is where we are coming from. I want to do this think, but must think does it make sense, but also we must make 'calculations' where are we going? Many times the congregation is not so strong, not the best, but they look at what they are doing, many times there are strong congregations, we should do this, definitely we must do this, but make the calculation, what is the outcome. This way we will not come to sin. This judgement and calculation will prevent us from doing what we should not do. But deeper, the last part of the Mishna is we will eventually stand judgement before the Almighty. A strong congregation, strong willed and the congregation annuls their will, strong congregations that force their will. The Rebbe of blessed memory had a great strong will, we know where we came from, we are trying to figure out where we are going. But certainly the last point (judgement before Almighty), we do not want to add to the fire of dispute. How could my Father-in-law of wanted such a thing. We know our path, certainly we should take the path of Shalom (peace) free of dispute. This is the Bobover path. With the help of the Almighty there will be a complete peace, that holds. What would have Grandfather, my Father-in-law done? I heard from my Grandfather regarding a difficult decision, a private matter, the Rebbe said when I have a difficult decision I think what would my Holy Father or Grandfather of done, how did my Holy Ancestors handle these type problems, that is what we do, this is the Oral Tradition (Torah She Baal Peh). This is Toras Moshe (the tradition all the way from Moses). So we should go with this path for Bobov-45, we don't look at them. I heard, one time by the first Ruv, a meal for Rosh Chodesh (the new moon), one man wanted to eat different from everyone else, meat instead of milk, he did not know Torah and was a trouble maker. The Ruv said we need a הכר (separation), the man said he was a 'Hekar' the Ruv said a הקר (trouble maker). We do not want to be trouble makers. We don't need to make arguments. My Father-in-law said in the verse in Psalms 65:2 - לְךָ דֻמִיָּה תְהִלָּה אֱלֹהִים - Praise waits for You - when we wait to do the Almighty's will and don't cause trouble, comes out the Honor of Heaven. We come back to Genesis 28:16 - וַיִּיקַץ יַעֲקֹב, מִשְּׁנָתוֹ - it is time to come together and G-d willing build further with strength and Honor of Heaven, and an honest congregation, us and all the other places. Let's get something very clear. A person who is willing to fight his own family, and involve thousands of people in the fight, in order to attain a "spiritual" position, does *not* give in to a Psak he does.t agree with out of the goodness of his heart, as is claimed here. He did so by force.
