The IRS has nothing to do with state sales tax. So you wouldn’t owe anything to the IRS. In fact, If this is a business vehicle, you could use the sales tax paid as a deduction and pay LESS federal tax to the IRS if you paid sales tax on the vehicle.

Not true. Try writing off that vehicle's registration and loan payments, and sales taxes for IRS tax purpose. State use tax comes up too. No intelligent Cars sales lot will allow you to drive off the lot as well. Dealers are required to ship the car to your registered state at your expense otherwise they may be responsible for your tax if they get audited, at the very least they will have you notarize a document indicating you are shipping this vehicle to "your state".

@SIat they don't convert to obd2 though, I have an R32 GTR and my friend has a cali legal R33 GTR. The question mark of the whole process is how they will adapt the R34 which is obd2 to Cali emissions and they successfully passed a GTT. They tailpipe test the car, and run extensive evap and overall emissions. But they don't convert them to OBD2 if they are OBD1 or OBD0

Many register vehicles also in Oregon, Alaska, Guam & US Virgin Islands & drive them here to avoid Sales Tax & Property/Excise tax as well.

We live in Alaska for 6 months and winter in Montana for 6 months. Registering in Alaska is less expensive for us. No sales tax, no inspection in Alaska also.

Regarding insurance. If you are retired and travelling the country. I would think you could make an argument to your insurance company that your 500K RV is ok to have Montana plates (or any other state for that matter) since you drive it all over the country. The argument that the vehicle is primarily driven where your permanent might be really doesn't past muster in that case. Thoughts?

If you have a business in Montana and the business owns the vehicle, how is that “illegal” and why would another state have any claim to taxes for a vehicle that the company bought?!

It really depends on the circumstances. If you have a business in Montana and the vehicle is used for business purposes solely in Montana then it is likely okay to do that. If you instead bought the vehicle and registered it with a MT LLC and you drive it elsewhere like in your home state, then penalties and taxes for use will be assigned.

Look at CA DMV code…. These guys are not dumb, the law states it must be registered where it’s garaged after it’s been in CA for 20 days. How will you explain CHP why you running MT plates with your CA license and address? Clearly you are not garaging this car in MT.

@@alexsimon915 well the good news is that in our wonderful state of California, especially LA county, we don’t have to worry about too much police pulling us over anymore as there is a few of them and there’s a lot of lawlessness going on. People running red lights, stop signs and doing takeovers with donuts in the middle of the day on the freeway is common.

The vehicle could be insured under a blanket insurance if you “own a dealership “. Could be an acre lot.

All you do is say to your insurance that it’s garaged IN CA but it is a Montana plated veh. Most insurance companies are fine, you have to be very specific and tell them that it is garaged in CA.

@@weemankyle When the car that's in your garage it is domiciled in your home state yet it has a license plate and is registered in another state. That is illegal in most states. Run it by your home state DMV and see what they think about it. Also what are you going to tell your insurance company about why the car is registered in a state a thousand miles away?

I have a good friend of mine that’s in retirement and moved to Montana and has lived there for two years theoretically can’t I give him the money and have him buy it avoiding the 7.25 % tax in California and have it under his name and he transfers it to my name as a gift so there is no transfer fee ?

Every single U-Haul truck in the entire country has Arizona plates. What is the specific legal difference between driving a U-Haul truck and driving a car registered to an LLC in Arizona (or Montana...)? In both cases you're just driving a company vehicle, albeit an out-of-state company. Is it because U-Haul's plates are apportioned?

Since the main benefit of Montana purchase/registration is evading state sales tax, if there is no sales tax to evade in your home state, there is no benefit to the Montana sale/registration.

What I wonder about is what if you bought and registered the car LLC in other state and then “bring it over” here and register in CA…. Do they still tax you? My guess is yes…. Though not even sure how the hell it is legal at all since veh was out of state by LLC that has nothing to do with CA

You would need the appropriate level of insurance to meet the minimum standards where the car is registered. You may choose to have the car registered in Montana, and then you will need to comply with those registration requirements.

If you're living in Montana for a period of time, you would not be subject to the same risks as someone registering the property in MT and then using it 100% outside of the state of MT.

What about using this strategy to register a kit car like the DF Goblin. They can't be registered in all states so many use the montana loophole to just get it registered. Is it more or less sketchy using this strategy for a kit car than a high end car? Also, these kit cars sell for no more than 25k most of the time.

Many states have caught on to the loophole of registering vehicles out-of-state and have passed laws that effectively close the loophole. As a general rule, we recommend registering vehicles in the state where they will be primarily operated.

I don't ever recall my insurance asking about where my car is registered. They just want my VIN and my address. That's it. So I'm not sure why the insurance would even need a Montana address which is what some claim will trip them up. Just give them your home state address. If you own the car outright I don't even see why they'd ask for the title.
