What are the restrictions applied to the open market's buyer after the purchase of the property, where the seller is selling out the council house through right to buy letter and to the open market? Is there any obligation/ restriction applied to the ownership of the property to the open market's buyer from council after the purchase?

I am in a city where it is predominantly 'right to acquire' most of the houses have been given to housing associations and if you want to buy its only 5 to 9k discount. Its a shame because houses are not affordable now in any area and discounts should be higher.

QUESTION: I have lived in my house 10 years when I moved it was a total mess some can even consider it not suitable to live in none the less I put tens of thousands of pounds £££ decorating and refurbishing..... so my question is when they VALUE the property do they take that into consideration and valute the house the way they gave it to me or the way it is now?

hello mate , my nans 79 she can buy her house for 44k its worth circa 130k - she has around 40k in savings - is there a lender that would borrow her some of if not the majority of the amount required to buy ? she is retired on a pension around 1k a month ? Any advice would be appreciated

These 3 years do not have to be continuous and could have been in different homes with different landlords. If say the house is worth 150k and you qualify for the 52k discount, you then use that discount as a deposit.. is it possible to release some of that equity at the same time to use to improve the property?

Question: If my partner was added to my mum's tenancy for 12 months could he then buy the house with the max discount as she has lived there over 15 years? Also could he buy the house himself or would it have to be joint in her name? Thanks!

Yes he can be on the RTB document after 12 months but this would need to be joint I believe to get full discount and the property would need to be bought with all names named on the RTB doc

As to 'you don't have to ask the Council if you want to make any alterations' .... well, because most Council houses are on a Council Estate, there will probably be a few restrictions already placed on the property when you buy it, since sometimes the Council do not want the general view of the area changed - this will probably depend on where it is, of course

Why would you do it? Say goodbye to free old age care. Am also assuming that you're then not allowed to sell it on, at market value, banking the cash, whilst everyone else has to find a big deposit and endure large monthly mortgage repayments for the same size house that you got cheap?

I would not do that coz it defies the whole purpose of RTB. Buy it then pay it out within 10/15 years or something, think the logic behind RTB is to help poor Tennant's who have lived in these homes for years, my neighbour has done since she was born she's now 70+, still cannot afford RTB, house will be going back to council when she ykw. Her daughter will not inherit the tenancy coz she inherited from her mum. I'm tryn to see how I can help both of them

I did the rtb1 application and all prosess just flopped today after two extended periods of time. My lander asked for fire risk assessment exact date from council, but they won’t give us it just they give due date. So after about 10 months and £900 application fees wasted. Now I need to restart again but not sure if same problem will be again. I’m so disappointed with my solicitor and lander.

My mother has applied for right to buy,, she has been sent the price with the discount applied. At the minute she doesn't have enough money to buy it and I can't help at the minute as I've just purchased my own house. Would she be able to re apply in 12 months or is there a time limit on when you can reapply?? Many thanks

Some banks and brokers say that the law has changed and that for a right to acquire mortgage you need a minimum of 25% deposit on top of the 10k discount from the housing association. Is this correct?

You just get a mortgage for the amount you are able to buy it for. That’s it really and the discount becomes the deposit. In reality it doesn’t exist

Actually, I doubt it, as they are probably not named on the lease/tenancy agreement, but I may be wrong but I have never dealt with the children only the parents . . . all you have to do is contact Council and they will tell you - good luck ✔👍🏠

I would like to buy my council property but recently found out that my husband did not add my name on the council contract or paper work. I was in hospital when we got the council property and he added his name only. We live in the council property for 12 years and I have always been the one making rent payments. Anyways been told I can’t buy the house as my name is not on paper work and can only go through him. We are married in community of property so thought the council property would be automatically be on both our names.

I think it is still possible to add your name to the tenancy, as this has been your main and only resident for the past 12 years. I would advise that you go back to the council and ask that you would like to add your name to the tenancy and what steps do you need to get this done. Find out what the grounds were for him to get the tenancy in the 1st place in just his name alone? Did he apply at the time as a single male occupant? I'm a bit confused. Anyways, keep asking until you find the answer. Perseverance is the key! But I would also suggest ofcourse, that you speak to your husband about this and hopefully he will be on-board about the whole thing. Try not to make it a big deal and fall out over it (although what he did does sound underhand, but this could have been a simple mistake on his part at the time). Good luck. Wish you all the best!!
