When you build the house you might find its worth less than it cost to build it. I built a house over three years recently but i did a lot of labour on the project. It cost me 120 euro to finish everything that included a kitchen and tiling and wardrobes well beyond a builders finish. To build a new house now costs anything from 200 euro a sq foot and upwards. Anyone including an architect or engineer that tells you anything different is bullshitting you. After all there in on the whole thing aswell.

In relation to drawing down in stages after the work is complete and the construction contracts act which entitles a contractor to be paid every 30 days, does the release of payment in the stages prevent a builder from being paid monthly If he has not completed works to a certain stage such as wall plate?

No, the bank won't care. They just want their money back and in the meantime to have their charge on the property.

Hey, Terry I want to build a rental on my neighbors garden without paying for the land my neighbor owns and have my company have ownership of it, in return for my neighbor supplying the land the company would be obliged by contract to pay a percentage of the profit from the rental property to my neighbor. Would this be possible? Can my neighbor sell the site to me for 1 euro to avoid gift tax because he knows hell get rental income from the company?

Yes, anything is possible. Whether it is advisable or not, or whether there is potentially complex taxation and legal issues, would probably justify you going to a solicitor for advice 😉

You need to buy a site, unless someone gifts one to you. Buying is probably more likely😉

Is there ever a scenario that you can be granted PP even if you don’t meet the local needs criteria. I’ve lived in my area for 8 years but now looking to build as with growing family our current house is too small with no room to develop. There is some land for sale in my area but very little houses that we could buy.Any idea as to what I options I have. Thanks

Yes, but I would not like to be counting on it. You should arrange a pre planning meeting with the local authority. They will give you a good indication of what will be accepted and what won't.

is there any indication for ppl not form Ireland how much "additional" costs one "must" incur (as in architect, permit help and solicitor?) also is there a place or a book that will give us information as to what we need to look for if we buy a site regarding "zoning" or permissibility of building at all (we are thinking about a tiny house/very small house which should ideally be "on grid" but also function off grid) will you book on house sales (we are both lawyers ourselves but our education is german and american) be helpful in such a circumstance?

I am not aware of any "self building" book in Ireland, although there may be one, which would give you this information. All I can tell you is you will incur 1) legal costs 2) planning/architect/design costs 3) contribution to the local authority as part of your grant of planning permission Planning laws here are strict enough but if you buy a derelict property which has been used as a residential property in the past you will be in a stronger position than if you bought a greenfield site with a view to getting permission. This is difficult and slow.
