How can he cause them problems?.... Officers have "qualified immunity", therefore if they act by rules, he can not cause them problems. @@McCucumber The sergeant isn’t corrupt, and that’s not what he is saying at all. Pay more attention to what he actually said, and in the context of the previous dealings. They’re not worried about doing something wrong and getting held accountable, they simply know that nothing that they say to him is going to make any difference because he won’t hear anything from them, and they don’t want the aggravation of getting dragged in to a confrontation with somebody who is looking forward to the confrontation in the hopes that he can provoke them into making a mistake, and will give them all sorts of grief in the process of trying to do so - Especially when, again, all the headache is not going to do anything because he won’t listen to them.

Haven’t gotten to the arresting a cameraman part but the Sgt was right in that the eviction process needs to continue and no crime was committed. Around the 10 minute mark the Sgt made some good points. Again not sure about the person on the sidewalk yet but agree with the leaving dude alone for now.

Wow! That Sgt weaseled their way out of doing a public service. There was a disturbance that could lead to future disturbances... and the Officer (to his credit) decided that at least talking to the cause of the disturbance could help (just like the Police do at multiple other assignments). It sounds like Benzino raised his voice, was verbally aggressive, is known for his aggression, and caused the staff to fear for their safety, ultimately causing a disorderly public disturbance (dunno why the Officer didn't articulate that to the Sgt, though he probably thought it futile). That's potentially enough for at least a Disorderly Conduct investigation (I know that's a vague offense, but the Officer has discretion whether to investigate it for a full report... or to resolve it some other way). Sarge comes along and undermines the Officer's discretionary decision to resolve it by talking to the problem. It would be different if the Officer would have made that decision on his own (still a bit questionable if he had, but acceptable discretion), but the Sarge stopping those wheels in motion is wrong. Sadly, that Officer may now second-guess similar decisions in the future. And the Sgt asking "But it's not something YOU witnessed?" (8:16) is a COMPLETE cop-out (pun-intended). Just imagine if you call the Police for something, even something as minor as a Disorderly Conduct, and they say they can't do anything because they didn't personally observe it (unless the Police have cause not to believe the complainant's story). As long as the Police have a credible, cooperative complainant/witness to the Probable Cause of an offense, they can investigate further, including interviewing the suspect.

Raising your voice is NOT illegal, being verbally aggressive is NOT illegal and being "known" for being aggresive is not against the law! Dude the Sgt was right on this one!

Please look up the legal definition of "public place" and you will find it means " any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, and shops." Any member of the public can stop in that publicly-accessible area and inquire as to rental information. So it IS a public place. EDIT: Georgia statute 16-1-3(15) specifically defines "public place" as "any place where the conduct involved may reasonably be expected to be viewed by people other than members of the actor's family or household." (Thought you looked up each "statute in that city.")

@Cipheiz Yes, the Police CAN trespass someone "without a prior written agreement." They can act immediately on the word of a representative of the property... and there doesn't have to have been a crime committed to do so. But there is a conflict when that property includes a place where the person resides and where his rental matters need to take place. THAT'S why the management couldn't make that decision in this situation. Here, they'd need to have a court address and decide if he needed to be prohibited specifically from the office area and not other areas... or if they just needed to continue with the eviction. And I like how you proved yourself wrong with "the Police did talk to him a half hour later." Why? Under your skewed thinking, what gave them the cause or authority to do so? Maybe he should sue the Police for "talking to him" without "reasonable grounds."

Brilliant, mature and highly experienced Police sergeant. The critical question is ... What law did Benzino break for which he ought to be confronted by Police.... the answer is NONE. Second question is..... is Benzino wanted by any Law enforcement agency and did any of the rookies check .... the answer to both is NO. What is then the basis for the confrontation or intervention by Police especially with this man's long history of flipping the narrative with law enforcement?? Could their efforts and time be better devoted to more serious and perhaps dangerous situations than this ??? I say, yes. The Seargeant should be training other Seargeants and officers.

Well done to the Sergeant, for being both sensible and Legal. I am a big dude and if someone pisses me off and I start venting I am not breaking the law just because you feel scared, sad, happy etc. the police are not here to protect your feelings as being upset or angry is not a crime. Its so very sad reading all the comments from as bunch MOFO simps, manginas, pansies and snowflakes in the comment section, all of whom seem to be urging the sergeant to intervene on the side of the poor little white women who does not realize that you cannot trespass one of your sitting tenants (even if they are big scary latinos) from the apartment office just because they get irate. You can just see most of these young officers itching to take the side of the women by going to talk to Benzino, but what exactly where they supposed to say to him "Please dont talk to her in the manner you talk because it scares her?". Police are not commercial mediators.

He did the right thing for the wrong reasons. 10:35, basically what the corrupt sergeant is saying is that if this wasn't someone with fame and fortune and the ability to hold them accountable, then by all means, harass and intimidate or possibly illegally arrest him, but since this guy has money and the ability to hold them accountable for their actions, "don't do what we usually would do" Exactly what is expected of "law" enFORCEment in this day and age. Absolutely no integrity.
