After watching this video I wanted to see what my state say about where a officer is allowed to be. And ran across a story where a officer at midnight saw a car in a driveway with its lights on. Then the officer a hour later saw the headlight still on. So he block the driveway and saw urine on the outside of the car. Then he went around the the passenger side of the car and saw a person slumped down asleep in the car. The officer arrested the man in the driveway for a DWI. Even though he had no proof that the person was out driving the car on public roads.

However I've always though, well if they break them and the requirements were not met, there should be no such thing as immunity. If you break into someone's home, for no reason, assault two people, for no reason. Then show no remorse. You should be held to a standard of the law as a normal citizen. @@soultrex9722 To clarify, it's not State law that differs, the diff is between PUBLIC and PRIVATE property (ie Wal-Mart etc are PRIVATE entities). The ACTUAL ISSUE raised here is a CONSTITUTIONAL one. Ie, pertaining to citizens 1stA rights in PUBLIC areas. You need to get permission in PRIVATE locations (which can charge a fee if they so choose), but you cannot charge a fee or be selective (as in issuance of permits), for 'access' to Constitutional RIGHTS. Hope that helps! Cheers.

@kriscynical Yes, of course! Permits back then were literally printed by the store managers and signed after they bought something too 😂. It was done this way because these stores owned the parking lot and the store permits helped the stores manage/secure their property. So according to the Supreme Court of Pennsylvania, if a police officer gets intoxicated, crashes his patrol car into your house, pulls down his pants and urinates on your floor, and then tells you that you're under arrest for cattle rustling, doing anything other than respectfully allowing him to handcuff you will result in a resisting arrest charge. And it will hold up in court even when the officer is arrested for all this misconduct and your cattle rustling charge is dismissed within the hour. You go to jail for resisting the lawful commands of a peace officer.

@@buckeyenative1365 that is what is wrong with our court system...too many times you hear of a court challenge being made but the appeals courts refuse to make decisions and kick it back down to the lower courts...so many times they could have settled case law but instead refuse to do their jobs...we need to wipe the slate clean, get rid of ALL federal judges all the way up to SCOTUS, and take the power of appointment away from the President and Senate as we see that has HUGE holes in it that can violate the constitution. Make all new applicants go thru a rigorous background check, and if they are not able to pass the same muster as our military is to get a security clearance then they can't be judges either. Then voters for each district vote for their federal judges with 10 year term limits on the bench, if they are judges at a lower court they can apply for judgeships at higher courts....same goes for SCOTUS...10 years max, voted on by the entire United States....have the terms spaced so that we vote 2 to 3 new SCOTUS judges every 2 years during the regular elections.

All cops in this video have no HONOR, no RESPECT, no COURAGE, no INTEGRITY. Their families and friends back their actions in this video.

Absolutely! Usually in these situations he says something like “I can’t reasonably give a grade to someone dealing with issues beyond their control” or something like that

ATA grades are partly based on people’s legal standing to do what they do in videos. Because it’s illegal to resist an unlawful arrest in PA, dude isn’t going to get an “A”-dude also talked way too much to the police. The whole point of this channel is to educate citizens and law enforcement on how to behave in these encounters. If ATA were gave this guy an “A” it could give the false impression it’s okay to resist police in PA.

@@jadoolit you don’t know much about mental disorders and it shows lol also I am pretty sure ATA said that the officer DID NOT have a reason to go into the home therefore “it could be said” that the guy didn’t resist a LAWFUL arrest. But when you aren’t 100% there it’s really difficult to make sense of what is going on around you. Who are friends vs foes, and we are raised to think of as cops as friends until they prove that they aren’t. So when he isn’t 100% there he reverts back to childlike thinking which makes him feel like that the cops are friends. (They can also get angry - they’re less fun but still in need of help) He also just thought it was a misunderstanding and that if he explained what happened to another officer that they would help him. I don’t think he should have been graded at all because he wasn’t in his right mind.

Imagine getting upset over a grad that means nothing given by the opinion of a show on YT. Man, I'm glad my life isn't that sad.

This cop is a lying pos. He forced his way in that home without anyone asking him too or anyone needing help. This male is the caller. No emergent circumstances existed here. LAWSUIT!!! DONE

In the second video I don't really see the man "resisting". I see him blocking the entry to his home from an intruder and trying to shut the door. The cop went hands on when he wasn't able to just walk in. The man wasn't told he was under arrest or being detained. So he definitely wasn't resisting arrest. He wasn't resisting a lawful duty because the officer had no right to enter the home. So a person can't stand in their doorway or try to shut the door without being arrested for "resisting"? That's ignorant.

Exactly. But Mr. ATA says, “Accordingly, it is certainly possible that the resident could be convicted of resisting for his actions.” Whaaat?? And then he was being choked by the officer after being taken down! If that’s not a case for self-defense, what is?

That's why the cop went to immediately saying he heard screaming. To get entry rights from exigent circumstances, which would hold up. But the camera doesn't lie, so he has no reasonable evidence for his actions. So he's trespassing, using excessive force, and likely falsifying police reports.

@@NearlyFullyFree yeppers, I hear that in a lot of this type of video. They generally do NOT get good grades due to facts like that.
