Main point for the Trust is for Real Estate. Bottom line other assets such as bank account and brokerage accounts, we can use TOD or POD without being put into the Trust. Personal items can be put into your Will. Keeping assets accounting sheet private and not disclosed in the trust. Is this the simplest way ?

What about this: 1) own a house -> do TOD 2) $$ in the bank -> designate a beneficiary 3) IRA -> designate a beneficiary. That’s it.

Thank you so much for sharing your knowledge and experience. My husband and I are in the process of starting our estate planning. Our assets are our home, bank accounts and one 401K. Our home is owned by our two year LLC. You've convinced us NOT to create a will. But, what would suggest: a revocable or an irrevocable trust?

Very informative, thank you. You say a living trust needs to be funded by transferring ownership of assets to the trust. If I have a brokerage acct in my name containing stocks, and my spouse is listed as beneficiary, don’t they get the step-up cost basis of the stocks when I pass? If I transfer the brokerage ownership to a trust that is in both of our names, does my spouse lose this cost basis step-up value?

I am thinking of WILL WITH all everything to one daughter so as to avoid probate problems to her, I have no trust funds, just home and personal property. Can I do this in a simple will? Could I call you by phone if need to arrange for you to help or prepare it. __ Paul Shepherd in Maine. I'm 89.

The problem with an inventory for the court is that it becomes a matter of the public record. I don't like that....people knowing exactly what my heirs have.

Is there a difference between having the living trust owning the assets vs. listing the living trust as the beneficiary of the assets?

We use NOLO to make our will and assorted documents for estate planning. We have health issues and are in 70s. Beneficiaries will not include my son who has never been respectful towards us. Can we simply list the beneficiaries with percent allocation and not mention him? Or do I need to state clearly zero for the son? We live in Texas.

a matter to digress upon is the fact that different states have vastly different laws pertaining to will, inheritance and estates. i am in Louisiana and have been amidst an embroiled estate/inheritance situation for 5 years now. general info is far from the what is actual unfortunately.

I don't understand how probates get so lengthy. Is it family squabbles that cause delays? I read that someone was searching for beneficiaries for years. Why no time limit on a search. Move forward. If a beneficiary is out there, that person must cone forward on their own and file necessary paperwork. Death notices are posted public info. Delays just enrich the lawyers.

Other than having a pour over will (with a trust) why would anyone get just a will over a trust? Are there any advantages?

@@art_without_borders - I think it’s worth the small price difference for the disproportionate benefits you get from it, at least in my own opinion. Going through probate court will probably cost you the price of 10 trusts or more. Plus probate takes a long time and is public.

@@MrChuckwagon55 Then I completely misunderstand the issue. I thought if you had a will, and if you only have estate properties and $$ in the banks/IRAs, you do not have to go through the probate. Plus, I like the idea of having beneficiaries on all my accounts. I was told by my banks it is superior to designating somebody in the trust/will. I also like the idea of "Transfer Upon Death" for my property.
