Being an informant is some of the most grimy AND dangerous things you can do. I knew a girl who was MAYBE 104 pounds soaking wet. She got hooked on cocaine and heroin (speedballs) and got busted. These cops basically threatened her into snitching and sent her into a house FULL of gangsters and heavy artillery to make a “controlled buy” and often times (according to her) the dealers would literally frisk you or force you to shoot up in their presence. She did. So the whole situation is screwed. She still gets to get loaded, all while putting her life on the line if she got caught being an informant, just to give some drugs to cops who didn’t have the balls themselves. They had to use a girl who was totally helpless. NEVER be an Informant. Tell the cops to shove it up their ass. Get a good attorney and fight it like everyone else. I will forever hate those cops who did that to her.

Can a police officer open your door while your asleep at a gas pump after he clearly sees your responding to his voice and then discover meth on the floor of your car, then proceed to not make an arrest or write a ticket, and then sends you on your way after he asks for you to become an informant. Then several months down the road after you won't answer his calls, he then put a warrant out for your arrest for possession of meth. He was the only responding officer to I presume a medical call. I've denied all along they were my drugs. Can I call this an illegal search and seizure, since I had never gave him permission or open my door, nor did he have probable cause? I was already parked so I wasn't pulled over, he gave me all field sobriety tests that I passed, and he never presented the narcotics to me, as far as I know he planted them.
@GustitisLaw
5 жыл бұрын
Thanks for your excellent question. My first advice is to challenge ALL searches as illegal. Never assume a search and seizure complied with the 4th Amendment and your applicable State law. When you challenge a search, that places the burden of proof upon the government to PROVE the search was legal. Next, let's analyze the facts as you presented them above. (1) If you are asleep behind the wheel, parked at a public gas pump, my guess is the officer has the legal right to check on your well-being as part of their community care-taking responsibility. (2) If the officer then saw suspected drugs in plain view inside your vehicle, he was legally permitted to seize those suspected drugs as potential evidence. (3) The police have the discretion to arrest or not to arrest on scene, especially since they had yet to receive lab results on the suspected drugs. (4) The police also had the discretion to ask you to become an informant. Whether you cooperated was up to you. (5) After you refused to inform, and after the lab results came back positive for Meth, the officer then could obtain a warrant for your arrest since he now had probable cause. (6) Your "ownership" of the drugs was irrelevant. All that's important was whether you knowingly possessed the drugs. (7) Not knowing about the drugs is a legitimate defense. Please speak to your defense attorney about how to leverage that defense in the case. (8) And again, challenge ALL searches and seizures as violating the 4th Amendment and your applicable State law. Good luck in this important case!

@GustitisLaw

You don't want to hire a lawyer who represents other persons involved in the same incident for which you got into trouble. That is called a conflict of interest and defense lawyers will try to avoid these conflicts whenever they identify one. If your defense attorney is simply representing other people charged with similar crimes, that just means the lawyer has a lot of experience with that type of case.

You should consult with a defense lawyer for the following reasons. First, the lawyer will evaluate the facts to determine whether you have any type of factual or legal defenses. Second, you need to know exactly what you are getting in return. Third, you need to have an expert to review the CI contract to understand both party’s responsibility in the deal. Fourth, you must have your lawyer explain what will happen to you if you fail to abide by the contract conditions. Sorry, if you want to make an informed decision about whether you want to inform, that’s what you need to pay for. Good luck.
