Kuongeza tu kidogo, it's important to: -confirm that there are no restrictions imposed on the use of the property or any competing rights by third parties, -check the permitted user of the land, -confirm that it is not on riparian land or on the Ndungu report, -ensure that there are no pending or imminent court cases, -confirm if any notices for compulsory acquisition have been given by the NLC or (depending on location) applicable authorities... etc -you want to also confirm whether or not the title is challenged at the registry (this doesn't necessarily show up on the search) -if you have cause to be suspicious, you may want to do further investigations on the title (see how it was obtained in the first instance, fraudulently obtained titles will return a seemingly okay result but are liable to be cancelled in future) -IMPORTANT: once you receive the search results you need to confirm that the entries at the encumbrance section match your expectations and that none are outstanding. -depending on the kind of title you are getting and its location, you might need to get a few consents for the transfer and pay the Government imposed costs

Hi bro normally banks do not accept to pay full amounts until a transfer has been effected...however banks are the best because they know how to do their due diligence..

Banks usually register a charge (mortgage) against the property on the title as a security. The title must first pass to your name (assuming that you are the one who is borrowing) before they can charge it. Transfer of the title and registration of the charge should be done simultaneously. If the title to the property is defective, untrasferable or unchargable the bank would have no security.
