Congrats! Check with a local apartment association to see if they have an estoppel form. A local real estate agent may have one, as well.

My lease does not require that I sign it. If I do, will I sign away rights to pursue litigation, insurance claims, and rent reduction? The owners of my building are very much aware that I'm pursuing all of this due to their gross negligence which caused significant and permanent damages. City housing authorities have been very involved so there's substance. I think they want to sell the building to try to evade responsibility.

Thanks for the support, Robert! You can get a copy of the rental agreement from a real estate agent in your area or join the local apartment/landlord association....they will have a similar lease and it's worth the price of admission to stay up to date on the paperwork.

Do terms on a signed estoppel, being a newer document, supersede a lease’s agreements for utilities? Example: The original lease states utilities are paid by tenant, but the estoppel states water is paid by land lord. Who would pay for water the new owner or the tenant? Thx!

The rental agreement is the boss here...the estoppel is just supposed to confirm what's in the rental agreement. If there's a discrepancy, fix it before the property sells.

@@WIREassociates thank you The problem/ confusion is the house has now changed hands and the old owner paid for water even though it states otherwise on the lease. The estoppel confirms the owner paid for water.

My landlord gave me a 60day notice 30days ago I discovered threw zillow that this house has been sold for cash a couple of days ago does a estoppel mean anything now Sounds like the buyer bought this property in the AS IS condition category I'm I correct.

Sounds like it's too late for an estoppel in this case since it already sold and they didn't have you sign. You could reach out to the new owner to see if they want to fill one out with you.

What is the estoppel does not list any plans for deposit information?

The estoppel has a section for the security deposit amount. You can add anything else you'd like on the estoppel.

Just wanted to let everyone that if you live in San Bernardino County if you received an unlawful detainer beware the court in Barstow is shady as hell. My landlord reason for eviction is withdrawal of property for purposes of selling property which they can't evict you for. I filled out an answer and turned it in to get filed and the clerk rejected the filing and didn't state why it was it was rejected in the computer system. I didn't know that when the clerk enter the information on the unlawful detainer into the computer system that she didn't enter it correctly. She left out my Fiance's name. So it was on the unlawful detainer but she didn't enter it in the system. So I had to file another answer once again and she rejected the filing of it to claiming that my Fiance isn't a party named in the case I told her that odd because his name is on the summons that was served and she argued with me saying his name wasn't on it and I know for a fact it was. So because she let is name out when she entered it in the computer system that caused my answer to be rejected twice and because the server lied on court documents saying that they served us documents to they never served on us the landlord talked the clerk into entering the clerks judgement for a default and it resulted in a sheriff leave a notice to vacate on my door. Once again a shady ass slumlord get away with an illegal eviction and gets away with owing a tenant money for repairs that the tenant paid for because the Landlord refused to do them and they had to be some

@Stacy Lirawell filed ex parte motion to quash write motion to vacate default judgment motion to stay. Went to court and the motion was granted. So I got the lock out stopped. Trial is next week I would like to have a lawyer with me but it seems like every time I call ICLS all they want to do is email me more papers and that's not what I need. I need them to represent me next week. Looks like I'm on my own
