I have found many clients want the attorney to choose the actual investment. Obviously, this cannot be done. They must research the investment as they would any other business.

I have pity on you IQ Arthur! Majority of EB5 applicants ARE AWARE of all what you told , they know their money can be gone... their intention is to secure a GB for them and their families. A middle class, daily wage or a single mom will not invest in EB5 ever ! its meant for millionaires and filthy rich who care a dime for the investment amount . Their primary intention is to get a GB, PERIOD. They have enough wealth to buffer the loss at the expense of GB. The audience of your video are well to do and super rich, they care a shit for this investment amount

Hi Art, I find your videos very enlightening and also fun to watch. I am a lawyer in my home country of Venezuela and given the fact that we are currently experiencing a lot of political and economic unrest, I have received quite a few questions from friends and family regarding US immigration policy which I knew very little about, and by watching your videos I have been able to shed some light on the subject and hopefully steer people in the right direction. Do you have offices in South Florida or some other attorney that you might recommend in that area? And/or Is it possible to do L1As and E2 Visa work from a distance without a personal consultation? Arthur is dead wrong for one clear and present reason: the USCIS presumes guilt on the issue of applicant's longterm intention to not return home. And they admit it in print. That means quite simply that after a certain but indefinite period of full-time "temporary" immigration status, they will deny your renewals or extensions on the basis that you appear to intend staying in the US forever, and that is prohibited under all classes of non-immigrant visa. Almost all valid non-immigrant visa categories preclude even applying for permanent residence while holding that status. Not to mention that even if you have a valid non-immigrant visa stamp in your passport, the border agent can still send you back out if it looks like you are abusing the "temporary" nature of the visa. It is surprisingly common for border agents to send a nonimmigrant visitor to an interrogation room and threaten deportation either now or on your next entry. And then who is going to manage your business, take your kids out of school? How do I know this? It happened to me and I know plenty of people who have been scared s---less in interrogation. Arthur knows nothing about the reality of permanent access to the land of the free...except that he was born with it, and makes money off people who crave it but who will not achieve it through his auspices. He is the fraudster...just deals in smaller denominations.

Klefco LLC -- if your (who knows what you really mean?) unfocused and poorly communicated blather expresses a concern about the temporary nature of the E-2, then you are dead wrong and possibly a fool. Sure, the E-2 is a temporary visa. But only a dimwit would leave a client in a temporary category with no end game. Only a SHORT-SIGHTED lawyer would do this. In my world, the E-2 leads to a green card. If you cannot fathom how I do that -- how I make the green card a reality from the E-2 -- then you lack the ability of critical thinking. And your IQ, if you are lucky, is about average. Do you find that challenging situations at work, that require thinking, are simply beyond your abilities? I'll bet you do. You seem so ill-informed, or you are so transparently greedy, that you use as a crutch your personal bad experience to attack my excellent service offered to my clients. You know nothing about me -- and you surely told us NOTHING about yourself. Are you in EB-5 investment sales, or in EB-5 law? You must be, if you imply that the EB-5 is superior to the L-1 or an E-2. You need to disclose your motives. Do you sell EB-5 investment schemes, for a huge fee that you pocket? Be honest. Are you an unscrupulous lawyer charging investors outrageous legal fees for an EB-5, instead of telling them about the more frugal and more common-sense E or L that they COULD have gotten? I think you do, but you haven't told us. There is something you are hiding. You are more than likely the fraudster here. Your level of unease with my ideas indicates that they threaten you. Good, I hope my ideas do threaten you, because I will always put the client first -- the human being -- and I will bet you are a sleezeball investment broker or an equally awful greedhead lawyer who puts the almighty Dollar first -- bilking the innocent. Pipe down, listen, and learn. And I am pleased that my ideas threaten you.

Wow i always like to research on the negatives on Eb-5 before sinking money, money that can be used for many things. I've done it all F-1, H1-B Eb-2(15 years since I'm Indian) Family based(15 years since I am Indian, however since it is not tied to a company i will get it when I am older phew) ,.... Eb-5 is the last shot to see if i can get the American dream(sooner)

Great video, however, in my opinion, the EB5 Immigrant Investor program is one of the best tools out there. It's legal and permanent, I see it like killing two birds with one same stone. Anyone with 500k to play with has more money and for this amount of money they can solve a few serious problems or situations by moving to the US. They might have a security situation, like kidnap or violence like countries such as Venezuela, Colombia, Brazil, and for half a million they can potentially move the whole family and establish a new future with money they already have. Or it might be to lead a successful path in the US for their kids, by entering to Elementary, Middle, High Shcool and then College with In State tuition fees. Instead of International . As you mentioned one of the key components of this big transaction is choosing the right project, doing one's homework to compare them and choose one that minimizes certain risks. In my opinion, small projects are the way to go.

Hi Arthur, Great video.. you are an entertainer too which makes you different than others along with great insight into your area of work. Here is the question for you: I am based in Canada and we will get Canadian Citizenship by 2017 end. My wife is a hair stylist in Toronto Canada and we would like to move to USA on E2 visa. We have some friends in Indiana US who have a beauty Spa that they are trying to sell. We have savings of of around 300k but would like to invest not more than 150k. I don't have much details for the Spa i mentioned in terms of profitability Question: 1. Can we just buy half of their business (not sure about the value of the business though) and get E2? Can we partner with an existing US owner and still get E2? If not, we can buy the whole business. 2. do we have a strong case because of my wife's experience in the same industry? (2 yrs or so) 3. I have approved I140 from my previous employer as i was on H1 visa in US. Can i use my priority date if i get another job and H1 again?

The whole purpose of the regional investment companies is for them to be able to raise capital via foreign nationals that actually want to live in the US. When the idea was first developed in the late 80s 1 million was a lot of money still is today but nowhere near its original impact. The amount today should be 2 million to factor in inflation. There also seems to be too much emphasis on realestate (now there might be an argument that they need the money to build things). There needs to be a greater focus on manufacturing.

Thank you so much for your excellent explanation . In a nutshell EB5-visa investor is the worst category of visa to get a green card . $500,000 or $ 1,000,000 . This is not a small amount for simple individuals . American government isn’t supportive to assist people to immigrate to the United States 🇺🇸 therefore most visa green card categories are very strict . EB5 May work out good for millionaires who are afford to pay million and all the expenses for immigration, economist and lawyer . One million is really very a huge amount then you put it in risky project you may end up with definite bankruptcy . I prefer working visa then EB5 . Hope American government change the immigration categories

There is a case in El Portal Florida where a Trailer Park Little Farm's site was bought by a company called Wealthy Delight that potentially is a subsidiary of a foreign investor (most of the EB5 Visas has gone to China, too). Hundreds of low income residents face Eviction at the end of February as El Portal City closes down the place for no apparent reason or a planned replacement for the Trailer Park in the site that was bough for $14.25 million. I read I the Story in the New Times of Miami, Florida this week, very disturbing indeed for the country's future if that is the case.

Somebody owns that land and is entitled to use it as they see fit. People living in trailer parks is not the fault of the people who own the land/business. Inflation and lack of economic opportunity is the very reason as to why people cannot afford houses not an EB5 program. The EB5 program really should be focused on wealthier investors and the minimum amount should be far higher than what it is. E-2 should be the primary visa for smaller investors who are directly running a business them self.

You are supposed to give it back with the same interest as at least a regular bank would give. However the EB 5 does state that the investor knows there is some risk to the investment.

I'm from India I have about $600,000 that I could invest, now my question being do I have to invest this money in already set up business, projects or can I come the United States and start up my own business and if it doesn't work out as in fails to create 10 jobs I can sell it and get my money back right?

You can start your own business. If it was direct what you are saying, there are ways for the business to fail and for you to be able to get your money out. You may, however, lose your Greencard if the 10 Jobs haven't been created for long enough. To preempt Arthur: Yes I am an EB5 advisor and no I don't push the "same, underhanded, not transparent garbage" that he has suggested to previous commentators
