Salaam! With all due respect to the shaykh, I respectfully disagree with the over simplification of this issue of who the Wali can be! There are collateral issues tied to this whole issue of birth rights and who is a mahram and who is not, therefore to rest the entire issue on the responsibility of the father to be the Wali or the brother or the uncle has to go back to the issue of legitimacy of the child's status in Shari 'ah! For example, were all the women that Rasulullah (SAAW) married given by their father,uncle or brother? If I'm not mistaken the woman he(SAAW) married from the Jewish tribe that the Muslims conquered all her mahram relatives were executed, plus they were not Muslims. Then there is the issue of the woman being Muslim and the family is not, as in most of the cases here in the U.S.A. first question is, was the child born in or out of wedlock? Because then she's walad az Zina, and the non Muslim father has no recognition under Shari'ah law. So now, why can't the imam be her Wali? Otherwise, this woman is doomed to be single the rest of her life because she has no legal mahram male to be her Wali? This issue has to be struggled with by ulama from this environment who have deep knowledge and experience with issues of this nature. And Allah knows best!
