How does not answering the question "Can a sitting president be required to respond to a subpoena?" not disqualify him immediately? It's not a "hypothetical", there is a very real possibility that we will have to face this situation and others like it soon, and we will need this man and the rest of SCOTUS to have far better answers. Or any answer, for that matter! Saying something is "settled law" is just another non-answer. Who does Kavanaugh thinks unsettles settled law in this country? SCOTUS. If he doesn't understand that or just believes that the rest of us don't, then he should absolutely not get a seat.

If the Democrats get their way any Republican president would spend half his time responding to subpoenas. Their proper actions under the law would be to either wait until the president leaves office or proceed to impeachment and conviction to remove the president from office. Then the former president can respond to all the subpoenas the Dems and their allies direct to him/her.

And that would have been a fine answer for Kavanaugh to have given, John, albeit a bit partisan for a SCOTUS nominee. That could be an excellent point for discussion, especially with a president who's facing multiple lawsuits already. But Kavanaugh's non-answer is just not acceptable to me when he should be fully aware that this could be a real possibility soon.

Melissa Buffaloe - When the Constitution was written, the Founding Fathers established legal immunity for the president during each presidential term of office specifically to keep the president from becoming tied up in lawsuits and personal legal controversies while in office. The Founding Fathers provided only one solution for people (like you) who are concerned about misbehavior on the part of Donald Trump. If in the opinion of members of the House of Representatives, presidential misbehavior rises to the level of high crimes and misdemeanors, then they can vote to impeach him/her. Then the president gets tried by the Senate. If they convict him, then he is removed from office and loses his legal immunity. The Democrats probably will attempt to impeach and convict Trump. But I think they will fail to remove him from office. And if Kavanaugh gets a seat in the high court he likely will (correctly, in my opinion) vote with a majority of justices to put on hold all personal (non-official) legal actions against Trump until he is no longer president.

You're making some good points, which I'm in no position to argue because I really haven't studied the topic thoroughly enough (and thankfully it's not a situation we've had to deal with all that often!). But my point is that Kavanaugh himself should have better answers. If he was making the kind of arguments that you are, I would feel better about him joining SCOTUS, but as it stands, he seems to either not have thorough knowledge of the topic, or to be avoiding it, and either one feels like it should be grounds for disqualification.

KavaNO is not eligible because he is a member of a foreign order. The Knights of Malta is the oldest order of the Vatican, it is a military order. There is a U.S. Law that forbids holding positions of office while member of foreign order, for their allegiance may not be to U.S. First. There are others in our government. Eric Prince is also a Knight of Malta. This is no Elks club.

That was a good discussion, though I would have like to see more explanation of how the extreme opinions of the judge can impact the day to day lives of Americans. Since Trump is pushing the envelope everywhere, what's at stake in the current legal opposition to Trump's most heinous agendas could have been cited as what can happen if this judge is confirmed. Even something as basic as food safety regulations could be discussed in that context in order to make real the dangers.

Kavenaugh seems like center right. What do you want? A far right justice? He sided 8 times against bush policy. He may have been on staff with bush but it doesn't look like he had much input on policy decision. In fact the emails Corey Booker just dropped show Kavenaugh advocated for race neutral policy after 2003. It states it right in the email just released. He also testifies just now 'I was not involved... in that program' more spin at DN. More disappointment from a viewer.

Marten Dekker we see what we need to confirm our bias. I see a smart, articulate moderate who has stood up (dissent) to establishment and ms positions. Remember, the seat for SCJ was open when we voted. The people voted for DJT to make the next SC nomination, not the the other guys. I did not vote for him, but I will in 2020. He's getting shit done. Msm will not report it. This was the first time in 60 years voters could knowingly vote for a lifetime judge. And Trump gave us all his choices beforehand -- unlike any candidate before him. And people cry about transparency. People have lost their ability to reason. It's unbelievable how myopic they have become.
